Abstract

This study is legal research aiming to find out the essence of Divine Principles in Indonesian Contract Law from the review of the Natural Law theory, the Sunt-Servanda theory, the Awareness and Legal Obedience Grundnorm theory, and Truth theory. This research reveals that the Divine Principle's essence is the most fundamental principle or guideline derived from God but exists in humans, aiming to find the truth and regulate the parties in making agreements. The application of the Divine Principle aims to find the truth and regulate the parties in the agreement's field.  Indonesian citizens could realize and practice the Precepts of Godhead in their agreement activities. In establishing the agreement, the parties are applying the teachings of their respective religions. This study reveals that the Divine principle needs to be incorporated into one of the upcoming National Agreement Laws principles, especially in the contract born because of the agreement. This study maintains that the divine principle can be applied comprehensively for Indonesian citizens who are parties to the agreement, not only limited to the Indonesian Muslim citizens.

Abstract

 Jurnal ini ditulis dengan tujuan untuk mengetahui dan menganalisis keabsahan tindakan Notaris menahan suatu sertipikat milik Penghadap dalam hal terjadi kekurangan pembayaran Komisi Jasa Pengurusan Sertipikat milik Penghadap. Jenis penelitian ini merupakan penelitian Yuridis Normatif dengan menggunakan pendekatan peraturan perundang-undangan, dan juga pendekatan konseptual yang dalam penyelesaiaannya dideskripsikan, serta dianalisis menggunakan teori Keabsahan Hukum. Hasil dari penelitian ini adalah bahwa perbuatan Notaris yang memberikan jasa pengurusan sertipikat tersebut seperti perbuatan yang dilakukan oleh seorang Komisioner (Pasal 76 KUHDagang) yang bertindak atas permintaan orang lain dan mendapatkan komisi/provisi. Namun dalam hal ini karena ia bertindak atas nama Pemberi Kuasa, sesuai ketentuan Pasal 79 KUHDagang maka ia tunduk pada ketentuan Pemberian Kuasa yakni pada Bab XVI KUHPerdata. Seorang Notaris berhak menahan sertipikat milik kliennya dalam terjadi kekurangan pembayaran komisi jasa pengurusan sertipikat, dengan didasarkan pengaturan pada Pasal 1729 dan Pasal 1812 KUHPerdata. Berdasarkan kedua pasal tersebut orang yang menerima titipan/kuasa pekerjaan dapat menahan kepunyaan milik pemberi titipan/kuasa apabila biaya jasa dan juga biaya-biaya yang timbul selama penitipan dan kuasa tersebut harus dibayar lunas oleh Pemberi titipan/kuasa, sehingga sah apabila Notaris menahan sertipikat milik penghadapnya dalam hal terjadi kurang bayar Komisi Jasa Pengurusannya.Kata-Kunci: Hak Retensi, Notaris, Jasa Pengurusan, KomisiThe journal was written with the aim of finding out and analyzing the legality of Notary’s action in withholding a certificate belonging to an Appearer on a shortage of payment Certificate Management Service Commission belonging to the Appearer. The research was a normative juridical research using laws and regulations approach, as well as a conceptual approach in which the solution was described and analyzed using Legal Validity theory. The result of the research was the act of a notary who provided certificate management service was like an act of commissioner (Article 76 of Commercial Code) who acted at the other request and got a commission/provision. However, he acted on behalf of the authorizer in accordance with Article 79 of Commercial Code, so he obeyed to the terms of Power of Attorney, namely in Chapter XVI of Civil Code. Based on the two articles, the person who received the power may retain the property of the authorizer if the service fee and other costs during the safekeeping and the power must be paid in full by the authorizer. It is legal if the notary retains the deed of the Appearer in the event of a shortage of payment Management Service Commission. Keywords: Retention Rights, Notary, Management Service, Commission.

