Abstract

Notary is an official appointed by the Government based on the Notary Position Regulation to be able to make a deed. The Notary is required to be responsible for the contents of the deed made by the parties so that it does not contradict the Regulation of the Notary Position, and or does not make a deed that does not meet the requirements in advance of shipping or contrary to the provisions of Article KUHPEr. So that the Notary in carrying out his responsibilities must not conflict with the authority specified in the regulations. One deed that can be made by a Notary Public is a certificate of inheritance SKW. In practice the making of SKW is not as small as a Notary who was fooled in bad faith from the parties in terms of the contender giving a fake Birth Certificate so that the Notary Public means that those who are facing are the heirs who should and are entitled to and get an inheritance. But related to this matter, if in the future the SKW is problematic it will not be the responsibility of the Notary. Civil liability can occur in 2 cases Acts against the Law and Default. Violation of Unlawful Acts by a Notary is to act beyond or contradict the responsibility that has been given to him as stipulated in the regulations relating to the making of the deed. The practice that becomes the responsibility of a notary in making SKW is as follows: First, Error in applying the article related to the distribution of inheritance. Second, mistakes in determining the parties who become heirs in good faith. Third, the error determines the amount of distribution for each heir determined by SKW. Fourth, the testator's will is not included in the SKW made by the parties. Notary in practice can avoid this risk if among the Notary professions determine and determine the procedures and prerequisites for making and format of SKW as the notary profession agrees to the code of ethics so that uniformity of the Notaries in making SKW thus prevents the Notary from legal liability that should be can be avoided in carrying out his responsibilities as a Notary

Abstract

Kepadatan Bandara Adisutjipto di Yogyakarta dikarenakan kesediaan lahan sangat terbatas. Berdasar kondisi tersebut PT Angkasa Pura I (Persero) selaku pengelola bandara mulai mencari alternatif lahan baru. Setelah melalui pencarian dan pertimbangan beberapa tempat, maka dipilihlah lahan di Kecamatan Temon, yang terdiri dari 5 desa, yaitu Desa Jangkaran, Desa Sindutan, Desa Pilihan Desa Kebonrejo, dan Desa Glagah. Dalam rangka pembebasan tanah ini banyak hal dan peraturan yang harus diperhatikan dan dipatuhi. Undang-Undang Nomor 2 tahun 2012 tentang Pengadaan Tanah bagi Pembangunan untuk Kepentingan Umum, dan Peraturan Pemerintah Nomor 71 tahun 2012 tentang Penyelenggaraan Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum merupakan peraturan utama yang dipergunakan untuk melaksanakan pembebasan tanah guna lokasi pengganti Bandara Adisutjipto. Oleh karena itu kami ingin meneliti lebih jauh lagi tentang pelaksanaan pembebasasan tanah tersebut serta dampaknya bagi masyarakat sekitar. Hasil penelitian ini adalah pelaksanaan pengadaan tanahuntuk pembangunan bandara di Kulon Progo di Daerah Istimewa Yogyakarta saat ini sedang berlangsung. Hal ini terjadi karena pembangunan bandara baru di Daerah Istimewa Yogyakarta merupakan pelaksanaan Program Nasional sektor Perhubungan Udara (Berdasar RPJMN tahun2010-2014 dan RPJMN 2015-2019). Pembangunan ini juga menimbulkan manfaat sosial dan ekonomi bagi masyarakat sekitar di Kulon Progo di Daerah Istimewa Yogyakarta.

Abstract

Coral reef is an underwater biodiversity great in value. Sovereignty of the state to explore its natural resources is deeply recognized by international law. On the other hand, the state must also guaranteethe preservation of its natural resources. This research will explain about state responsibility (Indonesia)upon the damage of the coral reefs based on Convention on Biodiversity in Kepulauan Seribu. Terumbu karang merupakan salah satu kekayaan laut yang sangat tinggi nilainya. Hukum internasional mengatur bahwa meskipun suatu negara berdaulat penuh atas wilayahnya, negara tersebut berkewajibanuntuk tidak merusak lingkungan. Penelitian ini menganalisis mengenai tanggung jawab Indonesia sebagainegara peratifikasi Konvensi Keanekaragaman Hayati 1992 sehubungan dengan kerusakan terumbu karang di Kepulauan Seribu.

