Abstract

The restorative justice approach is a diversion in the handling of criminal acts which in the criminal justice procedure are centered on imposing criminal sanctions which are transferred to a communication and mediation process that presents the perpetrators, victims, families of the perpetrators/victims, and other related parties to come together to realize a form of agreement. for the handling of criminal acts that are fair and proportional to the victims who are harmed and the perpetrators by prioritizing repairs such as initial conditions and restoring a harmonious interaction model in society. It is this restorative justice approach that will be used in the investigation, investigation and examination stages in courts of insults, considering that the enforcement of criminal law against insult cases that occur in the community has not given satisfactory results. The regulation of defamation offenses whether carried out offline or online with social media refers to the provisions of the Criminal Code (KUHP) and the Information and Electronic Transactions Law, which in these two provisions contain criminal sanctions against the perpetrators. The purpose of the restorative justice approach in dealing with insults offenses is the restoration of victims who suffered as a result of the humiliation by providing compensation, imposing social work on the perpetrators and matters mutually agreed upon by the parties.

Abstract

Artikel ini bertujuan untuk memperoleh gambaran tentang cyber warfare dan tantangannya kedepan, strategi cyber security di Indonesia serta penguatan cyber security di Indonesia dalam rangka mewujudkan keamanan nasional. Masalah difokuskan pada bagaimana menjaga keamanan nasional dari ancaman serangan cyber yang mungkin terjadi dan kemungkinan taktik pertahanan. Metode penelitian yang digunakan adalah pendekatan kualitatif dan deskriptif analitis dengan teknik pengumpulan data menggunakan studi pustaka dari penelitian sebelumnya dan data sekunder.  Kajian ini menyimpulkan bahwa peretas memanfaatkan keresahan masyarakat sebagai celah untuk meluncurkan serangan, mulai dari phishing hingga ransomware, kasus kebocoran data 91 juta pengguna situs belanja online. Kesimpulannya adalah Indonesia dalam keadaan darurat cyber warfare. Strategi yang harus dilakukan adalah Pembentukan undang-undang khusus tentang tindak pidana siber, Peningkatan sumber daya manusia, dan kerjasama stakeholder di dalam negeri dan kerjasama internasional bidang cyber security untuk mewujudkan keamanan nasional.

Abstract

This research conducts a comparative study of law enforcement strategies aimed at combatting taxation crimes in Indonesia and Malaysia. The study examines the legal frameworks, enforcement mechanisms, and institutional capacities of tax authorities in both countries. Through an analysis of relevant laws, regulations, and enforcement practices, the research evaluates similarities and differences in approaches to tackling tax evasion, fraud, and non-compliance. Additionally, the study explores the role of collaboration between tax authorities and other government agencies, as well as international cooperation in addressing cross-border tax crimes. By identifying effective strategies and areas for improvement in law enforcement against taxation crimes, the research aims to contribute to the development of more robust and coordinated efforts to combat tax evasion and ensure compliance with tax laws in Indonesia and Malaysia.

Abstract

This article or paper aims to Analyze the Law and Criminal Liability for Environmental Pollution Due to Waste Dumping, as well as analyze the Legal Liability in Decision 464/PID. B/LH/2022/PN. MTR. This study uses a normative juridical approach to analyze the application of law and criminal liability in cases of environmental pollution due to waste dumping, based on Decision Number 464/PID. B/LH/2022/PN. MTR. The data was analyzed qualitatively from legal documents, interviews, and literature. The results of the study show that environmental pollution due to B3 waste dumping is a serious violation with a wide impact on the ecosystem and the quality of life of the community. The UUPPLH provides a legal framework to deal with these violations through criminal and administrative sanctions. Decision Number 464/PID. B/LH/2022/PN. MTR shows the strict application of environmental criminal law by imposing sanctions on the perpetrator, Heri Irawan, to provide a deterrent effect. Although effective, strengthening supervision, business compliance, and community involvement are still needed. This collaboration is important to create a sustainable and pollution-free environment.

