Abstract

Polygamy is allowed only for those who their law and religion allowing a husband to have more than a wife. Such provision has been stated in general elucidation of Marriage Law at point 4c states that “This Law encourages monogamy. Only if requested by concerned parties, under their law and religion of the concerned parties, which allowing a husband to have more than a wife.” The word “law” in general elucidation of Marriage Law at point 4c refers to the marriage law of the husband. The Judge of Religious Court may have competency to consider any reasons and requirements of request for polygamy. The Judge of Religious Court shall try the case and render its judgment in accordance to the prevailing laws, Al Qur’an, Al Hadits, and the opinion of Islamic scholars. The judgment must have clear and suffi  cient consideration, in which the judge may base its verdict. Article 62(1) of Law No. 7 of 1989 concerning Religious Court provides that all ex parte decisions and judgments rendered by the court shall contain sufficient consideration and refer to certain rules of the prevailing laws both written or unwritten regulation.

Abstract

Penyelesaian perkara melalui lembaga adat dilakukan dengan asas musyawarah atau kekeluargaan untuk menegakkan hukum, dan menghilangkan akibat lanjut dari suatu perkara. Tujuan tertinggi yang ingin dicapai adalah keseimbangan yang terwujud dalam kerukunan masyarakat. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan historis dan perundang-undangan terkait pembuktian dalam penyelesaian sengketa adat pada peradilan adat. Berdasarkan hasil penelitian diketahui Pembuktian dalam peradilan adat dilakukan oleh para pihak yang bersengketa dan peran aktif dari pemuka adat. Dalam peradilan adat penyelesaian sengketanya dilakukan secara damai, sehingga pembuktiannya ada yang dilakukan para pihak dan ada yang dilakukan oleh pemuka-pemuka adat yang memeriksa perkara. Alat bukti yang digunakan adalah alat bukti tertulis (surat), saksi, keterangan para pihak dan perilaku dari para pihak di tengah-tengah masyarakat.

Abstract

Dalam prakteknya perjanjian leasing ini banyak terjadinya wanprestasi yang menimbulkan sengketa antara pihak lessor dengan lessee. Penyelesaian sengketa yang dipilih oleh lessee (konsumen) adalah melalui Badan Penyelesaian Sengketa Konsumen (BPSK). Putusan BPSK dalam penyelesaian sengketa leasing ini sering diajukan keberatan terhadap putusan BPSK ke Pengadilan Negeri, dan putusan Pengadilan Negeri selalu membatalkan putusan BPSK dengan pertimbangan BPSK tidak berwenang memutus perkara antara perusahaan pembiayaan dengan konsumen karena hubungan hukum antara konsumen dengan pelaku usaha merupakan perjanjian bersama dengan penyerahan harta secara fidusia. Menurut Mahkamah Agung sengketa leasing tidak termasuk dalam sengketa konsumen, sementara konsumen mengajukan gugatannya ke BPSK. Sengketa leasing sebagai sengketa di bidang lembaga keuangan diatur dalam POJK Nomor 1/POJK.07/2014 Tentang Lembaga Alternatif Penyelesaian Sengketa Di Sektor Jasa Keuangan, Sengketa leasing merupakan sengketa konsumen di sektor jasa keuangan yang telah mempunyai aturan khusus dalam penyelesaian sengketanya di luar pengadilan melalui LAPS sebagaimana yang diatur dalam POJK Nomor 1/POJK.07/2014 Tentang Lembaga Alternatif Penyelesaian Sengketa Di Sektor Jasa Keuangan. Adapun sarannya adalah Adanya harmonisasi peraturan perundang-undangan yang terkait dengan perlindungan konsumen terutama tentang penyelesaian sengketa konsumen di luar pengadilan, sehingga tidak ada kerancuan dalam pelaksanaannya. Para hakim harus lebih memahami dan melaksanakan peraturan perundang-undangan yang berlaku khususnya dalam penyelesaian sengketa leasing.

Abstract

Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan belum mengatur semua aspek yang terkait dengan perkawinan, salah satunya adalah perkawinan beda agama. Perkawinan beda agama bukan merupakan hal baru bagi masyarakat Indonesia, padahal dalam undang-undang a quo, perkawinan disahkan berdasarkan hukum agama, mayoritas agama yang ada di Indonesia pun melarang adanya pernikahan tersebut. Namun, hak asasi manusia menegaskan bahwa kebebasan melangsungkan perkawinan dan memeluk agama merupakan hak dasar yang tidak dapat diintervensi oleh siapapun. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif dan bersifat deskriptif-analitis, berdasarkan studi kepustakaan. Hasil penelitian menunjukkan bahwa larangan perkawinan beda agama selaras dengan nilai-nilai Pancasila, khususnya sila pertama, Ketuhanan Yang Maha Esa. Perkawinan tidak hanya dilihat dari sisi formal, tetapi juga aspek spiritual dan sosial. Secara hukum, perkawinan beda agama dianggap tidak sah menurut hukum positif maupun agama. Anak yang lahir dari perkawinan semacam ini dikategorikan sebagai anak luar kawin, sehingga hanya memiliki hubungan perdata dengan ibu dan keluarga ibunya. Konsekuensinya, anak tersebut tidak memperoleh hak waris dari ayahnya, kecuali melalui wasiat wajibah, hibah, atau hadiah.