Abstract

The development of the digital economy has provided various services that make it easier for the community, one of which is the presence of information technology-based lending and borrowing services or online loans through Fintech. However, the issue of online lending or financial technology peer to peer lending (P2P fintech) is increasingly in the public spotlight. The most recent case of a Kindergarten teacher in Malang entangled in a loan of Rp. 40 million in 24 online loan service providers due to continuous default. This paper will examine the problems with online loans from the point of view of interest rates in this case related to the credit agreement and how or suggestions to overcome these problems. The research method used in this research is normative juridical research using a statutory approach and a case approach. The results of this study indicate that the problem of imposing interest rates on online loans occurs because Article 17 Paragraph (1) of POJK Number 77 of 2016 creates uncertainty in the practice of determining interest rates and arrangements regarding limits on the imposition of interest rates are only regulated through the association's code of ethics.

Abstract

ABSTRAKSI Penelitian ini membahas tentang peran Dinas Kesehatan Kabupaten Nganjuk dalam pelaksanaan pengawasan terhadap peredaran makanan yang mengandung pewarna tekstil Rhodamin B. Hal tersebut dilatarbelakangi oleh banyaknya makanan yang mengandung pewarna tekstil Rhodamin B yang beredar di masyarakat Kabupaten Nganjuk.Dari hasil analisis yang dilakukan maka dapat diketahui bahwa pelaksanaan pengawasan berbentuk pengawasan berkala dan pengawasan khusus bekerjasama dengan BPPOM Provinsi Jawa Timur. Kendala yang dialami adalah terbatasnya dana, terbatasnya kuantitas dan kualitas SDM yang dimiliki oleh Dinkes, rendahnya pemahaman pegawai dalam lingkup Dinkes mengenai substansi UU dan keamanan pangan, tidak adanya sarana dan prasarana untuk menguji makanan hasil operasi pasar, tidak adanya tugas pokok dan fungsi yang secara tegas untuk melakukan tugas pengawasan terhadap makanan dan minuman, rendahnya tingkat pendidikan dan ekonomi masyarakat di Kabupaten Nganjuk, rendahnya pengetahuan masyarakat mengenai keamanan pangan, rendahnya pengetahuan masyarakat mengenai hak dan kewajibannya selaku konsumen, rendahnya pengetahuan pelaku usaha mengenai perbuatan yang dilarang dilakukan oleh pelaku usaha, rendahnya kesadaran masyarakat untuk melaporkan peredaran makanan mengandung pewarna tekstil Rhodamin B. Kata Kunci: peran dinas kesehatan Kabupaten Nganjuk, pelaksanaan pengawasan, peredaran makanan, dan pewarna tekstil rhodamin b.

Abstract

AbstractThis paper aims to identify and analyze what the juridical implications of the publication of the decision of the Constitutional Court No. 46/PUU-VIII / 2010 on Child Outside Marriage Deed which has been published by the Department of Population and Civil Registration prior to the establishment of the Constitutional Court's decision . The method used in this study is a normative juridical approach legislation. From the discussion, it can be concluded that the Constitutional Court 46/PUU-VIII/2010 Number of Tests on Article 43 paragraph ( 1 ) Marriage Act ( Act No. 1 of 1974 ) when viewed from the angle of legal certainty it will lead to legal certainty . But the decision will not have any juridical implications of the child's birth certificate that has been published outside of marriage and illegitimate child who was born before the date of February 17, 2012, as if enacted would be contrary to the principle of legality is interpreted Article 47 of the Law on the Constitutional Court and Article 28 ( i ) of the 1945 Constitution . Likewise, if the terms of the fairness and usefulness , especially for justice seekers / applicant , the timing of this decision is not fair and not useful , because although the Court granted the petition but the Constitutional Court can not be applied to her .  Key words: yuridical implication, birth certificate, children who are born outside of marriage Abstrak Tulisan ini bertujuan untuk mengetahui dan menganalisis apa implikasi yuridis dari terbitnya putusan MK Nomor 46/PUU-VIII/ 2010 terhadap Akta Anak Luar Kawin yang sudah diterbitkan oleh Dinas Kependudukan dan Catatan Sipil sebelum lahirnya putusan MK tersebut. Metode yang digunakan dalam penelitian ini adalah yuridis normative dengan pendekatan perundang-undangan. Dari pembahasan dapat disimpulkan bahwa Putusan MK Nomer 46/PUU-VIII/2010 tentang Pengujian terhadap Pasal 43 ayat (1) UU Perkawinan (UU NO 1 Tahun 1974) jika dilihat dari sudut kepastian hukumnya maka akan menimbulkan kepastian hukum. Akan tetapi putusan tersebut tidak akan mempunyai implikasi yuridis terhadap akta kelahiran anak luar kawin yang sudah terbit dan anak luar kawin yang sudah lahir sebelum tanggal 17 Februari 2012, karena jika diberlakukan akan bertentangan dengan asas legalitas yang ditafsirkan dari Pasal 47 UU Mahkamah Konstitusi dan Pasal 28 (i) UUD 1945. Demikian juga jika ditinjau dari sudut keadilan dan kemanfaatan, khususnya bagi pencari keadilan /pemohon, waktu pemberlakuan putusan ini menjadi tidak adil dan tidak bermanfaat, karena meskipun MK mengabulkan permohonannya tetapi Putusan MK tersebut tidak dapat diberlakukan kepadanya.Kata kunci: implikasi yuridis, akta kelahiran, anak luar kawin.