Abstract

This research aims to analyze inequality in judges' decisions in drug crime cases by studying two court decisions, namely Decision No. 1192/Pid.Sus/2024/PN.Mdn and Decision No. 1035/Pid.Sus/2024/PN.Mdn. These two decisions involved defendants who were subject to the same sentence despite significant differences in their roles and the amount of evidence found. M. Ramadhan acted as an intermediary with evidence of 0.79 grams of narcotics, while Ari Wibowo was more active in the narcotics network despite only having evidence of 0.04 grams. This research uses a qualitative method with a case study approach to evaluate the factors that influence judges' decisions, such as the role of the defendant and the amount of evidence in sentencing. The results showed that despite differences in the roles and evidence involved, both defendants were sentenced to the same sentence, namely 7 years and 6 months' imprisonment and a fine of Rp 1,000,000,000, with a subsidiary of 1 year's imprisonment. This finding indicates an inconsistency in the sentencing considerations, and suggests the need for stricter standardization in sentencing in drug cases to achieve justice that is more in line with the conditions and facts of each case.

Abstract

Consumer protection in Indonesia currently faces significant challenges, particularly regarding weak law enforcement and uncertainty in the application of criminal sanctions. Based on Law No. 8 of 1999 on Consumer Protection, criminal sanctions are applied as Ultimum Remedium, which complicates the process of obtaining justice for consumers who are harmed. This paper proposes a paradigm shift in the application of criminal sanctions by making them the primum remedium in resolving consumer criminal cases. This approach is expected to provide legal certainty, justice, and a deterrent effect on business actors who violate consumer rights. Additionally, the study suggests reconstructing several articles in the Consumer Protection Law, such as Articles 8, 9, 13 paragraph (2), 15, 17, 18, and Articles 62 and 63, to align with the evolving conditions of society, economy, and global trade. These changes aim to enhance the effectiveness of consumer protection and ensure better legal certainty for Indonesian society in the face of global legal developments related to consumer protection.

Abstract

The principle of ultimum remedium is one of the principles in legal science that serves as an important foundation in the criminal justice system, placing criminal sanctions as the last resort after non-criminal efforts are deemed ineffective. The application of this principle is closely related to children as both perpetrators and victims of sexual violence, emphasizing a humane approach, restorative justice, and the protection of human rights, with a focus on recovery efforts for victims. This article examines the principle of ultimum remedium in relation to its application in sexual violence crimes in Indonesia, Malaysia, and Tunisia. The study results show that all three countries share a common vision in placing criminal sanctions as a last resort and emphasizing the importance of child protection and restorative justice. However, there are significant differences in regulation and implementation challenges. Indonesia and Malaysia have a more systematic and integrated approach, while Tunisia faces legal and social obstacles in consistently applying this principle. Efforts to strengthen law enforcement capacity and update legislation are urgently needed so that the principle of ultimum remedium can be effectively implemented to achieve comprehensive justice and protection for victims of sexual violence

Abstract

Tujuan pada penelitian ini adalah untuk mempelajari dan memahami unsur-unsur apa yang mendorong pelaku untuk melakukan tindak pidana pembunuhan berencana, menganalisis tanggungjawab pelaku atas tindak pidana yang dilakukan oleh terdakwa, dan memahami pendapat Majelis Hakim tentang pelaku tindak pidana pembunuhan berencana (Studi Kasus Putusan Nomor 2062/Pid.B/2023/PN Lbp). Hukum normatif adalah metodologi penelitian yang digunakan dalam penulisan ini. Pasal 340 KUHP mengatur pembunuhan berencana, yang juga—sering disebut—sebagai pembunuhan berencana. Berbeda dengan pembunuhan dengan pemberatan, yang diatur dalam Pasal 339 KUHP tentang pembunuhan biasa, delik pembunuhan berencana adalah delik yang berdiri sendiri. Delik pembunuhan berencana merupakan pengulangan dari delik pembunuhan dalam Pasal 338 KUHP tentang pembunuhan biasa, kemudian ditambah satu unsur lagi, yaitu "dengan rencana lebih dahulu".
