Abstract

Penyelesaian sengketa konsumen di luar pengadilan dapat dilakukan melalui Badan Penyelesaian Sengketa Konsumen (BPSK) dengan cara konsiliasi atau mediasi atau arbitrase (choice of law). Permasalahan yang disampaikan adalah berkaitan dengan sifat dan kewenangan BPSK termasuk sebagai quasi peradilan dalam sistem peradilan nasional dan makna final serta mengikat dalam putusan BPSK sesuai dengan makna putusan pengadilan. BPSK ini diberikan kewenangan untuk memeriksa dan memutus suatu perselisihan ataupun perkara pelanggaran hukum. Tujuan penelitian untuk menganalisis sifat final di pengadilan yang berkaitan dengan penyesaian sengketa konsumen. Untuk mencapai tujuan tersebut, penelitian dilakukan dengan metode penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka untuk menemukan aturan hukum, prinsip-prinsip hukum maupun doktrin-doktrin hukum guna menjawab permasalahan hukum yang dihadapi. Hasil penelitian menunjukkan bahwa sifat dan kewenangan BPSK termasuk sebagai quasi peradilan dalam sistem peradilan nasional diberikan kewenangan untuk memeriksa dan memutus suatu perselisihan ataupun perkara pelanggaran hukum, dan bahkan perkara pelanggaran etika tertentu dengan keputusan yang bersifat final dan mengikat (final dan binding) sebagaimana putusan pengadilan yang bersifat “inkracht” pada umumnya, dan makna final dan mengikat dalam putusan BPSK sesuai dengan makna putusan pengadilan dimana para pihak dalam upaya perdamaian membuat Putusan Akta Perdamaian yang mengikat para pihak yang tidak dapat diajukan upaya hukum apapun (final).

Abstract

This study aims to analyze the judge’s decision and considerations in the trademark dispute between Starbucks Corporation and PT. Sumatra Tobacco Trading Company, as decided in Supreme Court Decision Number 836K/PDT.SUS-HKI/2022. This trademark dispute is interesting to study because the Supreme Court stated that PT. Sumatra Tobacco Trading Company had committed trademark imitation or piggybacked on a well- known trademark, even though the trademark registered by the defendant was in a different class of goods from the plaintiff’s trademark. This study is a normative juridical study that uses both legal and case approaches. The results show that the Supreme Court, in its decision, considered PT. Sumatra Tobacco Trading Company’s actions are not based on good faith, even though the registered trademark is in a different class of goods.

Abstract

Devi Octaviani, "Legal Protection for Industrial Design Rights Holders for the Similarities of Industrial Design Products." Legal Study Program, Faculty of Psychology, Law and Social Sciences, Muhammadiyah University Purworejo, 2026. This research aims to analyze the form of legal protection for industrial design rights holders in Indonesia based on Law Number 31 of 2000 concerning Industrial Design and examine the judge's considerations in Decision Number 583 K/Pdt.Sus-HKI/2021 regarding the application of the principle of novelty. Industrial Design as part of Intellectual Property Rights has an important role in the business world because it provides aesthetic value and competitiveness of a product. Therefore, legal protection for industrial designs is essential to guarantee legal certainty and justice for rights holders. The type of research used is normative juridical research with a statutory approach and a case approach.  The research results show that legal protection for industrial design rights holders is provided through a constitutive registration system (first to file), which includes preventive and repressive protection. Preventive protection is realized through registration of industrial designs at the Directorate General of Intellectual Property, while repressive protection is provided through a lawsuit mechanism at the Commercial Court if a violation occurs. In Decision Number 583/Pdt.Sus-HKI/2021, the Supreme Court canceled the Defendant's industrial design because it did not meet the element of novelty as regulated in Article 2 of Law Number 31 of 2000. The panel of judges considered that the registered design had been previously disclosed and used by another party before the date of receipt of the application, so it was not worthy of legal protection. This decision confirms that the principle of novelty is an absolute requirement for granting industrial design rights and is the main basis for resolving industrial design disputes in Indonesia.