Abstract

AbstractThis paper aims to determine the reasons why people fulfill and do not fulf ll agreements in Malang. This is an empirical juridical research using sociological approach. The results concluded that the reason why most people fulfill agreements is because every promise must be kept and that the Lord is Seer and if an agreement is not fulfi lled, it will sin and receive the sanction of the Lord. The role of basic principles is very important in the fulfi llment of agreements. Then, follow the rule of law because it viewed the agreement as a law for the parties to, as in the Civil Code. Meanwhile, the expectation is to be / be considered as a good citizen by fulfi lling the agreement, which is regulated in customary (adat) law at least be the reason why people fulfill the agreement. The reason why a person does not fulfill an agreement is due to the inability of respondents to fulfill (no money, no time, illness etc.). This shows that the factor of the respondent himself that caused him to not fulfill the agreement.AbstrakTulisan ini bertujuan untuk mengetahui alasan orang memenuhi perjanjian dan tidak memenuhi perjanjian dari 85 orang di Malang. Jenis penelitian ini adalah penelitian yuridis empiris dengan pendekatan sosiologis dan dianalisis dengan teknik deskriptif kualitatif. Hasilnya bahwa alasan terbanyak mengapa orang memenuhi perjanjian adalah setiap janji harus ditepati, karena Tuhan Maha Melihat sehingga jika tidak ditepati akan berdosa dan mendapat sanksi dari Tuhan. Peranan asasIlahiyah sangat penting dalam pemenuhan perjanjian. Kemudian, diikuti ketaatan hukum karena melihat perjanjian sebagai undang undang bagi para pihak, seperti yang ada dalam KUHPerdata. Sementara itu harapan menjadi/ dianggap sebagai warga masyarakat yang baik dengan memenuhi perjanjian, sebagai mana diatur dalam hukum adat paling sedikit menjadi alasan mengapa orang memenuhi perjanjian. Alasan mengapa seseorang tidak memenuhi perjanjian adalah karena ketidakmampuan responden memenuhi (tidak punya uang, tidak punya waktu, sakit dan sebagainya) sejumlah 18 (delapan belas) jawaban Hal ini menunjukkan bahwa faktor dari diri respondenlah yang menyebabkan ia tidak memenuhi perjanjian.

Abstract

AbstrakDalam Hukum   Adat, pertunangan tidaklah sama dengan perkawinan, tujuannya tidaklah  melegalkan hubungan suami istri, melainkan perjanjian awal untuk melakukan perkawinan. Terlepas dari itu semua, ternyata di Desa Sitiarjo, yang mayoritas penduduknya beragama Kristen, ada fenomena yang menarik, yaitu pada masa pertunangan masyarakat desa tersebut sudah mem- bolehkan pasangan tinggal serumah.  Permasalahan yang dikaji dalam pene- litian ini adalah apakah faktor dominan penyebab terjadinya penyimpangan karakteristik sosio religius hukum adat dalam pelaksanaan pertunangan relevansinya dengan agama Kristen di Desa Sitiarjo Kecamatan Sumber Manjing Kabupaten Malang dan apakah upaya yang telah dan akan dilaku- kan oleh pemuka agama Kristen dan pemangku kepentingan untuk mengu- rangi angka kehamilan sebelum perkawinan. Penelitian ini merupakan pene- litian yuridis antropologis, yaitu penelitian hukum yang dikaitkan dengan budaya masyarakat setempat. Hasil penelitian menunjukkan bahwa  faktor dominan terjadinya penyimpangan adalah adanya diskriminasi dalam perto- batan. Upaya yang dilakukan untuk mengurangi angka kehamilan sebelum perkawinan adalah pemberian hadiah bagi pasangan yang belum hamil saat nikah.Kata Kunci : pertunangan, penyimpangan, sosio religius, hukum adat

