Abstract

This research was conducted with the aim of: (1) knowing and analyzing the process of growing Islamic jurisprudence thought in the Islamic community; (2) knowing and analyzing the factors that caused the freeze of Islamic jurisprudence thought in the early era of its appearance; and (3) offer some reform efforts toward Islamic jurisprudence thought. This research uses library research method where library material is discussed and analyzed with content analysis techniques and descriptive analysis to support existing propositions and ideas from various references with historical approaches. The results showed that; (1) the growth of Islamic jurisprudence thought can grow in the midst of Islamic society due to the great need for the jurispruding laws themselves, where this need is higher with the emergence of various problems caused by differences in social and cultural conditions; (2) the freeze and cheese and the Islamic jurisprudence thought cannot be separated from several reasons, including excessive concern for the efforts of "infiltration" in Islamic jurisprudence and fanaticism of sects that go beyond the limits; and (3) reform efforts must begin by restoring the function and role of ijtihad as the main instrument of the development of Islamic jurisprudence that is carried out proportionately.

Abstract

This research aims to determine the comparison of munākaḥāt jurisprudence and Fatwa MUI Sul-Sel No. 2 of 2022 concerning panai money'. The research method used is descriptive qualitative (non-statistical) with library research methods (literature review) which are processed through normative and comparative approaches. The results of this research found that Panai’ according to the South Sulawesi MUI Fatwa Number 2 of 2022 is permissible or permissible with several provisions. In the perspective of munākaḥāt jurisprudence, panai’ is termed as assets required by the bride's father from the groom, both from the dowry and outside the dowry. From this we can understand the difference between the South Sulawesi MUI Fatwa and the perspective of munākaḥāt jurisprudence, namely in terms of legal understanding and results. And this research further strengthens the opinion of munākaḥāt jurisprudence that it is religious or even haram.

Abstract

This research aims to find out the law committing an act of euthanasia for a dying patient. The type of research used is library research that is qualitative descriptive with methods of normative jurisprudence approach. The results of the study found that in the review of Islamic law active euthanasia in which a physician makes an active effort helps to accelerate the death of a patient, who is presumed and estimated to be unable to survive (death) even if at the request and consent of the patient or his family is explicitly prohibited, because such an act belongs to intentional murder. Nevertheless, there must be some other way of healing, for the purpose and purpose of a person's healing and life and death is ultimately in God's hand.

Abstract

This research was conducted with the aims of: knowing the meaning of globalization; (2) knowing and analyzing the negative impact of globalization on the identity of the nations; and (3) knowing and analyzing solutions to confront the impact of globalization towards muslim identity. This research used qualitative descriptive approach with library research method. The sources of this research data are books related to the history and development of globalization. The results show that: (1) globalization means bringing the world closer together through great advances in communication, transportation, satellites and the internet, openness of information flows, accompanied by one-pole power (in this case America with its influence of Zionism) that seeks to unite all economic, political forces (including the military) and thought to fulfill its interests; (2) the negative impact of globalization on the nations of the world, especially in the Islamic world, is that globalization has a high potential in reshaping the basic understandings of Muslims about nature, people and life, to be replaced by the understanding that has been commonly believed in the West; and (3) Islam and muslims can actually use globalization as an effective way to strengthen their identity. The use of globalization in order to affirm the identity of Islam and muslims is of course based on the objective view that this phenomenon does not fully contain negative values and holds a very powerful force, depending on "who and how" it is utilized. The beautiful collaboration between scholars, thinkers, scientists, experts, culturalists, and muslim perpetrators of globalization in formulating elements of globalization appropriately is an expectation for the strengthening of muslim identity in the midst of the current globalization.
