Abstract

The purpose of this research is to find out and to analyze problem and the role of the TNI Special Operations Command (Koopssus TNI), as well as obstacles faced by the TNI Special Operations Command in the prosecution of  terrorism in Indonesia. This research is discussed and motivated by the increasing complexity of terrorist acts which use the latest technology,  international networks and close links with other transnational crimes, as well as endangering national and international security. The research method is conducted using normative law, while the source of legal material used is through secondary legal material which is material obtained through library studies by examining various references relating to the object of this thesis study such as books, legislation, scientific journals, print and electronic media. The statutory regulations in this study are the Law of the Republic of Indonesia Number 5 of 2018 concerning Eradication of Terrorism Crimes, Law Number 34 of 2004 concerning the Indonesian National Army and Presidential Regulation Number 66 of 2019 concerning the Composition of the Organization of the Indonesian Armed Forces. Based on the results of this study it can be seen that terrorism is not only a criminal offense, but also is broader than that. Terrorism is anything that wants to change Ideology, including those based on religion. The Special Operations Command of the TNI handles Terrorism Crimes which is highly escalated and its deployment under direct order from the President. The TNI Special Operations Command is a new structure within the TNI, and addresses urgent issues. The role of the TNI Special Operations Command is not optimal because it is a relatively new organization. Its existence is as expected because it accommodates the interests of the TNI, related to being able to handle strategic matters at the national level so as to accelerate its deployment under direct command from the TNI Commander.Keywords:TNI Special Operations Command (Koopssus TNI), Role, Obstacles,    Terrorism

Abstract

Terrorism and radicalism, in the name of religion, which in nature deconstruct the development of the existing state, must be completely eliminated. Moreover, if terrorism and radicalism, by making social media a means of recruiting members. If so, the policy makers must intervene and make a stronghold in the digital space. In addition, there must be a step from the community exponents to participate in combating terrorism and radicalism. For example, from Islamic boarding schools and Islamic community organizations, such as Nahdlatul Ulama or NU and Muhammadiyah, in Indonesia. The existence of NU and Muhammadiyah is central because so far, they have played a role in advancing the nation from all fronts. The activeness of these two community organizations in counter movement, dealing with terrorism and radicalism is a must. Abstract

The industrial revolution 4.0 has an impact on the development of law, government, and social justice. The era of globalization 4.0 causes changes in almost all sectors of human life, especially the economic and technological sectors. The Information and Electronic Transaction Law, abbreviated as UU ITE, must be able to protect various legal interests to protect freedom of speech, express opinions orally and in writing. In addition, it is related to legal interests to protect the freedom of communication and obtain information as rights that are constitutional rights of citizens. The development of information and communication technology requires the government to make UU ITE. This article discusses the implementation of criminal law enforcement through UU ITE, which makes the digital world the target for applying these regulations. UU ITE must be able to bring enthusiasm to keep Indonesia's digital space clean, healthy, ethical and productive. In a criminal case with a restorative justice paradigm, the judge does not only decide based on the law alone, but also considers justice for all parties (victims, perpetrators of crimes, and the community). Court decisions should provide justice, benefit, and legal certainty, and contain philosophical, juridical and sociological foundations so that they are systematic and comprehensive. Abstract

