Abstract

This abstract is entitled "Implementation of Government Regulation Number 20 of 2021 concerning Control of Study Abandoned Areas and Lands on HGB Land Indicated as Abandoned as Land in Madiun City". This research is a type of legal research with empirical research methods. Besides, this research uses a juridical-sociological research approach. The results of this abstract study Abandoned Land is land that is not used, not cultivated, not used according to its designation. In fact, land in Indonesia must function socially and benefit many people around it. The implementation of the control of Abandoned Land in Madiun City has been carried out with reference to Government Regulation Number 20 of 2021, namely concerning Control of Abandoned Areas and Lands. There are 108 lands indicated to be abandoned and 4 of them are certified with Hak Guna Bangunan. In the implementation it has been carried out properly and maximally, namely by socializing in advance regarding Government Regulation Number 20 of 2021, namely concerning Control of Abandoned Areas and Lands and continuing to be investigated regarding abandoned land, only in this implementation there is still an update of new regulations related to object exceptions. abandoned land, namely the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 20 of 2021 concerning.

Abstract

The aims of the study to find out Decided Ratio on Religious Court Decision No. 701/Pdt.G/Pa/Sky Concerning Mandatory Will for Non-Muslim. This study used qualitative research. Based on the description of the discussion in the previous chapter, it can be concluded that the research results are as follows: a.Mandatory wills for non-Muslims in the perspective of Islamic law from among scholars have religious opinions, but according to contemporary Islamic legal theory. b. Compulsory will law against non-Muslims in a positive legal perspective is not regulated normatively in a clear formulation, both in the Civil Code (KUHPdt) and in the Compilation of Islamic Law (KHI). Its application is based on jurisprudence.

Abstract

Abstract

This research is aimed at analyzing the Ratio Decidendi of District Court Decision No. 873/Pdt.G/2013/PN.Sby against notaries who do not read their deeds. The purpose of this research is to determine and analyze the Decidendi Ratio of District Court Decision No. 873/Pdt.G/2013/PN.Sby regarding deeds that were not read by a notary. Then to analyze the responsibilities of notary officials based on article 16 paragraph 1 letter (m) of the Law on Notary Positions. This type of research uses normative juridical research using a statutory approach and a conceptual approach using literature study legal material search techniques. The analysis technique used in this research is the interpretation technique used is systematic interpretation. Based on this, the problem formulation is (1) What is the judge's consideration (Ratio Decidendi) regarding Decision No. 873/Pdt.G/2013/PN.Sby regarding deeds that were not read by a notary? and problem formulation (2) What are the responsibilities of notary officials for deeds that are not read out based on article 16 paragraph 1 letter m based on the Law on Notary Positions? (1) Ratio Decidendi, namely the implementation of a decision with a ruling that the lawsuit cannot be accepted (Niet Ontvankelijk verklaard) in District Court Case No. 873/Pdt.G/2013/PN.Sby, even though in principle the lawsuit is not accepted, the notary still has responsibility for deed that he has made. Even though in principle the lawsuit is not accepted, the judge should consider not carrying out the obligation to read the deed by a notary(2) The Notary's responsibility for a deed that is not read, in this case the Notary can be sued because the authentic deed is downgraded to a private deed and then be sued civilly, namely regarding compensation based on 1365 of the Civil Code, as well as administrative sanctions based on the Code of Ethics. Notary. The advice that can be given is that during the examination of the case, if the lawsuit contains formal defects, it is better to stop it so that the decision is not rejected. Then the parties in the lawsuit must make a detailed lawsuit so that the lawsuit can be granted. Then there are administrative sanctions for the notary who does not carry out the obligation to read the deed. less severe and less of a deterrent effect, then the supervisory board should ensure that the deed made by the notary is truly authentic or not during its inspection and there should be a clear place for complaints for the public to the regional supervisory board.

