Abstract

Termination of Employment Relations based on the Law No.13 of 2003 is considered necessary because it often leads to discontent for workers / laborers as has not fulfilled the right of the right workers / labor as it should. It causes the workers to fret when the worker becomes the backbone of the family, the worker / laborer has the responsibility to sustain his economic life, for it needs the protection of workers in the right that should be obtained and how to solve it. From the results of the discussion, some rights were obtained, among others, replacement money, severance pay, and term of employment and settlement of Termination of Employment including Bipartite, Mediation, Conciliation, Arbitase.

Abstract

axes are a very important source of state revenue for the implementation of national development, improving people's welfare. Determination of the imposition of Land and Building Tax on tax objects used by the state to manage, is regulated by Government Regulation. The land and building tax has been made so fairly by the government, but in reality it is felt to be unfair by the community because Land and Building Tax is an objective tax that does not view the socio-economic conditions or the ability of the community as taxpayers. The United Nations Division for the central government and regional governments has been regulated in Law No. 32 of 2004 concerning Regional Government as amended by Law No. 8 of 2005 concerning the implementation of Perpu No. 3 of 2005 concerning Regional Government into Law - 10% for Central Government 90% for Local Government.

Abstract

Meningkatnya pengangguran membawa dampak pada persaingan global dan teknologi dan lingkungan yang kompetitif. Permasalahan dalam penelitian ini adalah perlaksanaan perlindungan hukum bagi tenaga kerja outsourcing dan kendala dalam melaksanakan perlindungan hukum bagi tenaga kerja sesuai Undang- undang Nomor 13 Tahun 2003. Penelitian ini menggunakan metode yuridis normative yaitu penelitian yang menggunakan aturan hukum untuk memecahkan masalah- masalah yang terjadi dalam hubungan kerja. Hasil penerlitian ini menunjukan bahwa perlindunga terhadap pekerja/buruh dimaksudkan untuk menjamin terpenuhinya hak- hak dasar untuk mewujudkan kesejahteraan diatur dalam pasal 3,64,65,66 Undang – undang Nomor 3 Tahun 2003 tentang ketenagakerjaan. Adapun kendala dalam perlindungan dalam tenaga kerja yakni Pembatasan alur kegiatan proses pelaksanaan kegiatan, Pelaporan alur kegiatan dalam proses pelaksanaan pekerjaan, dan Pelaporan alur kegiatan dalam proses pelaksanaan pekerjaanKata Kunci : Perlindungan Hukum. The problem in this study is the implementation of legal protection for outsourced workers and constraints in implementing legal protection for workers in accordance with Law No. 13 of 2003. Abstract

Upah minimum memegang peranan penting khususnya pada pekerja/buruh dan pengusaha, pemerintah sendiri juga telah ikut serta dalam menangani masalah upah, salah satunya yang telah ditetapkan oleh Gubernur No. 560 Tahun 2017 tentang Ketetapan Upah Minimum pada 35 Kota/Kabupaten di Jawa Tengah dengan UMK tertinggi ditempati oleh semarang sebesar Rp. 2.310.087 akan tetapi hal tersebut tidak membuat pekerja/buruh di kota Semarang puas akan kebijakan dari gubernur,oleh karena itu untuk mengatasi masalah tersebut pekerja sebaiknya mengetahui mengenai faktor yang mempengaruhi,baik itu faktor yang pendukung atau penghambat dan cara melindungi pekerja/buruh tersebut. Berdasarkan dari pembahasan didapat faktor penghambat antara lain rendahnya aktivitas ekonomi, tingginya angka pengangguran dan biaya operasional yang tinggi sedangkan untuk faktor pendukung antara lain adanya kerjasama antara dinasker dan perusahaan, penetapan UMK oleh Gubernur,dsb. Untuk perlindungan pekerja terhadap pemberlakuan UMK antara lain perlindungan terhadap pekerja wanita, tunjangan, dan kewajaran upah.Kata kunci: Upah Minimum, KHLMinimum wage plays an important role especially for workers / laborers and employers, the government itself has also participated in handling wage issues, one of which has been determined by the Governor. 560 Year 2017 on the Minimum Wages Provision in 35 Cities / Regencies in Central Java with the highest MSE is occupied by Semarang Rp. 2.310.087 but it does not make the workers / laborers in the city of Semarang satisfied with the policy of the governor, therefore to overcome the problem workers should know about the factors that affect, whether the supporting factors or obstacles and how to protect the workers . Based on the discussion, the inhibiting factors are low economic activity, high unemployment rate and high operational cost, while for supporting factors such as cooperation between dinasker and company, determination of MSE by Governor, For the protection of workers against the implementation of MSEs, among others, protection of women workers, benefits, and fairness of wages.Keywords: Labor, Minimum Wage, KHL

