Infant’s right on exclusive breastfeeding has been protected on Law No. 36/2009 on Health. One of the measurements in its protection is by using criminal provision. It is stated in Art. 200 and 201, each of which has criminal sanction to those obstructing the exclusive breastfeeding program. As an effort to implement this national policy, quite a numerous of provinces or even lower administrative regions had issued regulations concerning the same matter. Some of them have criminal provision as well, as can be seen in City Regulation of Cirebon No. 4/2016 on Early Initiation and Exclusive Breastfeeding and also in the City Regulation of Semarang No. 5/2014 on Early Initiation and Exclusive Breastfeeding. This paper will assess specifically the criminal provisions on those regional laws in a comparative perspective. The selection of the two laws is based on the preliminary study which found a quite unique form of criminal provisions on each laws. The analysis is also be based on art 200 and 201 Law No. 36/2009 and its derivative regulations as a normative measurement in national level, with which the two regional laws must be in line to. This research found that there are quite a significance differences between the two laws especially regarding the form of action that is criminally regulated. Variation also found on how the two laws fulfil what is demanded by the national criminal policy.

The role and number of women workers is considerably significant in Indonesia. It is important then, to assure that their rights are well protected. One of the rights is the right of maternity leave. Article 82 Par (1) Law Number 23/2003 on Labour as the only provision that regulates this right in Indonesia, in which the time scheme on when do pregnant workersstart their maternity leave has been arranged, is deemed to be a potential determinant in causing a failure of exclusive breastfeeding. This is because the unclear interpretation generated from the formulation of the article. This paper would present an analysis on Article 82 Par (1) as well as academically-based suggestion on how should the article is interpretedin the light of the right of the infants to be exclusively breastfed.

Medical negligence in Indonesia can be considered as criminal conduct. Though the nature of medical contract—relationship is private, but it is considered to have public aspects. The criminalization of medical negligence is intended to protect citizen from any malpractice by medical workers. While there are enough lawsuits and cases being reported to the police, yet the conclusions are still in the shadow. There are some rules regarding some standards, either it is on the medical treatment procedures, or on the terms and procurements of the medical workers. Interestingly, failing on these standards come along with criminal punishment on. Yet, in some cases, we found out that criminal punishment being ruled out. Instead, the proceeding uses restorative justice. Restorative justice is a state of the art criminal proceeding that weighing on repairing damages on victim, caused by criminal conduct—than to punish the perpetuator. Using theories within the Criminal Study like the “goals of punishment”, justice theories, and restorative justice theories as well; we conclude that the switch of punishment into other obligation for victim’s sake is a good application of restorative justice

Pekerja perempuan di Indonesia memegang peranan yang cukup signifikan baik dari segi jumlah maupun perannya. Oleh karenanya hukum ketenagakerjaan haruslah dapat memberikan perlindungan bagi hak-hak dari pekerja perempuan. Salah satu hak yang penting pengaturannya adalah hak atas cuti melahirkan. Pasal 82 Ayat (1) adalah satu-satunya ketentuan yang mengatur mengenai masa cuti melahirkan. Di dalam ketentuan tersebut diatur tentang kapan pekerja perempuan memulai cuti melahirkan. Di lain pihak, Indonesia mempunyai ketentuan di dalam Pasal 128 Ayat (1) UU No. 36 Tahun 2009 tentang Kesehatan, dimana di dalamnya diatur bahwa bayi mempunyai hak untuk mendapatkan ASI Eksklusif. Artikel ini akan membahas mengenai rumusan dari Pasal 82 Ayat (1) yang dapat menghambat terpenuhinya hak bayi atas ASI Eksklusif. Artikel ini sekaligus juga akan memaparkan mengenai bagaimana seharusnya Pasal 82 Ayat (1) diartikan dan dilaksanakan, sehingga tidak menjadi penghambat dalam pemenuhan hak bayi akan ASI Eksklusif tersebut.

