Abstract

This paper attempts to describe confused term of strategy and method learning. The key term in the field of education, especially in aspect learning, are ap-proach, model, strategy, method, and technology. The five words have a concep-tual distinction and two other terms cause confusion, i.e.: strategies and meth-ods. Diversity and confusion of these terms occur both in learning practice and in the study of the theory. This study shows that the existence of the phenomenon of the use of the strategies and methods term that are relatively loose and even they are used interchangeable. There is no agreement in the literature that exam-ined on applicative relationship between the two terms above. It was further confirmed that both terms have the same meaning field.

Abstract

Adat (custom) is a polemical topic in Islamic law. The development of Islamic law since the era of Prophet Muhammad has shown the important role of adat. Islamic law was formulated in accordance or in opposition to the custom of Arabs. However, classical Islamic legal theory (usul fiqh) does not consider it in legal argumentation. Its role is recognized in qawa‘id fiqhiyyah (principle of practical law) as one of five main principles. It is included in non-agreed legal argument. The paper is aimed to reveal the place of custom in Islamic law from the era of prophet to the contemporary era, especially in Islamic legal theory, in the principles of Islamic law, and in Islamic court according to manual book. This paper concludes that custom plays crucial role in elaborating Islamic law in practice. Custom has been acknowl- edged by Islamic scholars, especially by those of Hanafite and Malikite schools, as important part of Islamic law. However, they limites the role of custom in term of private law. The custom was never be discussed in term of rites and folklore, as it is popular now. The custom can still plays important role in Islamic private law or even in alternative dispute resolutions as far as traditional authority is needed and acknowledge by Islamic communities.

Abstract

The 6th century of Islam witnessed the first emergence of the new class of ulama that tended to "close" the gate of ijtihad. By the closure of the gate of ijtihad I do not mean that the gate of ijtihad can indeed be closed. At some point of its development, the legal system of various schools of thought of Islam has finally been established, the resultant consequence of which being that some ?ulama felt that ijtihad can only be done on elaborating further the views of the previous ?ulama and not on proposing original views on particular legal issue of Islam. Al-Suyuti emerged during the era where legal system of Islam has already been established. He claims interestingly, that he is a mujtahid mutlaq, that is, some one who has the absolute and independent authority to do ijtihad and to extrapolate rules from the legal sources of Islam. This comes as a sharp contrast to the general belief at the time that no mujtahid mutlaq may any longer emerge. Al-Suyuti wrote al-Radd to legitimize his claim; a claim that inevitably prompted a strong objection from his fellow legalists. Although his claim was not received with enthusiasm from the public, al-Suyuti has nonetheless made a valuable contribution in the field of the study of ijtihad. His works are applauded as a great evaluation on the subject. On various occasions, al-Suyuti wrote that the Muslim intellectuals should not be satisfied with the views of the previous ?ulama (taqlid) and that they should instead exercise their intellectual acumen via ijtihad.

Abstract

The philosophy of Islamic Law (u??l al-fiqh) has been known as occupying the central position in the whole structure of Islamic jurisprudence. Its method and logic of legal extrapolation has dominated not only the legal sphere of the jurists but also influenced the philosophers and the scholastics in their method and way of thinking. U??l al-fiqh is mainly deductive in its approach and is concerned with the analysis of linguistics. Now with the developments of new methods in legal and linguistic studies, many scholars have attempted to introduce new way of interpreting Islamic law by bringing up hermeneutics as the main tool. Hermeneutics is about interpreting text by taking into consideration the cultural and personal backgrounds of the author. It also teaches that in reading a text, a reader must be neutral in that he should not have in mind an a priori knowledge and assumption about the subject. This paper is concerned with exploring the dynamics of both u??l al-fiqh and hermeneutics in the context of developing the Islamic Law in contemporary life.

Abstract

Javanese Islamic Literature was connected to Islamic mysticism and written in poem to express delicate and sophisticated doctrines. Poem is deemed to be able to go beyond literal meaning for it expresses notion through figurative languages. Suluk Wujil is a good example of such early Javanese Islamic literary work that features spiritual quest and teaching. Suluk Wujil tells about Wujil, a convert who wanted to reach the essence of the ultimate Truth. Wujil is symbolic figure carrying an important sufistic teaching as well as the revealing socio-religious discourse in the early development of Islam in Java. This article is aimed to reveal the content of Suluk Wujil using three steps of semiotic reading, i,e, narrative schema, primary sign discovery and syntagmatic as well as paradigmatic analysis. The paper shows, firstly, that narrative scheme of Suluk Wujils is proceeded by a complaint of Wujil who failed to get into The Ultimate Truth after ten years of spiritual learning in Bonang. Ratu Wahdat or Sunan Bonang taught him the way to get spiritual enlightenment along with endorsing spiritual enlightenment of Seh Malaya (Sunan Kalijaga). Secondly, the primary sign of the Wujil Suluk is the phrase "Arriving in Mecca", in the last part of the text. The phrase affirms the spiritual characteristic of Suluk Wujil, with concern to a spiritual journey to very truth of Islamic spirituality. Thirdly, the paradigmatic analysis shows that there are various signs parallel and oppositional in the same time. The combination of signs forms a synthesis which leads to a deeper understanding of the significance of the signs. The syntagmatic analysis leads to an understanding of oppositional, but complementary signs.
