Abstract

Haryono No. 169, Malang E-mail: liavitr@student.ub.ac.id ABSTRAK Berdasarkan teori norma hukum berjenjang Hans Nawiansky, susunan atau hierarki sistem norma, norma yang tertinggi (norma dasar) itu berkembang menjadi Norma fundamental Negara atau Staatsfundamentalnorm. Maka, berdasarkan teori norma hukum berjenjang, Pasal 7 ayat (1) UU No. 12 Tahun 2011 yang menyebutkan jenis dan hierarki peraturan perundang-undangan menimbulkan adanya ketidakpastian hukum berdasarkan teori norma hukum berjenjang, selain itu disebutkan pula dalam Pasal 3 ayat (1) UU No. 12 Tahun 2011 bahwa UUD NRI 1945 merupakan hukum dasar dalam Peraturan Perundang-Undangan yang berarti norma dasar dan sumber hukum bagi Pembentukan Peraturan Perundang-Undangan dibawah UUD NRI 1945. Sehingga, baik bentuk Staatsfundamentalnorm maupun Staatsgrundgesetz tidak dapat diklasifikasikan ke dalam jenis peraturan perundang-undangan (formale gezets), dilain sisi terkait Hak Uji, apabila bentuk Staatsgrundgesetz dipaksakan sebagai bagian dari peraturan perundang-undangan maka tentu, harus diperhatikan konstitusionalitasnya dan tidak bisa dilepaskan dari sifat pengujian terhadap norma yang mendasarinya. Oleh alasan tersebut penelitian hukum yuridis-normatif ini dilakukan dengan menggunakan pendekatan perundang-undangan, historis dan konseptual untuk menjawab pertanyaan-pertanyaan hukum. Sehingga kedudukan hierarki norma dalam Pasal 7 ayat (1) UU No. 12 Tahun 2011 perlu dilakukan peninjauan ulang dengan melakukan pemisahan kedudukan sesuai tingkatan norma hukum yang ada. Bahwa, UUD NRI 1945 tidak bisa disejajarkan maupun dikelompokan dengan norma Peraturan Perundang-Undangan (formale gezets). Kata Kunci: Hierarki Norma, Peraturan Perundang-Undangan, Pemisahan, UUD NRI 1945.     ABSTRACT According to the theory of tiered law by Hans Nawiansky, the structure or hierarchy of system of norm, the highest norm (basic norm) grows into fundamental norm of the state or Staatsfundamentalnorm. Thus, according to the theory of tiered law, Article 7 paragraph (1) of Law Number 12 of 2011 mentioning the type and hierarchy of the legislation sparks uncertainty in law according to the theory of tiered law. Moreover, Article 3 paragraph (1) of Law number 12 of 2011 also states that the 1945 Indonesian Constitution is the fundamental law in the legislation, meaning that basic norm and the source of law for the structure of the legislation are under the 1945 Indonesian Constitution. Therefore, either Staatsfundamentalnorm or Staatsgrundgesets cannot be classified into the type of legislation (formale gezets). In terms of the right to review, when the Staatsgrundgesetz is forced to be the part of legislation, the constitutionality must be taken into account and it cannot be set apart from the trait of review towards the norm that lies as the basis. Therefore, this normative-juridical legal research was conducted based on statute, historical, and conceptual approach. The state of the hierarchy of norm in Article 7 paragraph (1) of Law Number 12 of 2011 must be reviewed, and this review involves separation of state according to the level of the existing legal norm. The 1945 Indonesian Constitution cannot be set equal to or grouped with the norm of legislation (formale gezets). Keywords: Hierarchy of Norm, Legislation, Separation, 1945 Indonesian Constitution.

Abstract

The psychological condition of forming laws and regulations that lead to investment optimization through various licensing and investment policies is an important aspect in viewing the diorama of licensing developments in Indonesia, one of which was initiated by Law Number 11 of 2020 on Job Creation. Displacement specimen decentralized to semi-centralized licensing is one of the consequences of the policy package in the Job Creation Law. This paper was written using the normative research method with 4 (four) types of approaches: statute, conceptual, comparative, and futurist. The discussion in this paper boils down to licensing rationalization at the regional level which is termed "Empty Packages'', although the regulatory framework related to licensing directs regional authorities to make licensing packages through PMPTSP and facilitated by Public Service Malls. This altruism towards the phrase "Empty Package" is due to socio-juridical problems in each region for their role in maintaining the health of regional investment at a point dilemma. In addition to the basic regulations in controlling/authorizing permits, there are several problems. The logical consequence is that the regional government does not have the authority in terms of enforcing business licenses that are factually contrary to the socio-juridical conditions of the region. So that in the future the results of this research need to be designed interregional linkages which directs licensing policies to be in line with central-regional investment needs with several limitations such as the size of urgent needs, feasibility, and major changes.
