Abstract

Tindak pidana korupsi merupakan permasalahan yang saat ini dirasakan semakin pesat perkembangannya seiring dengan semakin maju pembangunan suatu bangsa, maka semakin meningkat pula kebutuhan dan mendorong untuk melakukan korupsi.Menurut Azyumardi, tinggi atau rendahnya korupsi tidak banyak terkait dengan agama, tetapi lebih terkait dengan tatanan hukum yang tegas dan diiringi dengan penegakan hukum yang keras terhadap para koruptor. Harus diakui, bahwa agama lebih merupakan imbauan moral, meskipun agama juga memberikan sanksi hukum bagi pelaku yang melakukan suatu jarimah atau tindak kriminalitas—seperti korupsi, hukum itu umumnya hanya berlaku di akhirat kelak.

Abstract

Secara umum perjanjian perkawinan berisi tentang pengaturan harta kekayaan calon suami istri. Sedangkan tujuannya untuk mengatur akibat-akibat perkawinan yang menyangkut harta kekayaan.Di dalam Hukum Islam perjanjian perkawinan ini baru sah apabila dibuat sebelum atau pada saat perkawinan, sesuai dengan ketentuan Pasal 47 ayat (1) KHI, yaitu : “Pada waktu atau sebelum perkawinan dilangsungkan kedua calon mempelai dapat membuat perjanjian tertulis yang disahkan Pegawai Pencatat Nikah mengenai kedudukan harta dalam perkawinan” Adalah lebih baik jikalau perjanjian perkawinan itu dilakukan lebih dahulu sebelum perkawinan, ditandatangani dan dibacakan atau dilafazkan sesudah perkawinan.

Abstract

Tindakan debitor yang melakukan perbuatan melawan hukum yaitu kelalaian dan kesengajaan. Berdasarkan ketentuan Pasal 41-49 Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang hanya mengatur perbuatan melawan hukum debitur yang dilakukan satu tahun sebelum putusan pailit diucapakan, dalam perbuatan melawan hukum ada dua tindakan yaitu perbuatan melawan hukum kelalaian dan kesengajaan. Jika sampai waktu ditentukan debitur tidak membayar dan melakukan itikad buruk maka pengawas hakim atau kreditur dan pihak lain menyatakan bahwa berakhirnya penundaan pembayaran sesuai ketentuan yang diatur oleh hukum kepailitan. Penulis menyarankan sudah sepantasnya pemerintah merevisi kembali Undang-Undang Nomor 37 Tahun 2004 dalam penambahan pasal-pasal yang berkaitan dengan hukum kepailitan Indonesia termasuk diantarnya pasal-pasal ketentuan mengenai sanksi pidana, yang akan dikenakan kepada debitur. Dari berbagai pasal yang diatur dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang (PKPU) idealnya harus mengikuti perkembangan masyarakat agar tidak terjadi kerancuan dan ketidakpastian dalam rangka untuk menjamin keadilan bagi pihak yang dirugikan oleh debitor

Abstract

The COVID-19 pandemic situation has caused the destruction of economies throughout the world, including Indonesia. The negligence of the debtor due to the COVID-19 pandemic can be used as a reason to apply for a postponement of debt obligations. Due to the Covid-19 pandemic which disrupts the financial stability of the debtor, so that the debtor cannot pay off his debt or is negligent to the creditor, he can apply for a suspension of debt payment obligations. On the basis of the covid-19 pandemic, that the impossibility of carrying out the contract in the form of financial incapacity. UUK & PKPU provide legal protection to debtors in the midst of the covid-19 pandemic so they don't fall into bankruptcy through PKPU as stipulated in article 222 of the UUK & PKPU. The type of research used is normative legal research. The practice of paying debts through applications for postponement of debt payment obligations (PKPU) based on Law No. 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations, which starts from the procedure for submitting a PKPU application, temporary PKPU, publication of PKPU decisions, receipt of invoices, making a list of temporary receivables, implementation of the reconciliation meeting for the preparation of a list of permanent receivables, a discussion meeting on the reconciliation plan which includes restructuring of offers to creditors related to the reconciliation plan. The postponement of debt payment obligations (PKPU) is not enough to provide an opportunity for debtors with good intentions to carry on their business. Because the peace process is determined by the creditor, the UUK & PKPU require a reconciliation process with the approval of the creditor. The rules of Article 229 UUK & PKPU give full power to creditors, this causes debtors to depend on the decisions of creditors.

Abstract

The purpose of this journal is to find out the policies of the parties regarding delaying the fulfillment of business contract agreements during the Covid-19 pandemic and to find out the impact of delaying the fulfillment of business contracts for the parties during the Covid-19 pandemic. The research method uses the juridical-normative method. The results of the research method concluded that: 1). If the Covid-19 pandemic is included in a force majeure situation, the parties can take a policy to terminate the agreement if the pandemic is permanent or can delay the fulfillment of achievements if the situation is only temporary. 2). The impact of the current pandemic is that the parties have to temporarily postpone the contract that was agreed before the Covid-19 pandemic occurred due to restrictions on community activities whose rules have been conveyed by the Indonesian government. The delay to fulfill the achievement itself must get approval from both parties so that there is no broken promise (default).

Abstract

In the development of bank credit, the provision of credit to the public has followed a new pattern, in which the provision of credit takes the form of an application by way of payment or transfer of rights (cessie), replacement of creditor rights (subrogation) or renewal of debt (novation) for research and writing. created and compiled using normative juridical research methods relating to subrogation, cessie and novation in bank credit. The results of this study are that the transfer or transfer of rights (cessie), replacement of creditors due to payment (subrogation) or renewal of debt (novation), are legal actions that are often carried out by banks related to credit extended to the public which are variations and patterns in credit distribution. In this case, credit facilities as the main activity of banking institutions have had the same construction since long ago, but currently the development is leading to various patterns combining technological developments with market segments and accompanying regulations.