Kekerasan seksual telah menjadi perhatian banyak pihak. Pemerintah maupun penegak hukum juga mmberi atensi serius sehingga kebiri kimia dijadikan alternatif hukuman untuk pelaku kejahatan seksual tersebut. Artikel ini menganalisis tentang kebijakan pidana tindakan kebiri kimia terhadap pelaku kejahatan seksual berulang pada anak di Indonesia. Teori kebijakan pidana yang dikemukakan Marc Ancel dan teori tujuan pemidanaan Herbert L. Packer dijadikan landasan dalam membahas persoalan ini. Artikel ini adalah penelitian hukum normatif atau studi kepustakaan/studi dokumen. Kajian dilakukan terhadap regulasi negara yang tertulis maupun bahan-bahan hukum lain, serta literatur yang memiliki kesesuaian dengan topik yang tengah dibahas. Kesimpulan penelitian ini menunjukkan, Undang-Undang nomor 17 Tahun 2016 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2016 Tentang Perubahan Kedua Atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak Menjadi Undang-Undang dan Peraturan Pemerintah Nomor 70 Tahun 2020, mengenai kebiri kimian, selayaknya “ditinjau ulang kembali” untuk mendapatkan suatu formulasi pemidanaan yang lebih humanis serta tidak merendahkan martabat manusia.  Kata Kunci: Kebijakan Pidana, Kekerasan Seksual Anak, Kebiri Kimia Sexual violence has become a concern of many parties. Especially if the victims are children. The government and judiciary are also giving serious attention to. Thus, chemical castration is used as an alternative punishment for the perpetrators of these sexual crimes. This article analyzes the criminal policy of chemical castration against perpetrators of repeated sexual crimes against children in Indonesia. The theory of criminal policy proposed by Marc Ancel and the theory of the purpose of punishment by Herbert L. Packer are used as the basis for discussing this issue. This article is a normative legal research or literature study/document study. Studies are conducted on written state regulations and other legal materials, as well as literature that is relevant to the topic being discussed. The conclusion of this study shows that Law Number 17 of 2016 concerning the Stipulation of Government Regulations in Lieu of Law Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection to become Laws and Government Regulations Number 70 of 2020, regarding chemical castration, it should be "re-examined" to obtain a formulation of punishment that is more humane and does not demean human dignity. Abstract

The Green Economy has turned into a growing trend in the fourth industrial revolution (industry 4.0), particularly after the Covid-19 pandemic hit the world. The efforts to increase the investment (investor domination) in Law Number 11 of 2020 on Job Creation are apparently not reinforced by other instruments and overlook the principle of sustainable development. This study aims to analyze the legislative policy regarding the criminal sanction of the corporation which commits criminal acts related to prevention and eradication of forest destruction after the enactment of Law No. 11 of 2020 on Job Creation. The main observed issue is in the incompatible formulation of administrative sanctions and criminal sanctions. Hence, to analyze such matters, this qualitative research employs a normative legal perspective. This study finds the incompatible formulation of 'Criminal Sanctions' on Corporations, as it is stated in Article 82 Paragraph (3), Article 84 Paragraph (3), Article 85 Paragraph (2), and Article 96 Paragraph (2). Moreover, there is also an unfitting interpretation of 'Administrative Sanctions' in the "forms of administra­tive fines".

Abstract

Forests are the main contributor of oxygen for life on earth, providing around 30% of the total global oxygen requirement. Forest management based on ecological justice is an important concern for all countries in the world as an effort to maintain environmental balance and sustainability of life. Forest and environmental damage has caused a multidimensional crisis, including the climate crisis, climate change, loss of biodiversity, and environmental degradation that endanger the sustainability of life on this planet. In this context, the implementation of the Job Creation Law in the Forestry and Environmental Sector has not fully reflected ecological justice, due to political and power interventions that have given rise to conflicts of interest in forest area governance. This study uses a qualitative method with an empirical normative legal approach influenced by sociological jurisprudence. A critical approach is needed to encourage changes in forest management based on the principles of good governance, prioritizing the values ​​of ecological justice that are integrated with da'wah and tarbiyah. From a da'wah perspective, fair and sustainable forest management is a real form of amar ma'ruf nahi munkar, namely calling for goodness by protecting the environment as a mandate from Allah, while preventing damage that is prohibited in Islamic teachings. Meanwhile, from a tarbiyah perspective, good forest management reflects moral and spiritual education to build deep ecological awareness, form a society that cares about the environment and is responsible for its sustainability. The proposed strategic efforts include collaboration between da'wah movements, political parties, and state administrators to create forest management policies that are based on ecological justice and integrated with Islamic values. In addition, social movements based on tarbiyah values ​​are needed to encourage active community participation down to the grassroots level, including utilizing mass media to spread strong and sustainable ecological da'wah messages. With this approach, it is hoped that forest management will not only be oriented towards environmental sustainability, but also reflect justice, responsibility, and harmony as mandated by Islamic values.

