Abstract

This study aims to know and understand the concepts and laws of al-Talfīq in worship according to the perspectives of the four schools of thought. The problems that researchers raise in this study are; what are the concepts and laws of al-Talfīq in worship according to the perspective of the four schools of thought? This research uses a type of qualitative descriptive research (non-statistical), which focuses on the study of manuscripts and texts, using historical normative and philosophical approaches. The research results found are as follows; Talfiq is a method of merging two or more schools of thought to issue a new opinion (qaul al-Jadi). In addition, al-Talfiq is sometimes used by someone to get out of a difficult position by taking many different opinions without any superiority (tarjīḥ) between them. Regarding the law, the scholars have different opinions, some allow it absolutely, absolutely forbid it, and some allow it and some others prohibit it depending on certain criteria or conditions. Abstract

This research aims to determine the comparison of munākaḥāt jurisprudence and Fatwa MUI Sul-Sel No. 2 of 2022 concerning panai money'. The research method used is descriptive qualitative (non-statistical) with library research methods (literature review) which are processed through normative and comparative approaches. The results of this research found that Panai’ according to the South Sulawesi MUI Fatwa Number 2 of 2022 is permissible or permissible with several provisions. In the perspective of munākaḥāt jurisprudence, panai’ is termed as assets required by the bride's father from the groom, both from the dowry and outside the dowry. From this we can understand the difference between the South Sulawesi MUI Fatwa and the perspective of munākaḥāt jurisprudence, namely in terms of legal understanding and results. And this research further strengthens the opinion of munākaḥāt jurisprudence that it is religious or even haram.

Abstract

It is said that Shia does not believe in Al-Qur'an that is available today, but we find that the Al-Qur'an that was printed by the Shia is the same Al-Qur'an which is printed elsewhere. Therefore, this study aims to explain the essence of Shia’s belief in Al-Qur'an that is currently in the hands of the Muslims and also the roots of that belief. The method used in this research is descriptive analysis namely by examining classical and modern books particularly the books of Shia’s scholars as the main source to explain and answer the problem formulations in this study. The results of this study indicate that Shia does not believe in Al-Qur'an that exists today. They are forced to read and perform its laws until the emergence of Al-Qaim, which is Imam Mahdi Al-Muntazhar in their version which would carry "the original al-Qur'an." There are two roots of this belief those are to legitimize the doctrine of Al-Wilayah or Imamat of Ahlul Bait and to deny the virtues of the companions.