Abstract

This research examines the legal status of Cash Waqf for Prospective Brides and Grooms (WTC) in islamic regulatory frameworks to ensure legal certainty and enhance transparency. This research is a descriptive normative juridical research with statute approach and conceptual approach. The results of this research indicate that the normative status of WTC remains unclear, leading to legal uncertainty and gaps that need to be addressed immediately. Substantively, WTC aligns with maqashid syariah as it is oriented towards strengthening family economic resilience. However, in practice, it has not been realised due to unclear guidelines for implementation, low wakaf literacy, a lack of transparency, conflicts with extortionate fees, and the failure to distribute benefits effectively. This research recommends that WTC need to be supported by technical regulations aligned with national waqf law, involving BWI and the Ministry of Religious Affairs and that the concept of mashlahah mursalah serve as the foundation for drafting family-oriented regulations, such as BWI decrees, circular letters, and operational guidelines for the WTC. The optimalisation of the role of the BWI, the Ministry of Religious Affairs, and the BWI representatives, and strengthening of transparency through a real-time dashboard similar to the 'SatuWakaf' system.

Abstract

The construction of BAZNAS’s civil liability in cases of unlawful acts in zakat management arises from the absence of explicit regulation in Law No. 23 of 2011. The research employs a normative legal method using statutory and conceptual approaches through the analysis of primary, secondary, and tertiary legal materials. The findings indicate that although not expressly regulated, BAZNAS may still be held civilly liable based on Articles 1365–1367 of the Indonesian Civil Code, the principles of good governance contained in the Administrative Governance Law, and constitutional guarantees of legal protection. The discussion further emphasizes that BAZNAS’s civil liability may take the form of material and immaterial compensation, restitution, and mandatory systemic improvements to prevent future violations. The study concludes that mechanisms of civil liability remain applicable and relevant to BAZNAS, even though they are not explicitly formulated within the Zakat Management Law.

Abstract

This study examines the effectiveness of marriage dispensation adjudication in protecting children’s rights following the enactment of Supreme Court Regulation (PERMA) No. 5 of 2019. Although Law No. 16 of 2019 raised the minimum marriage age to 19 years for both men and women, marriage dispensation applications remain prevalent, raising concerns about the consistency of child protection in judicial practice. This study analyzes how PERMA No. 5 of 2019 is implemented in marriage dispensation decisions and evaluates the extent to which the principle of the best interests of the child is incorporated into judicial reasoning. Using normative legal research with statutory and conceptual approaches, the study analyzes primary, secondary, and tertiary legal materials through qualitative descriptive-analytical methods and legal interpretation. The analysis indicates that PERMA No. 5 of 2019 strengthens judicial scrutiny by requiring greater consideration of children’s welfare, but its effectiveness remains constrained by social, economic, educational, and cultural circumstances. Premarital pregnancy, economic hardship, limited educational opportunities, and social norms that normalize early marriage continue to influence judicial considerations and dispensation applications. These conditions create a gap between normative child protection standards and their practical implementation. This study contributes to the discourse on judicial discretion by emphasizing the need for consistent child-centered interpretation, stricter assessment of urgent circumstances, and stronger preventive policies addressing the structural factors underlying child marriage.

Abstract

S Surrogacy, a reproductive technology where a woman carries a pregnancy for another party, presents a complex legal and ethical dilemma in Indonesia. This article analyzes the legal vacuum (rechtsvacuum) surrounding this practice from the dual perspectives of Indonesian positive law and Islamic law. This research employs a normative juridical methodology, utilizing statute, case, and comparative approaches to dissect the existing legal framework. The analysis reveals that Indonesian positive law, particularly Law No. 36 of 2009 on Health (now superseded by Law No. 17 of 2023) and the Civil Code (KUHPerdata), implicitly prohibits surrogacy by restricting assisted reproduction to married couples using their own gametes and the wife's womb, and by rendering surrogacy contracts legally void for violating the principles of a "lawful cause" and "public morality." Consequently, children born from surrogacy face profound legal uncertainty regarding their status, inheritance, and parentage. From the Islamic law perspective, the Indonesian Ulema Council (MUI) has issued a definitive fatwa declaring surrogacy haram (forbidden), primarily based on the principle of Hifdz an-Nasl (protection of lineage) and the jurisprudential method of Sadd al-Dzari’ah (blocking the means to evil) to prevent the confusion of lineage and the commodification of the human body. The existing legal void creates significant risks, including the exploitation of women and legal disputes over the child's welfare. This article concludes that maintaining the status quo is untenable and recommends the urgent formulation of a specific, comprehensive law on assisted reproductive technology that explicitly regulates or prohibits surrogacy to provide legal certainty, protect the rights of all parties involved, and align with Indonesia's socio-legal values Keywords : Child's Legal Status, Islamic Law, Legal Vacuum Surrogacy, Positive Law
