Abstract

This research was conducted at Pegadaian Jalancagak Subang Regency. Pegadaian is one of the financial institutions that offers Logam Mulia investment services, one of which is called MULIA (Murabahah Logam Mulia For Abadi Investment). Product Mulia is a financing offer to customers for the purchase of gold bars produced by PT. Aneka Tambang (ANTAM). This study aims to determine how MULIA product provisions, the application of the murabaha contract on MULIA products and the impact of MULIA products for pawnshops and the community. This type of research is qualitative using descriptive analysis method. Data sources used include primary and secondary data. From the results of the discussion the researchers found that there were several provisions in the application of the MULIA product murabahah in Pegadaian Jalancagak that were not in accordance with the provisions of the Shari'a, including; first concerning the object of the contract or Marhun which was not raised or did not exist during the contract. Second, the sanctions that are permitted according to the Shari'a are applicable to customers who are capable but neglect or postpone delay of payment but do not apply to customers who are truly unable to pay, but in its application at Jalancagak pawnshop requires all customers to receive sanctions or pay fines if unable pay without exception. Third, in the application of sanctions / fines regarding funds generated from fines input as corporate income, which according to Shari'a provisions should be intended for social funds

Abstract

The purpose of this researech is to find out how the productive waqf management system of paddy land at the islamic fondation Miftahul Jannah Islamic Boarding School in Jatibaru District Jatisari Karawang, and how the distribution of results from productive waqf management of paddy land at the islamic fondation Miftahul Jannah Islamic Boarding School. Type of research used is field research, us for the approach used in this study is a descriptive-qualitative approach. Nadzir as the manager of waqf in the form of protecting waqf assets, nadzir made the Akta Ikrar Wakaf (AIW) to PPAIW so that have legal power in accordance with statutory regulation. In its management, nadzir uses the anual rental system (long-term rental model and hukr), in principle the payment is direct or cash for year. Waqf manager has never reported the management of waqf to the government or related parties because it does not understand the path or procedures for reporting. Management pattern is still included in the traditional consumptive waqf management pattern. The results of the management of waqf land are approved for boarding operation and for boarding improvements or revairs in school hostels, with a 50% share for the repairs or renovations of boarding schools and 50% for operational costs. Operational cost are divided 75% for the honorarium of the teacher council and 25% for the need of the ATK (Office Stationery).

Abstract

Abstrak - Tujuan dari penelitian ini adalah untuk mengetahui mekanisme praktek jual beli followers di media sosial Instagram dan untuk mengetahui mekanisme praktek jual beli followers di media sosial instagram dalam perspektif ekonomi Islam. Jenis penelitian yang digunakan adalah penelitian lapangan (field research), adapun pendekatan yang digunakan dalam penelitian ini adalah pendekatan deskriptif-kualitatif. Mekanisme yang dilakukan dalam praktik jual beli followers ini dilakukan seperti jual beli online dan Mekanisme praktik jual beli followers dalam perspektif ekonomi Islam, jual beli followers Jika ditinjau dari jual beli secara umum berdasarkan Fatwa Dewan Syariah Nasional- Majelis Ulama Indonesia Nomor 110/DSN-MUI/IX/2017 melalui tabel kesesuaian adanya ketidaksesuaian syariah dalam jual beli Followers. Jual beli followers ini termasuk kedalam jual beli yang tidak sah yang disebabkan tidak terpenuhinya beberapa rukun dan syarat diantaranya mengenai objek dan tidak sesuai dengan prinsip muamalah.