Di dalam kehidupan sehari-hari banyak ditemukan seorang pelaku melakukan lebih dari satu perbuatan pidana yang saling berkaitan. Terhadap kondisi seperti itu KUHP telah mempunyai aturan tersendiri, yang dimuat di dalam Pasal 64. Putusan hakim terhadap sebuah perkara pidana merupakan cerminan dari bagaiaman aturan-aturan pidana materiil diterapokan dalam sebuat peristiwa pidana yang konkret. Putusan hakim tersebut juga diharapkan tidak hanya memuat keadilan tapi juga berdasarkan suatu argumentasi dan logika hukum yang sesahih mungkin. Oleh karean itu, bagaiamana hakim menjelaskan dasar dari putusannya di dalam sebuah putusan perkara pidana menjadi penting. Penelitian ini menganalisis mengenai bagaiamanakah peraturan perbuatan berlanjut dalam Pasal 64 KUHP diterapkan dalam tiga putusan perkara pidana. Pemilihan perkara pidana dialukan berdasarkan kesederhanaan dari tindak pidana pada setiap putusan dengan tujuan agar analisis dapat berfokus pada unsur-unsur dalam Pasal 64 KUHP, tanpa adanya unsur-unsur yang kompleks dari tindak pidananya sendiri. Penelitian ini adalah penelitian yuridis normative denga pendekatan undang-undang. Hasil penelitian menemukan bahwa pada ketiga putusan perkara pidana yang diteliti tidak dijelaskan bagian manakah dari perbuatan terdakwa yang dianggap oleh hakim telah memenuhi unsur “terdapat kaitan sedemikian rupa di antara setiap perbuatan yang dilakukan’. Padahal unsur tersebut merupakan unsur yang paling esensial dari Pasal 64 KUHP.

Pasal 200 UU No. 36/2009 Tentang Kesehatan mengatur bahwa setiap orang yang dengan sengaja menghalangi pelaksanaan program ASI eksklusif diancam dengan sanksi pidana. Walaupun demikian, penegakan hukum atas pasal ini belum berjalan dengan baik. Di lain pihak ibu menyusui adalah subjek sentral dari pelaksanaan ketentuan ini. Penelitian ini membahas mengenai mengapa penegakan hukum Pasal 200 belum berjalan namun dilihat dari aspek budaya hukum ibu menyusui sebagai elemen penting bagi penegakkan hukum. Kesimpulan penelitian ini adalah bahwa budaya hukum responden ibu menyusui merupakan salah satu factor yang mendasari keputusan responden untuk tidak menggunakan Pasal 200 ketika hak nya dilanggar

Coral reef is an underwater biodiversity great in value. Sovereignty of the state to explore its natural resources is deeply recognized by international law. On the other hand, the state must also guaranteethe preservation of its natural resources. This research will explain about state responsibility (Indonesia)upon the damage of the coral reefs based on Convention on Biodiversity in Kepulauan Seribu. Terumbu karang merupakan salah satu kekayaan laut yang sangat tinggi nilainya. Hukum internasional mengatur bahwa meskipun suatu negara berdaulat penuh atas wilayahnya, negara tersebut berkewajibanuntuk tidak merusak lingkungan. Penelitian ini menganalisis mengenai tanggung jawab Indonesia sebagainegara peratifikasi Konvensi Keanekaragaman Hayati 1992 sehubungan dengan kerusakan terumbu karang di Kepulauan Seribu.

This study aims to describe the internalisation of justice based on Pancasila in the concept of criminalization and analyse the criminal provisions of the exclusive breastfeeding program from the perspective of criminalization based on Pancasila justice. This study is included in normative legal research. The results of the study show that the handling of criminalization must be in accordance with the concept of justice from the Pancasila perspective which contains two main elements, namely proportionality and the principle of kinship to maintain unity. The crime of exclusive breastfeeding programs is related to the denial of obligations carried out by families or corporations to provide time and facilities to support exclusive breastfeeding. Criminal sanctions for actions that do not support the implementation of the exclusive breastfeeding program in the form of imprisonment, fines or additional penalties as regulated in Article 430, Article 447 and Article 448 of Law Number 17 of 2023 are not in accordance with the concept of justice based on the Pancasila perspective because they do not meets the aspect of proportionality and does not reflect the principle of kinship.

Art 80 and Art 76C of Law No. 35/2014 purports to protect children from domestic violence (including most importantly those committed by the mother of the child). This article using empirical juridical purports to analyze what factors are influential in determining compliance. Primary data is collected using purposive sampling technique and subsequently is analyzed qualitatively. The main result of the research is that avoidance of penal sanction is not a significant role in determining legal compliance. More significant or influential are factors such as the extent or level of understanding the rule’s purpose or values behind the existing rule (prohibiting domestic violence), the need to maintain good relationship with the child; identification of the mother with certain groups in society and personal values.
