Abstract

Ma'tinggoro is a tradition of slaughtering or slaughtering animals, especially buffalo, the ma'tinggoro tradition can be found in the Tana Toraja area which has the ma'tinggoro process in traditional ceremonies, namely the solo sign. The research method used in this study uses descriptive qualitative research. The data source in this study used data from interviews, observations, documentation and literature reviews. In the interview activity involving the secretary of the MUI Tana Toraja who was the main informant in this study, the results of the research described that the practice of the ma'tinggoro tradition is a tradition carried out in the slaughter of animals, especially buffalo and is usually found during the Wednesday Solo traditional ceremony.

Abstract

This thesis focuses on how judges consider the class 1A religious court in Palu in determining the marriage dispensation and an analysis of Islamic and positive law regarding marriage dispensations in the Palu Class 1A Religious Court. This research uses qualitative research based on empirical law collected through interview studies, documentation studies, observation and data reduction, data presentation, verification and checking the validity of the data. The results of this research show that the judge's consideration in granting marriage dispensation looks at the legal facts, that there are indeed witnesses in the application for marriage dispensation. The judge will consider the application for marriage dispensation that has been submitted by the applicant based on the existing evidence. Looking at the benefits, the Panel of Judges in determining a case must have a legal basis for the case they are handling and grant the request if it is very urgent. Then, Islam does not regulate the age limit for marriage, the age limit for a person to marry only mentions signs of female maturity and men having wet dreams. The judge basically uses various considerations and legal bases, namely Law Number 1 of 1974, Compilation of Islamic Law (KHI), as well as fiqhiyah rules. However, the panel of judges prioritized the concept of maslahah because it was to prevent undesirable things. The principle is that the prospective bride and groom must mature their body and soul in order to realize the goal of marriage well without ending in divorce and to have good and healthy offspring. Therefore, underage marriages must be prevented, with this provision the age limit for marriage is set in the Marriage Law. rigid. This means that it does not provide an opportunity for anyone to do it.

Abstract

Penerapan hukum keluarga di negara-negara yang berpenduduk mayoritas Muslim khususnya kawasan Timur Tengah dan sekitarnya memiliki praktik yang berbeda-beda, kita tidak menemukan keseragaman praktik hukum keluarga di negara-negara tersebut. Hal ini dipengaruhi oleh perbedaan sistem pemerintahan, kultur, situasi dan kondisi masyarakat setiap negara. Mesir merupakan salah satu negara yang berpenduduk mayoritas Muslim yang menetapkan Islam sebagai agama negara. Karena itu, prinsip-prinsip hukum Islam menjadi sumber hukum utama dalam pembuatan dan perumusan undang-undang termasuk hukum keluarga. Praktik hukum Islam di Mesir tidak berlaku secara utuh hanya bidang-bidang hukum keluarga dalam ruang lingkup yang terbatas meliputi pembagian warisan dan perkawinan. Namun, penerapan hukum keluarga di Mesir terus mengalami reformasi dan pembaruan. Pembaruan hukum keluarga terjadi di Mesir pada tahun 1920. Ini ditandai dengan diundangkannya UU No. 25/1920 mengenai hukum keluarga dan penjagaan (Law of Maintenance and Personal Status/Qanun al-Ahwal al-Syakhsiyyah wa al-Siyanah). Reformasi hukum keluarga pada tahun 1970an ditandai dengan dikeluarkannya aturan undang-undang mengenai kewenangan kepada lembaga peradilan memaksa pihak-pihak (suami) untuk membayar uang pemeliharaan kepada isteri-isteri, janda-janda, anak-anak, ataupun orang tua pada tahun 1976. Hingga era sekarang hukum keluarga di Mesir terus mengalami perkembangan.

Abstract

Nikah sirri merupakan term klasik yang menarik perhatian kalangan para pemikir hukum Islam sejak masa klasih hingga modern  terkait pengembangan dan perluasan makna yang terjadi di berbagai wilayah dunia yang menggunakan hukum Islam sebagai landasan dalam pembentukan peraturan perundang-undangan khususnya negara Indonesia mengingat motif dari larangan agama untuk melangsungkan perkawinan secara sirri dengan pertimbangan dampak negatif yang ditimbulkan dari perkawinan tersebut. Dengan terjadinya perluasan makna dalam term tersebut melahirkam pemahaman baru dalam hukum perkawinan khususnya dalam bidang administrasi perkawinan. Sebagian ulama berpendapat bahwa nikah sirri adalah nikah yang disembunyikan maka pernikahan haruslah diumumkan. Namun bagi yang berpendapat bahwa nikah sirri adalah tidak sempurnanya saksi, maka haruslah menghadirkan saksi secara sempura baik dua orang laki-laki atau seorang lelaki dan dua orang wanita, dan meskipun tidak disiarkan maka pernikahannya tidaklah dinamakan nikah sirri, serta yang terakhir konsep nikah sirri dalam artian perkawinan yang tidak tercatat pada lembaga pencatatan perkawinan, maka diharuskan untuk mencatatkan perkawinannya.