Abstract

Disaster management is a critical component of national development, particularly in the aftermath of natural disasters. The relocation process of liquefaction disaster survivors in Petobo, located in South Palu, Central Sulawesi, underscores the pivotal role of the government in safeguarding Indonesian citizens' rights, including providing adequate housing within a healthy and secure environment. This research was conducted in the wake of the disaster with the primary objective of evaluating the legal protection and human rights afforded to survivors residing in Petobo Village, which has been designated as a red zone due to the severity of the disaster. The study uncovered significant damage to infrastructure, loss of life, and ecosystem degradation as direct consequences of the disaster. These findings underscore the government's obligation to provide permanent housing (hence HUNTAP) to fulfill the basic needs of survivors. Providing decent housing is fundamental to ensuring the well-being and dignity of every citizen affected by the disaster. Moreover, it aligns with the core principles of citizenship and human rights, which are essential for fostering sustainable and harmonious communities, particularly in regions grappling with the aftermath of natural calamities. Shortly, the relocation of liquefaction disaster survivors in Petobo, South Palu, Central Sulawesi, highlights the government's pivotal role in safeguarding its citizens' rights, especially in times of crisis. By prioritizing permanent housing and ensuring a healthy and secure environment for survivors, the government demonstrates its commitment to upholding human rights and fostering resilient communities in disaster-affected areas.

Abstract

In many cities in Indonesia street vendors have given a quite significant contribution to the local’s economy. However, their physical existence oftenly gives an undesirable impact to the area itself. Aligned with the concept of regional autonomy which is regulated in the Law No 32/2004 concerning the Regional Autonomy, which was later revised by the Law N0 23/2014, provincial government has the rights as well as responsibilities to manage some of the governmental matters. The authority of Kota Bandung had issued the Regional Law No. 4/2011 concerning the management of street vendors. One of the essential matters in the respected law is the categorization of the areas for vending into three zones. One of those is the red zone, within which vendors are not allowed to exist physically, nor to have business activities. Nevertheless the law aims to accommodate as well as to manage street vendors, so that they could positively contribute to the city. This research examined whether or not law is properly implemented. It is found that the efforts to accommodate the vendors from the authorities have not been carried out optimally. The only attempt to enforce the law concerning the red zone is the repressive kind, with no permanent results of discontinuity from the part of the vendors to operate their business some time after. Almost all of the vendors interviewed stated that they had never been engaged in any form of efforts from the local government.

Abstract

Abstract The effort to acknowledge as well as to protect intellectual works have been done not only in the view of protecting the so-called intellectual property rights but also preserving the works itself. For the later, the attempt is represented in Law No 4/1990 which obligate publishers and recording companies to deposit a stipulated number of copies of their work in determined libraries. This national level policy followed by quite a lot of provinces resulting in the formation of regional regulations concerning the same matter. However, only few of those use criminal law instrument. Since this is a multiperspective research, Regional Regulations of Sumatera Barat No. 9/2014 is deemed to fit the study because it comprises criminal provisions, business law aspects, and also private law issues. This research examines the implementation of the law from three standpoints: i) the implementation of the criminal provisions, ii) how its implementation protects the rights of the owner of the works as well as their benefit from the view of business law, and iii) the private legal relation between the parties of deposit arrangements. The research found that: i) the criminal provisions have not been enforced because the authority has not been equipped by civil investigator; ii) Dinas Kearsipan&Perpustakaan Kota Padang has done full effort in registering the works in order to have them deposited in the library, eventhough constraints related to budget delimitates the attempt. By this reason the protection and benefit for the owner has not been fully achieved; iii) there is neither special agreement nor any arrangement found in the relation between parties.
