Abstract

ABSTRAKUU Cipta Kerja resmi disahkan dalam rapat paripurna DPR tanggal 5 Oktober 2020. Salah satu yang menjadi permasalahan setelah disahkanya UU cipta kerja adalah hak pekerja. Hubungan kerja merupakan suatu hubungan yang timbul akibat dari perjanjian kerja yang dibuat atau disepakati bersama oleh pengusaha dan pekerja/buruh. Yang menjadi permasalahan dalam penelitian ini adalah bagaimana jaminan hak pekerja terhadap kehilangan pekerjaan setelah lahirnya UU nomor 11 tahun 2020. Dengan adanya penelitian ini akan memberikan pengetahuan bagi para pekerja dan pengusaha tentang hak pekerja dalam hak pekerja kehilangan pekerjaannya. Metode penelitian yang dipakai dalam penelitian ini adalah Penelitian hukum normatif (legal research) biasanya “hanya” merupakan studi dokumen, yakni menggunakan sumber bahan hukum yang berupa peraturan perundang-undangan, keputusan/ketetapan pengadilan, kontrak/perjanjian/akad, teori hukum, dan pendapat para sarjana. Pada UU Nomor 11 Tahun 2020 Tentang Cipta Kerja bagian ketiga “jenis program jaminan sosial” tercantum bahwa program jaminan sosial baru yaitu Jaminan Kehilangan Pekerjaan, yang dikelola oleh BPJS Ketenagakerjaan berdasarkan prinsip asuransi sosial tepatnya pada pasal 82. Manfaat yang akan pekerja atau peserta dapatkan dari Jaminan Kehilangan Pekerjaan ini, di antaranya uang tunai, Akses Informasi Kerja, Akses Informasi Kerja.Kata kunci: kehilangan pekerjaan, hak pekerja, UU Cipta Kerja.

Abstract

From January to July 2020 cases of violence against adult women increased from 3020 people to 3059 victims, even sexual violence in children increased to 2556. The purpose of this study was to find out the state responsibility of the rights of victims of crime; The application of law to victims of sexual crimes and obstacles and challenges in the application of the rights of victims of sexual crimes. This research is a normative juridical legal research, namely research conducted based on secondary data. The nature of this research is descriptive analysis. The data used in this study are secondary data, namely data obtained from literature research in the form of legal materials. Data collection techniques are literature and field. The results showed that the Criminal Act of Sexual Violence could provide legal protection for victims and be able to restore the rights of the Sikorban by providing legal treatment, recovery and protection.

Abstract

Extrajudicial killing is a murder carried out by state officials outside of a court decision. This research aims to find out how legal protection is for criminals in Medan City using extra-judicial killing based on human rights. The research method used is a normative jurisprudential research method. Normative research requires a statutory approach and a conceptual approach. The data collection technique used is through document and library studies of secondary data in the form of primary, secondary, and tertiary legal materials. The results of this research conclude that extrajudicial execution is an arbitrary act, does not have a clear legal basis, and is a serious violation of human rights stipulated by law and international documents, thus the perpetrator will not receive legal certainty and justice. and this violates human rights, especially Article 28 Letter A and also Law Number 39 of 1999 concerning Human Rights.

Abstract

This research aims to find out about legal regulations related to playing victims who cause harm to other parties, to find out the steps taken by POLRI in dealing with playing victims, and to analyze cases of spreading hoax news by playing victims at Percut Sei Tuan Police Station. By using empirical legal research methods, this research examines the problem by taking examples of real cases that have occurred in the community. Empirical legal research methods study law as actual behavior and unwritten social phenomena, which occur in the midst of community life. Therefore, empirical legal research is also known as sociological legal research. The results showed that positive law in Indonesia does not provide a detailed explanation of the sanctions for playing victim. Such actions can have serious implications and can be punished by various articles in the Criminal Code, for example Article 311 of the Criminal Code, Article 378 of the Criminal Code, and others. The handling of perpetrators who pretend to be victims or known as “playing victim” is part of the responsibility of the National Police in maintaining public order and security.
