Abstract

Flexibility in Islamic Law can be found in judges’ rulings in many cases of inheritance in religious court. Therefore, the judge as a law enforcer should make ijtihad based on principles of justice and maslahah. One of method of judges in deciding heirs is to consider about juridical, philosophical and sociological aspects, but can not ignore the facts of the trial. This study aims to analyze the implementation of legal flexibility in inheritance cases within religious court in Palu City, Central Sulawesi. The study found there are at least 3 cases that apply the islamic law flexibility theory. That cases number are 050/Pdt.G/2014/PA.Pal., 246/Pdt.G./2016/PA.Pal., and 562/Pdt.G/2014/PA.Pal.

Abstract

In comparing the masculine concepts of these two figures, the researcher concluded that the concept of maslahat al-Tufi and al- Syatibi only had differences at the epistemological level. If al-Tufi positions maslahat as a supremacy of the law which is higher than the nas, while al-Syatibi is more careful by trying to combine the text massively and not justifying the reason beyond the limit set. In this concept of maslahah, al-Syatibi excels in elaborating his theory in more detail as the goal of the Shari'ah so that it develops into a whole theory sid, while al-Tufi does not formulate maslahat theory in one form of writing as in al-Syatibi with the book al-Muwafaqat essay.

Abstract

Islam teaches the importance of zakat as one of the main instruments in distributing wealth and upholding social justice. In Qur'an verse At-Taubah 60 explains eight groups of zakat mustahik, one of which is converts, namely people who have just converted to Islam or individuals whose hearts are expected to be attracted to Islam. This research uses empirical research methods, data collection techniques through observation, interviews and documentation studies. The results of the research show that converts to Islam in Palu City have on average embraced Islam for a long time. The picture of converts as zakat recipients is that there are still those who still receive their zakat and there are also those whose zakat has been cut off and has even become muzakki. Giving zakat really helps them and can increase their faith in Islam. The perspective of Muhammadiyah and Nahdlatul Ulama in Palu City refers to At-Taubah 60, which states that converts have the right to receive zakat. The two organizations do not have differences of opinion regarding the criteria for converting zakat recipients, the purpose of giving zakat, the impact of giving zakat from an economic and spiritual perspective, as well as the priority scale for giving zakat. However, they differ in their opinions regarding the time limit for giving zakat to converts. From the conclusions obtained, it is recommended that Muhammadiyah and Nahdlatul Ulama in Palu City have data on converts who receive zakat, so that well-documented data will provide a clear picture of the number of converts, their needs, and the impact of the zakat assistance given to them.

Abstract

The process of child adoption, principally, adoptive parents have an inherent obligation to provide for the adopted child, including daily basic needs, education, and healthcare.  This obligation includes fulfilling basic daily needs such as clothing, food, and shelter, as well as ensuring the child’s education and healthcare. The fulfillment of these needs is not only material but also encompasses care, affection, and moral guidance so that the child can grow and develop optimally. This responsibility is comprehensive and must be carried out continuously to ensure the welfare and future of the adopted child, allowing them to have equal opportunities as other children. However, in practice, the implementation of this financial obligation often encounters various challenges. Some adoptive parents do not fully understand the responsibilities attached to their status as caregivers, resulting in the financial support not being provided adequately. On the other hand, economic limitations are also a major factor that hinders the optimal fulfillment of the adopted child’s needs. This indicates a gap between the legal provisions and the practices occurring in the field. Therefore, this research was conducted to thoroughly examine the practice of child adoption and the implementation of financial responsibilities using an empirical legal research method with a case study approach. The research findings indicate that the majority of child adoptions are carried out informally without court approval, while the provision of financial support generally follows the principles of Islamic law and the positive legal framework in Indonesia.   Pada prinsipnya, dalam proses pengangkatan anak, kewajiban memberikan nafkah kepada anak angkat merupakan tanggung jawab yang tidak dapat dipisahkan dari peran orang tua angkat. Kewajiban ini meliputi pemenuhan kebutuhan pokok sehari-hari seperti sandang, pangan, dan papan, serta aspek pendidikan dan pemeliharaan kesehatan anak. Pemenuhan tersebut tidak hanya bersifat materiil, tetapi juga mencakup perhatian, kasih sayang, dan pembinaan moral agar anak dapat tumbuh dan berkembang secara optimal. Tanggung jawab ini bersifat menyeluruh dan harus dilaksanakan secara berkesinambungan demi menjamin kesejahteraan serta masa depan anak yang diangkat, sehingga ia memiliki kesempatan yang sama dengan anak-anak lainnya.  Namun, dalam praktiknya, pelaksanaan kewajiban nafkah ini sering kali menghadapi berbagai kendala. Beberapa orang tua angkat tidak sepenuhnya memahami tanggung jawab yang melekat pada status mereka sebagai pengasuh, sehingga kewajiban nafkah tidak dilaksanakan secara maksimal. Di sisi lain, keterbatasan ekonomi juga menjadi faktor utama yang menyebabkan pemenuhan kebutuhan anak angkat tidak dapat dilakukan secara optimal. Hal ini menunjukkan adanya kesenjangan antara ketentuan hukum dengan praktik yang terjadi di lapangan. Oleh karena itu, penelitian ini dilakukan untuk mengkaji secara mendalam praktik pengangkatan anak dan pelaksanaan kewajiban nafkah, menggunakan metode hukum empiris dengan pendekatan studi kasus. Temuan penelitian menunjukkan bahwa mayoritas pengangkatan anak dilakukan secara nonformal tanpa penetapan pengadilan, sementara pemberian nafkah umumnya mengikuti prinsip hukum Islam dan ketentuan hukum positif di Indonesia.