Abstract

Indonesia is currently trying to draft a law of engagement. In the drafting process, there are differences of opinion as to whether the principles of binding law will be written explicitly or implicitly. Based on the results of the discussion, it can be concluded that, the nature of legal principles is a very important and fundamental thing, which comes from ethical values that exist in society, which is very useful because it is a direction guide, for the formation of legal norms and law enforcement itself. The function of legal principles is not only as a foundation, heart or bridge in the formation of binding law, but also functions as a compass for direction for the enforcement of binding law, because when there are problems in binding law that occur in the community while there are no rules governing it either in the law or in the agreement itself, the problem solving can be based on existing principles that function as a compass for direction for solving the problem. The right model for the inclusion of legal principles in the future Indonesian Bond Law is to be included explicitly to ensure legal certainty, justice and expediency. Based on the above conclusions, the author suggests the following: For the formulators of the Indonesian Law of Association, the inclusion of the principles of the future Indonesian Law of Association should be explicitly stated to ensure legal certainty for the parties and facilitate notaries and judges in enforcing the law of association. For judges, it is recommended that if they handle cases of binding law that have no legal basis, they can return to the existing principles of binding law. Notaries should pay attention to the principles of the law of engagement in drafting the deed of agreement requested by the parties.

Abstract

Tengger people are allowed to carry out activities in the Bromo Tengger Semeru national park area through a conservation partnership mechanism that includes traditional zones and religious, cultural and historical zones. Based on regional zoning data owned by the Bromo Tengger Semeru national park office, the total area of the both zones where the conservation partnership is carried out is only ± 84 hectares, while the Tengger people’s main livelihood is a farmers and that policy has a big impact on the economic rights of the Tengger people. One of the unresolved problems is how to change the government’s paradigm which is only oriented towards economic growth for development to a paradigm which prioritizes the economic rights of traditional communities around the national park. This research is normative legal research with a statutory, conceptual and analytical approach. The conclusion of this research is that the conservation partnership is not enough to guarantee the economic rights of the Tengger people because the pattern is based on ecological sensitivity method andi is carried out unilaterally by the national park office. There is a need genuine public participation from Tengger people, starting from the formulation of policy regulations to the evaluation level so that the economic rights of the Tengger people can be guaranteed.

Abstract

The Tengger indigenous people are a traditional entity spread across Bromo Tengger Semeru National Park. The Tengger indigenous people have inhabited Tengger mountains since the time of Majapahit kingdom. Indonesian government has designated Tengger mountain area as the Bromo Tengger Semeru National Park. The aim of this research is to determine a partnership pattern of Tengger indigenous people in collaborative management with the Bromo Tengger Semeru National Park office because if examined from a judicial perspective, costumary law has been marginalized by enactment of state law. The type of this research used a Socio-Legal Research with a legal anthropology approach. The main data source was obtained from in-depht interview with Gatekeepers and informants. The research findings show that there has been no true participation of the Tengger indigenous people in managing National Park area because the national park office make many policy regulations and determine area zoning unilaterally without considering the local wisdom that is owned by the Tengger indigenous people which has been passed down across generations for thousand of years. The Bromo Tengger Semeru National Park only uses an approach based on a spectrum of ecological sensitivity to maintain conservation area and determine the zones area. There is a need for a collaborative management pattern together with the Tengger indigenous people to achieve an ecologically sustainable conservation area. Collaborative management with the society also prevents the domino effect of ecological damage due to the high number of tourist both local and foreign, visiting the national park.