Abstract

This research identifies students' lack of numeracy skills, particularly in addition and subtraction, as a major problem. Its aim is to assess the effectiveness of using traditional congklak game learning media in improving numeracy skills, learning activities, and student responses in class II of SD Inpres Karunrung Makassar. With a population of all class II students (28 students), the sample was taken using a saturated sampling technique. The instruments used include numeracy tests and documentation. The research results showed a significant increase in students' numeracy skills, active learning activities, and positive responses from students to learning using congklak media. Thus, this media is effective in improving mathematics learning at SD Inpres Karunrung Makassar, with 81.68% of students responding positively to its use.

Abstract

The Free Return Guarantee offered by e-commerce Shopee gives consumers the right to return the product if they change their mind about purchasing a product without a prior checking process by the seller. In sharia economic law, principles such as honesty and transparency are highly emphasized. This study aims to examine the implementation of the Free Return Guarantee in Shopee e-commerce transactions and assess its conformity with the concept of khiyār syarṭ under sharia economic law, in order to determine whether this policy fulfills the expected principles of sharia economic law in commercial transactions. This article is descriptive research. In extracting and collecting data, the method used is library research, to be able to study library materials and documents which are the main source of information. The research results show that so far, the Free Return Guarantee program implemented by e-commerce platforms such as Shopee can be considered in accordance with the principles of Sharia Economic Law, as long as the policy is designed taking into account the rights and the obligations of both parties (consumers and sellers). Moreover, this policy aligns with the concept of khiyār syarṭ in Islam, which allows a conditional option period in transactions to ensure fairness and mutual consent.

Abstract

The process of child adoption, principally, adoptive parents have an inherent obligation to provide for the adopted child, including daily basic needs, education, and healthcare.  This obligation includes fulfilling basic daily needs such as clothing, food, and shelter, as well as ensuring the child’s education and healthcare. The fulfillment of these needs is not only material but also encompasses care, affection, and moral guidance so that the child can grow and develop optimally. This responsibility is comprehensive and must be carried out continuously to ensure the welfare and future of the adopted child, allowing them to have equal opportunities as other children. However, in practice, the implementation of this financial obligation often encounters various challenges. Some adoptive parents do not fully understand the responsibilities attached to their status as caregivers, resulting in the financial support not being provided adequately. On the other hand, economic limitations are also a major factor that hinders the optimal fulfillment of the adopted child’s needs. This indicates a gap between the legal provisions and the practices occurring in the field. Therefore, this research was conducted to thoroughly examine the practice of child adoption and the implementation of financial responsibilities using an empirical legal research method with a case study approach. The research findings indicate that the majority of child adoptions are carried out informally without court approval, while the provision of financial support generally follows the principles of Islamic law and the positive legal framework in Indonesia.   Pada prinsipnya, dalam proses pengangkatan anak, kewajiban memberikan nafkah kepada anak angkat merupakan tanggung jawab yang tidak dapat dipisahkan dari peran orang tua angkat. Kewajiban ini meliputi pemenuhan kebutuhan pokok sehari-hari seperti sandang, pangan, dan papan, serta aspek pendidikan dan pemeliharaan kesehatan anak. Pemenuhan tersebut tidak hanya bersifat materiil, tetapi juga mencakup perhatian, kasih sayang, dan pembinaan moral agar anak dapat tumbuh dan berkembang secara optimal. Tanggung jawab ini bersifat menyeluruh dan harus dilaksanakan secara berkesinambungan demi menjamin kesejahteraan serta masa depan anak yang diangkat, sehingga ia memiliki kesempatan yang sama dengan anak-anak lainnya.  Namun, dalam praktiknya, pelaksanaan kewajiban nafkah ini sering kali menghadapi berbagai kendala. Beberapa orang tua angkat tidak sepenuhnya memahami tanggung jawab yang melekat pada status mereka sebagai pengasuh, sehingga kewajiban nafkah tidak dilaksanakan secara maksimal. Di sisi lain, keterbatasan ekonomi juga menjadi faktor utama yang menyebabkan pemenuhan kebutuhan anak angkat tidak dapat dilakukan secara optimal. Hal ini menunjukkan adanya kesenjangan antara ketentuan hukum dengan praktik yang terjadi di lapangan. Oleh karena itu, penelitian ini dilakukan untuk mengkaji secara mendalam praktik pengangkatan anak dan pelaksanaan kewajiban nafkah, menggunakan metode hukum empiris dengan pendekatan studi kasus. Temuan penelitian menunjukkan bahwa mayoritas pengangkatan anak dilakukan secara nonformal tanpa penetapan pengadilan, sementara pemberian nafkah umumnya mengikuti prinsip hukum Islam dan ketentuan hukum positif di Indonesia.
