Abstract

This study aims to determine the accountability of shareholders in an individual company in the perspective of Job Creation Law ( as known as Undang-undang Cipta Kerja) and related Government Regulations. This research is a normative juridical study which is based on library-literal research in order to obtain secondary data. Data obtained from legal principles, regulations, and books were analyzed using qualitative methods. This qualitative research produces descriptive-analytical data. The results showed that shareholders in an individual company are only responsible for the shares they own , as long as there are no exempt matters as mentioned in Article 153 J paragraph 2. Based on the results of the research, the authors suggest two things, which are, first for individual company shareholders should run the company in good faith so that the individual company can be utilized properly in accordance with the philosophy of its formation. , secondly, the executive and legislative bodies should be able to make clearer rules regarding the establishment, amendment and discontinuation of individual companies  and also supervision due to there is no notary role in the establishment, amendment and dissolution of individual companie.

Abstract

Gender equality is an interesting issue to discuss if you look at the pros and cons that are often attached to this issue. The issue of gender equality began to spread in Indonesia in the 1990s. Many people misinterpret gender equality as if it is seen as an act or desire to put women in the world first. However, this is not the goal of gender equality itself. This study uses a qualitative descriptive method, research data obtained by analyzing, describing, and summarizing various conditions, situations from various data collected in the form of interviews or observations regarding the problems studied that occur in the field. To help village development based on the SUSTAINABLE DEVELOPMENT GOALS (SDGs) it must include 8 goals so that the millennium development goals can be fulfilled in accordance with what has been set by the government, regardless of everyone's gender.

Abstract

The rights of customary law communities are divided into two, namely individual and communal rights. The land tenure of customary law communities contained in the UUPA is a customary right (territory) to show to the land which is the environmental area of the legal community concerned. One of the problems related to customary land in Batu Belah Village is regarding the boundaries of the land. Unclear customary land boundaries give rise to disputes. The same thing ultimately hinders the process of registering customary land in Batu Belah Village, Kampar Regency. Based on this background, the main issues that the author wants to raise, among others, are first, How is the protection of customary land laws in Batu Belah Village, Kampar Regency? Second, what is the status of customary land in Batu Belah Village, Kampar Regency?, The type of research used by the author is sociological legal research, sociological legal research is also called empirical law research. The results of the study show that Batu Belah Village, Kampar Regency has not been registered because of several constraints. Thus, until now customary land in the region has not had a clear legal basis and is only interpreted on the basis of customary recognition in the sense that it has not received clear legal protection.

Abstract

Women's political rights are a centuries-long struggle. Women, who have often been considered second-class citizens, are struggling to gain the same rights as men in participating in political life. The struggle for women's political rights in Indonesia, including in Indragiri Hilir Regency, is an integral part of the history of the struggle for gender equality globally. Although there has been significant progress, there are still many challenges faced by women in accessing and exercising their political rights. Therefore, this research will discuss the urgency of women's political rights in the DPRD of Indragiri Hilir Regency in order to realise gender equality. Reasearch methods was Yudicial empiric methods. The results showed that women in the Regional People's Representative Council (DPRD) Indragiri Hilir Regency are very minimal, so this requires a new policy to provide space for women's representation in the Regional People's Representative Council (DPRD) Indragiri Hilir Regency. Although there is an increase in the number of women who occupy political positions, especially at the legislative level, the number of women's representation still does not reach the ideal target, as stated in Law Number 7 of 2017 concerning General Elections.

Abstract

Advokat merupakan orang yang berprofesi memberi jasa hukum, baik didalam maupun diluar pengadilan. Dalam menjalankan tugas atau profesi sebagai advokat, ada kode etik atau pedoman yang harus dijadikan pijakan oleh para advokat. Disamping itu juga ada hak dan kewajiban yang harus dilaksanakan oleh advokat dalam memberikan jasa bantuan atau pendampingan hukum bagi kliennya. Hal tersebut secara tegas diatur dalam Undang-undang Republik Indonesia Nomor 18 tahun 2003. Diantara hak-hak seorang advokat yaitu memiliki hak independence, hak imunitas, hak meminta informasi, hak ingkar, hak untuk menjalankan praktek peradilan di seluruh wilayah indonesia, hak berkedudukan sama dengan penegak hukum lainnya. hak memperoleh honorium dan melakukan retensi, hak untuk melindungi dokumen dan rahasia klien, hak memberikan somasi dan hak membuat legal coment atau legal opinion. Selain hak-hak tersebut, advokat memiliki kewajiban menjunjung kode etik profesinya, menegakkan hukum termasuk supremasi hukum dan hak asasi manusia dan bersungguh - sungguh melindungi dan membela kepentingan kliennya dalam hal jasa hukum tertentu yang telah mereka perjanjikan.

Abstract

This study examines the regulation of the position of the State Civil Apparatus (ASN) in the context of General Elections (Pemilu) in Indonesia. This research uses normative juridical method with qualitative descriptive analysis approach. Regulations on the position of civil servants are very clearly regulated in the legislation on how to regulate civil servants to be more optimal in supporting government activities to benefit the community as much as possible and be fair and always maintain neutrality in elections. Based on the results of the study, there are several regulations governing the position of civil servants in elections in Indonesia, namely the 1945 Constitution, the Civil Service Law, the Election Law, the Corps Life Government Regulation and the Civil Servant Code of Ethics, the Government Regulation on Civil Servant Discipline, and the Circular Letter of the Chairman of KASN concerning the Neutrality of Civil Servants.

Abstract

This research reveals how the role of academics can help the community in Sungai Tonang Village, Kampar Utara District, Kampar Regency, become more legally aware of how to prevent forest and land fires (karhutla). In this case, academics successfully conveyed the message of forest and land fire preventuin through a community service method that combines legal education, socialization, and local cultural approaches such as the Balimau Kasai tradition and the art of calempong baoguong music. The method used in this case in through intial data collection and direct soxialization with community leaders and village officials to addres the low legal literacy and environmental the law better, pay more attention to the environment, and have more environmental monotioring groups working to prevent forest fire. A synergistic collaboration model between academics, government, and society is used to adderss challenges such as limited funding, reduced trust in formal law, and limited outreach for socialization. In short, the success of sustainable forest and land fire prevention in Sungai Tonang Village, in addition to increasing socio-economic resilience and environmental conservation, depends on cross-sectoral cooperation and the utilization of cultural approaches.
