Abstract

ABSTRAK Dengan amandemen Undang-Undang Dasar 1945 ke 2 (dua) pengakuan Hak Asasi Manusia dicantumkan dalam pasal 28A-28J merupakan komitmen pemerintah Indonesia dalam pemenuhan Hak Asasi Manusia. Pengakuan HAM di Indonesian juga dilakukan dengan melakukan ratifikasi beberapa aturan internasional Hak Asasi Manusia. Pemeunuhan HAM Keberadaan hak asasi manusia bukan hanya dasar yakni hak hidup, tetapi juga penghilangan diskriminasi dalam segala bentuk, salah satunya dalam bidang hukum. Penegakan hukum sangat penting untuk menopang penegakan HAM di Indonesia. Khususnya penyelesaian pelanggaran HAM berat di Indonesia, baik selama orde baru atau orde lama. Penyelesaian kasus pelanggran HAM berat sangat penting, karena banyak kasus pelanggaran HAM berat yang belum terselesaikan. Adanya kendala baik dalam proses pengembalian berkas antara Komnas HAM dan Kejaksaan, serta keterlibatan DPR dalam proses tersebut seperti yang ada dalam pasal 43 ayat 2 UU No 26 Tahun 2000. Menjadikan tidak optimalnya penyelesain kasus pelanggaran HAM berat masa lampau. Dengan kewenangan terpisah dan dimiliki oleh tiga lembaga negara yang berbeda jelas tidak efisien, Sehingga dimungkinkan membentuk organ baru yang mereduksi fungsi serta kewenangan yang dimiliki oleh lembaga negara sebelumnya. Pembentukan lembaga tersebut dimaksutkan untuk mengoptimalkan dan efektif dalam penyelesaian pelanggaran HAM berat masa lampau.Kata Kunci: Pembentukan Komisi, Hak Asasi Manusia, Penegakan Hukum, Masyarakat Indonesia ABSTRACT By the second of amandement of the 1945 Constitution of The Republic of Indonesia, the recognition of human rights have officially been written in article 28A-28J which is the Indonesian government’s commitment in the fulfillment of human rights. The recognition of human rights in Indonesia is also done by making ratification of international human rights rules. The fulfillment of human rights with its existence is not only the basis of the right to life, but also as the elimination of discrimination in all forms, and one of them in the field of law. Law enforcement is salient role to sustain human right enforcement in Indonesia. Especially the settlement of gross violation of human rights in Indonesia, either during the new order or the old one.The settlement of gross violation of human right cases is predominant, as many cases of those problems have not been resolved. The existence of obstacles both in the process of returning the file between the Indonesian National Commission of Human Rights (in Indonesia known as Komnas HAM) and the attorney, as well as the involvement of the House of Representatives in the process as contained in article 43 paragraph 2 of Act No. 26 Year 2000, making it impossible to resolve cases of those violations in the past. Vis-à-vis with separate authority and being owned by three different state institutions are clearly inefficient, so it is possible to form a new organ reducing the functions and authorities owned by the previous state institutions. The establishment of such institutions is intend to optimize and be effective in the settlement of gross violation of human rights in the past. Abstract

This study aims to compare the history, goals, and models of multicultural education in the United States, the United Kingdom, and Indonesia. The study focuses on analyzing the similarities and differences in multicultural education approaches in the three countries through qualitative research using a desk study method. Data sources were obtained from journals, books, policy documents, and the latest scientific publications (2019–2025), then analyzed using content analysis techniques to identify themes, concepts, and evolving patterns of approaches. The results show that multicultural education in the United States emerged as a response to racial discrimination in the 1960s, while in the United Kingdom it developed rapidly due to the large influx of immigration after World War II. In Indonesia, multicultural education has strengthened since the 1998 Reformation era as a strategy to address ethnic and religious diversity and potential social conflict. This study recommends that Indonesia needs to develop a multicultural education model based on an inclusive curriculum, a pedagogy of equality, and an empowering school culture to strengthen social cohesion and tolerance.