Abstract

Penelitian ini ditujukan untuk menganalisis terkait Ratio Decidendi Majelis Pengawas Notaris,terhadap notaris yang tidak membacakan aktanya. Tujuan penelitian ini untuk mengetahui mendeskripsikan, menganalisis dan mengetahui, Ratio Decidendi (alasan) terhadap Putusan No 873/Pdt.G/2013/PN.Sby tentang akta yang tidak dibacakan oleh notaris. Kemudian untuk mengetahui, mendeskripsikan, dan menganalisis kedudukan undang-undang jabatan  notaris terhadap tanggung jawab pejabat notaris berdasarkan Putusan No 873/Pdt.G/2013/PN.Sby. Serta untuk mengetahui, mendeskripsikan, dan menganalisis bagaimana penegakan hukum berdasarkan Putusan No 873/Pdt.G/2013/PN.Sby terkait Undang-Undang Jabatan Notaris. Jenis penelitian ini menggunakan penelitian yuridis normatif dengan menggunakan pendekatan Undang-Undang dan pendekatan konseptual dengan teknik penelusuran bahan hukum studi kepustakaan. Teknis analisis yang digunakan pada penelitian ini adalah teknik  interpretasi yang digunakan adalah interpretasi sistematis. Hasil Penelitian menyimpulkan pelaksanaan putusan dengan gugatan tidak dapat diterima (Niet Ontvankelijk verklaard) mengenai Perkara Nomor 873/Pdt.G/2013/PN.Sby Putusan dengan gugatan yang tidak dapat diterima merupakan kesalahan penggugat dalam merumuskan gugatannya. Hal ini juga merupakan bagian dari kelalaian pengadilan dalam melaksanakan amanat Pasal 119 HIR/143 Rbg konstitusi yang memberikan kewenangan kepada ketua pengadilan negeri untuk memberikan nasehat dan bantuan kepada para pihak untuk mencegah terjadinya gugatan tidak sempurna. Bahwa konsekuensi hukumnya apabila akta yang tidak dibacakan tidak memenuhi ketentuan dalam Pasal 16 ayat (9) Undang- undang Nomor 2 Tahun 2014 adalah terdegradasinya kekuatan hukum akta yang dibuat oleh Notaris, dimana kekuakatan hukumnya menjadi akta dibawah tangan. Dalam pertanggung jawaban Notaris atas akta yang tidak dibacakan Notaris sebagaimana yang diatur dalam Pasal 16 ayat (1) huruf m Undang-undang Nomor 2 Tahun 2014 adalah tanggung jawab secara perdata terhadap kebenaran materiil akta yang dibuatnya karena menimbulkan kerugian secara materiil terhadap penghadap. Tanggung jawab Notaris berdasarkan Peraturan Jabatan Notaris seperti yang telah tertuang dalam UUJN dan tanggungjawab Notaris berdasarkan Kode Etik Notaris.

Abstract

Indonesia's national economic recovery requires increased competitiveness of business actors, including through the development of regulations for establishing business entities. The Job Creation Law and Government Regulation No. 8 of 2021 introduced the concept of an Individual Limited Liability Company (PT) which allows the establishment of a PT by one person without a notarial deed, for micro and small business actors. However, the change in status of an Individual PT to a capital partnership PT must be carried out with a notarial deed, which creates legal uncertainty and challenges in implementing the regulation. In addition, the lack of socialization and education regarding the regulation of Individual PTs has resulted in low understanding among business actors. This study uses a normative legal method with a statutory, conceptual, and historical approach, as well as an analysis of grammatical and systematic interpretation of primary, secondary, and tertiary legal materials. Through interviews with notaries, this study examines the legal consequences of the deed of change of status of an Individual PT and provides recommendations to clarify future legal norms in changing the status of an individual company to a capital partnership. It is hoped that the research results can support the implementation of more effective individual PT regulations, provide legal certainty for business actors, and strengthen the contribution of MSMEs to national economic growth

Abstract

Although the number of cooperatives continues to increase, challenges such as weak management, lack of training, and lack of professionalism of the supervisory body still hamper the development of cooperatives. In Gianyar Regency, many cooperatives do not hold RATs, resulting in violations of the Cooperative Law and Permenkop Number 19 of 2015 which requires a RAT at least once a year. Data from 2024 shows that 210 of the 877 active cooperatives in Gianyar did not hold a RAT. This study aims to identify deviations and their impacts as well as the responsibility of management for not holding a RAT. The implementation of the Annual Members Meeting (RAT) of cooperatives in Gianyar Regency is still ineffective due to weak internalization of legal norms, low awareness of management and members, and structural, technical, and cultural obstacles. This ineffectiveness shows that cooperative legal regulations are not optimal due to a lack of commitment and a strong legal culture. To overcome this, it is necessary to strengthen supervision by the Cooperative Service, technical training, development of digital systems, reformulation of educational sanctions, and increasing the internal capacity of cooperatives. With synergy between the government, cooperatives, and the community, the RAT can become a culture of democratic and accountable governance in accordance with legal and cooperative values.
