Abstract

Ridha Ayu Rachmawati, Agis Ardhiansyah, S.H., LL.M., Dr. Patricia Audrey Ruslijanto, S.H., M.Kn Fakultas Hukum Universitas Brawijaya Email:  ridhayu@yahoo.com   ABSTRAK Dewan  Keamanan PBB  didirikan pada tahun 1946. Dewan  Keamanan PBB memiliki anggota sebanyak 15 negara anggota, dimana 5 negara anggota merupakan negara anggota tetap yang mempunyai hak veto dan 10 negara anggota lainnya merupakan anggota tidak tetap yang dipilih oleh Majelis Umum PBB setiap periode 2 tahun. Dewan Keamanan PBB memiliki tugas untuk memelihara dan menciptakan perdamaian dan keamanan internasional sesuai dengan tujuan dan prinsip – prinsip Piagam PBB yang terdapat pada Pasal 24 Piagam PBB. Untuk mengajukan sengketa ke Dewan Keamanan PBB tidak diperlukan persetujuan pihak lain, jadi suatu negara anggota maupun bukan negara anggota dapat langsung meminta perhatian Dewan Keamanan PBB. Putusan yang dikeluarkan Dewan Keamanan PBB disebut Resolusi, yang mana resolusi yang dikeluarkan  bersifat  mengikat  secara  hukum  yang  terdapat  pada Pasal 25 Piagam PBB. Kata Kunci: Dewan Keamanan PBB, Kekuatan Hukum, Resolusi Dewan Keamanan PBB, Piagam PBB.  ABSTRACT The UN Security Council was set up in 1946. The UN Security Council has a membership of 15 countries, of which five member countries are permanent members who have veto power and 10 other member countries are non-permanent members elected by the UN General Assembly every two-year period. The UN Security Council has a duty to maintain and create peace and international security in accordance with the objectives and principles - the principles of the UN Charter contained in Article 24 of the UN Charter. To submit a dispute to the UN Security Council approval of the other party is not required, so a country members and non members can immediately draw the attention of the UN Security Council. The verdict issued by the UN Security Council called Resolution, which issued a resolution legally binding contained in Article 25 of the UN Charter. Abstract

The Bosnia-Herzegovina conflict in 1992 was a war that had its roots in the ethnic conflict (1992–1995) in Bosnia and Herzegovina, a former Yugoslav Republic with a multiethnic population consisting of Bosniaks (Bosnian Muslims), Serbs, and Croats. The Bosnia-Herzegovina conflict was a Non-International Armed Conflict (NIAC) which turned into an International Armed Conflict (NIAC). Factors causing conflict include ethnic and religious differences, the death of President Josip Broz Tito, the political policies of President Slobodan Milosevic, strategic areas, competition for natural and industrial resources, recognition of independence by the European Community and international organizations, and the economic crisis. International organizations that participated in ending the Bosnia-Herzegovina conflict include the UN, UNPROFOR, NATO, IFOR, SFOR, NAC, SHAPE, COMARCC, OIC, and NAM. After years of fierce fighting involving the three groups, Western countries, with the support of NATO, implemented a final ceasefire negotiated in Dayton, Ohio, USA, in 1995. This research uses qualitative research methods. Data presentation is carried out descriptively based on a comprehensive literature study from books, journals, and news to examine an event that has occurred objectively using existing theoretical approaches.
