Abstract

Dalam melakukan persaingan dan pengembangan usaha, ritel modern terus melakukan inovasi-inovasi. Salah satu bentuk inovasi ritel modern adalah pemberian promo tebus murah. Promo tebus murah bisa didapatkan konsumen dengan membeli produk sponsor dengan harga atau kuantitas minimum. Promo ini terbilang baru di masyarakat sehingga perlu dilakukan penelitian. Penelitian ini bertujuan untuk mengetahui hukum promo tebus murah yang ada di ritel modern. Penelitian ini menggunakan metode yuridis empiris dengan sifat indentifikasi hukum. Penelitian ini menemukan bahwa promo tebus murah sesuai dengan prinsip-prinsip syariah. Skema tebus murah tidak termasuk dari skema multi akad yang dilarang oleh syariah. Hal yang perlu diperhatikan dalam melakukan promo tebus murah adalah jenis produk, ketentuan dan syarat tambahan, serta penetapan harga produk sponsor.

Abstract

This article aims to analyze the position of time and its correlation with sharia sale and purchase transactions, to answer time problems in each component of buying and selling transactions. Buying and selling is a transaction that is most often carried out by humans in meeting their daily needs. One of the main components of buying and selling that distinguishes it from other transactions is the transfer of ownership by handing over the goods with the value of the goods. Normally, the handover of goods occurs in a sale and purchase activity known as the majlis`aqd. However, due to certain factors, the handover may experience delays. A delay or suspension which is a derivative of time has a certain effect on the validity of a sale and purchase contract. So that it can be understood that global universal time has a special position in buying and selling. This research uses content analysis method by making classic and contemporary scholarship books as references plus several journals. This study deduced the opinions of scholars regarding payment or delivery of delayed items which were then analyzed by the authors to be a conclusion. The results of this study indicate that the conditions of time can determine whether or not the sale and purchase agreement is valid. In addition to several aspects, the aspect of clarity of time is very important to note.

Abstract

Economic activities are increasingly complex along with the development of people's economic needs in modern times. Currently, there are many non-bank Islamic Financial Institutions that can help meet the needs of the consumptive community, such as the needs of members in the health and education sectors using ijarah contracts. The implementation is that the Islamic Financial Institution provides funds to members for education and hospital expenses, after which the members pay the Islamic Financial Institution in installments with a predetermined ujrah. After the author observes the implementation of ijarah contracts that are applied in multi-service financing such as education and health costs, these practices are not in accordance with Islamic law, because the meaning of services in ijarah contracts practiced by financial institutions is that service products owned by financial institutions are not services that are performed. by other parties.