Abstract

The abuse of narcotics requires the role of law enforcement officers, who are expected to be able to prevent and combat such crimes to enhance morality and the quality of human resources in Indonesia, particularly for the nation's future generations. The research problem in this study focuses on how law enforcement is carried out by the North Sulawesi Regional Police (Polda Sulawesi Utara) against narcotics abuse crimes within its jurisdiction, what are the inhibiting factors in enforcing the law against narcotics abuse crimes, and what solutions are implemented. The research method used is empirical legal research. The findings of this study are as follows: first, the law enforcement conducted by the North Sulawesi Regional Police against narcotics abuse crimes is carried out in three forms: (1) Pre-emptive law enforcement, which aims to prevent the expansion of narcotics abuse by introducing and socializing the dangers of narcotics to individuals who have not yet been exposed to them. (2) Preventive law enforcement, which involves police actions aimed at preventing community behaviors from escalating into disturbances and actual threats. (3)Repressive law enforcement, which is carried out with the goal of ensuring justice by enforcing the law against violators in Indonesia.   Secondly, several obstacles are encountered in enforcing the law against narcotics abuse crimes, including: 1. Internal obstacles such as limited facilities, infrastructure, and adequately prepared human resources, 2. The need for additional supporting facilities and infrastructure for law enforcement, 3. Lack of public awareness, 4. Lack of participation from local government agencies, 5. The inability to build public awareness to report narcotics abuse crimes, 6. Difficulty in tracking down perpetrators of narcotics crime networks within the jurisdiction of the North Sulawesi Regional Police, 7. Abstract

The industrial revolution 4.0 has an impact on the development of law, government, and social justice. The era of globalization 4.0 causes changes in almost all sectors of human life, especially the economic and technological sectors. The Information and Electronic Transaction Law, abbreviated as UU ITE, must be able to protect various legal interests to protect freedom of speech, express opinions orally and in writing. In addition, it is related to legal interests to protect the freedom of communication and obtain information as rights that are constitutional rights of citizens. The development of information and communication technology requires the government to make UU ITE. This article discusses the implementation of criminal law enforcement through UU ITE, which makes the digital world the target for applying these regulations. UU ITE must be able to bring enthusiasm to keep Indonesia's digital space clean, healthy, ethical and productive. In a criminal case with a restorative justice paradigm, the judge does not only decide based on the law alone, but also considers justice for all parties (victims, perpetrators of crimes, and the community). Court decisions should provide justice, benefit, and legal certainty, and contain philosophical, juridical and sociological foundations so that they are systematic and comprehensive. Abstract

This article discusses labor rights in the laws and regulations in Indonesia. In particular, regarding the rights of workers who are approaching retirement age. There are also laws that are the subject of discussion, namely Law Number 13 of 2013 concerning Manpower and Law Number 11 of 2020 (Omnibus Law). All of this is also discussed from an Islamic perspective. The focus is on the Maqasid Sharia concept, as an effort to protect religion, life, wealth/property, intellect/mind, and descendants or the next generation, from every individual on earth. Maqasid sharia always relies on the principles of justice and the welfare of the people. This study uses a qualitative method with a literature study approach. The results of this study indicate that there are a number of problems in the application of laws relating to employment in Indonesia. Especially, in the new law, namely, the 2020 Omnibus Law. The problems referred to include, among other things, the unclear working contract period, changes to the minimum wage provisions, complicated outsourcing rules, the concept of termination of employment, and ambiguous leave terms. The government must pay attention to these findings. Viewed from the perspective of Maqasid Syariah, the lack of clarity on the term of the employment contract, the provisions of the minimum wage, outsourcing, and termination of employment can be classified as endangering one's financial aspects (wealth). While the issue of leave often has a negative impact on a person's physical and mental health (life and mind). This study is expected to have theoretical benefits in the fields of employment, public policy, and Omnibus Law. There is also a practical benefit for readers is to open up insight about the problems around, in connection with the Omnibus Law.