Abstract

Child labor is a form of exploitation in employing minors for small wages. Child labor often occurs in the informal sector, such as the palm oil industry, due to the absence of formal recruitment and proper supervision of the company. Law Number 13 of 2003 concerning Manpower expressly prohibits the exploitation of children for economic motives. The purpose of this study: 1) to find out the condition of casual daily workers in the oil palm sector in Indonesia, 2) to find out the factors that influence the existence of child labor in the oil palm sector in Indonesia. 3) find out the legal efforts taken to tackle child labor in the oil palmsector in Indonesia. This study uses a normative juridical methodology by analyzing relevant studies and research on the research topic. The data obtained in this study are secondary data through journals, news, reports, and data officially published by the relevant agencies. The results showed that the underlying factors of child labor are economic, social, cultural, and educational. The efforts made in overcoming child exploitation are in the form of providing supervision and warning to companies.

Abstract

Perusahaan yang melakukan penggabungan perusahaan (merger), sudah sepatutnya pekerja mendapatkan suatu perlindungan hukum, akibat penggabungan perusahaan ini pekerjalah pihak yang dirugikan. Perusahaan harus mengupayakan agar tidak terjadi pemutusan hubungan kerja dari penggabungan perusahaan (merger) karena status hukum pekerja pada perusahaan tersebut tidak secara otomatis berakhir. Metode penelitian hukum digunakan adalah yuridis normatif yaitu dengan pendekatan  perundang-undangan yang berlaku, juga mengacu kepada studi kepustakaan, data yang diguna bahan hukum primer antara lain ketentuan peraturan perundang-undangan yaitu Undang-undang Perseroan Terbatas dan undang-undang Ketenagakerjaan, serta menggunakan bahan hukum sekunder seperti buku, jurnal hukum.Teknis analisis bersifat dekriptif, dimana teknik analisis bahan hukum secara deskriptif menggambarkan keadaan atau kondisi berupa uraian suatu posisi. Apabila perusahaan tidak mau bertanggung jawab maka pekerja dapat menutut pihak perusahaan baik melalui jalur litigasi maupun non litigasi.

Abstract

The waste problem is becoming an increasingly pressing issue as economic growth increases. With environmental conditions that have become a waste emergency, the waste management system needs to use new and more comprehensive methods. In order to realize sustainable waste management, the circular economy concept exists to offer a holistic approach that emphasizes reduction, reuse, recycling and effective waste management. In the legal context in our country, Undang-Undang No. 18 of 2008 about Waste Management is the main legal basis for regulations governing waste management. This article was written with the intention of attempting a juridical analysis of household waste management and the like by considering the circular economy concept, with a focus on the implications and potential for making related regulations that are in line with Law no. 18 of 2008. Through this approach, researchers will uncover various legal aspects that influence the success and challenges in realizing the formation of sustainable waste management regulations in Indonesia. Using normative and descriptive legal analysis methods, this article discusses various legal provisions relevant to waste management, including regulations regarding waste prevention, reduction, processing and management. Apart from that, this research also explores the basic concept of a circular economy in the context of waste management, as well as the prospects for establishing regulations in waste management practices in Indonesia.
