Abstract

Abstract In the marriage contract to be binding on third parties, the marriage contract must be confirmed by official registration of marriage, this is in accordance with the provisions set forth in article 29 of Law No. 1 of 1974 on marriage stating that the time before marriage both parties by mutual consent can be entered into a written agreement approved by the marriage registrar officials after which the issue also applies to third parties during the third parties involved. This paper aims to analyze and find the clarity of the legal protection of third parties in the marriage contract canceled by the husband, and found the clarity of the status of marriage contract canceled by the court, which is still tied to a loan agreement with a third party. The benefits of this paper is expected to provide input legal protection of third parties in the marriage contract canceled. The method of writing the thesis is normative. Based on the results, it can be concluded that the form of legal protection for third parties on fair marriage contract is repressive protection. The validation status and marital agreements have legal force in this case the agreements made by deed, has the force of law is perfect, because it is made in the form of an authentic deed. If a marriage agreement is made to a notary and then registered to the court an agreement that has the force of law and if one spouse in default then they can sue replace losses when things are detrimental to the other party breached.   Key words: Agreement of marriage, legal protection, third party Abstrak Dalam perjanjian perkawinan agar dapat mengikat bagi pihak ketiga maka perjanjian perkawinan tersebut harus disahkan oleh pegawai pencatatan perkawinan, hal ini sesuai dengan ketentuan yang diatur dalam Pasal 29 Undang-undang nomor 1 tahun 1974 tentang perkawinan yang menyatakan bahwa pada waktu sebelum perkawinan berlangsung kedua belah pihak atas persetujuan bersama dapat mengadakan perjanjian tertulis yang disahkan oleh pegawai pencatat perkawinan setelah mana isunya berlaku juga terhadap pihak ketiga sepanjang pihak ketiga tersangkut. Tulisan ini bertujuan untuk menganalisis dan menemukan kejelasan perlindungan hukum bagi pihak ketiga dalam perjanjian perkawinan yang dibatalkan oleh suami, serta menemukan kejelasan status perjanjian perkawinan yang dibatalkan oleh pengadilan yang masih terikat dengan perjanjian utang piutang dengan pihak ketiga. Adapun manfaat dari tulisan ini diharapkan dapat memberikan masukan perlindungan hukum pihak ketiga dalam perjanjian perkawinan yang dibatalkan. Metode penelitian dalam tulisan tesis ini adalah yuridis normatif. Berdasarkan hasil penelitian, maka dapat disimpulkan bahwa bentuk perlindungan hukum yang berkeadilan bagi pihak ketiga pada perjanjian perkawinan merupakan perlindungan represif. Dan atas keabsahaan status perjanjian perkawinan ada kekuatan hukumnya dalam hal ini perjanjian yang dibuat dalam akta notaris, mempunyai kekuatan hukum sempurna, karena dibuat dalam bentuk akta otentik.  Jika sebuah perjanjian perkawinan tersebut dibuat ke notaris dan didaftarkan ke pengadilan maka sebuah perjanjian tersebut mempunyai kekuatan hukum dan bila salah satu pasangan melakukan wanprestasi maka mereka bisa menuntut gantu rugi bila hal yang tersebut merugikan kepada pihak yang dilanggar.   Kata kunci: Perjanjian perkawinan, perlindungan hukum, pihak ketiga

Abstract

The purposes of the research are to describe (1) increased the activity of students in writing the discourse description using cooperative learning model type TAI  and (2) increase students’ skills in writing discourse descriptions using cooperative learning model type TAI XI Lukis 1 SMK Negeri 3 Kasihan Bantul. Kind of this research is classroom action research which is held in two cycles. The research subject is all XI Lukis1 SMK Negeri 3 Kasihan Bantul students that contain 26 students.  The object of this study is subject to the basic competence  Indonesian write patterned narrative discourse description, descriptive, expository, and argumentative. The instrument that will be used is observation sheet, students, and teacher interview, test, and documentation The achievement data are analyzed in a qualitative way based on the reflection of every action cycle. The results of this study indicate that the TAI type of cooperative learning model can improve student learning activities in class XI Lukis 1 SMK Negeri 3 Kasihan Bantul on the process of learning to write discourse description. This is evident from the increased activity of students in each cycle. Students’ creativity in writing discourse description on pre-cycle 46,6%, cycle I 57,7%, and cycles II 69,23%. Students attention in paying attention to the teacher in pre-cycle 57,7%, the cycle I 69,23%, cycle II 76,9%. The attitude of the students in pre-cycle 65,38%,cycle I 73,1%, cycle II 84,6%. The students being active in a group discussion in pre-cycle 30,7%, the cycle I 38,5%, and cycle II 73,1%. Well cooperative in a group discussion of pre-cycle 53,8%, the cycle I 61,5%, and cycle II 92,3%. TAI type of cooperative learning model can improve the ability to write a description discourse of class XI Lukis 1 SMK Negeri 3 Kasihan Bantul. It is able to be seen from the aspect of idea contents in pre-cycle 26,92%, the cycle I 57,69%, and cycle II 92,30%. The idea organization accuracy in pre-cycle 38,46%, cycle I 69,23%, and cycle II 84,61%. The language order accuracy in pre-cycle 34,61%, cycle I 61,53%, and cycle II 84,61%. The use of vocabulary in pre-cycle 30,76%, the cycle I 65,38%, and cycle II 84,61%. The use of texts spelling in pre-cycle 34,61%, cycle I 69,23% and cycle II 92,30%.
