Abstract

Dispute settlement of land cases through the court contains many drawbacks such as bureaucratic barrier and time-consuming effort and cost. Although the principles of dispute resolution in the court claim that it takes short time and low costs, it remains difficult to implement. One of alter-native ways on dispute resolution land cases can be conducted through suitable mediation. Thus, the management, assessment and case management of land performed the National Land Agency along with the whole component of society in guaranteeing land cases can be quickly resolved. Key words: dispute settlement, mediation, legal certainty.

Abstract

AbstractCustomary inheritance law is influenced by the three kinship system. The Indonesian indigenous peoples, if there is a dispute about inheritance customs, completed the family council, if the hearts of deliberation families not bring results, then the Settlement shown to the Indigenous Institute, but when hearts division of inheritance still feel less satisfied BY Decision Traditional Leader Then Settlement of inheritance can be resolved in the court. Application of norms The jurisprudence of the Supreme Court Third hearts kinship system can be implemented yet, due to lack of knowledge of indigenous peoples against jurisprudence. Jurisprudence singer known only hearts Verdict The heritage dispute resolved by the Court InstituteIntisariHukum waris adat masih dipengaruhi tiga sistem kekerabatan Pada masyarakat adat jika terjadi sengketa waris adat, diselesaikan musyawarah keluarga, apabila dalam musyawarah  keluarga tidak  membawa hasil,  maka penyelesaian kepada lembaga adat, namun apabila dalam pembagian harta waris masih merasa kurang puas dengan putusan ketua  adat    maka  penyelesaian waris dapat diselesaikan di pengadilan. Penerapan norma Yurisprudensi Mahkamah Agung  dalam ketiga sistem kekerabatan belum  dapat  dilaksanakan,  disebabkan   kurangnya  pengetahuan  masyarakat    adat  terhadap  yurisprudensi.  Yurisprudensi  ini  hanya  dikenal  dalam  putusan  sengketa  warisan yang  diselesaikan  oleh  lembaga  pengadilan.

Abstract

The issue of joint property or shared assets (harta gono-gini) is actually a legal area that has not been fully explored, a domain open to ijtihad. The concept of joint property and all its details are not found in the studies of medieval Islamic jurisprudence (fiqh) or classical fiqh. The concepts surrounding joint property have continued to develop and are crucial to be discussed in contemporary studies. The urgent aspect to be researched is the model of managing marital property and the application of the principle of balanced justice in the distribution of marital property within the context of fiqh munakahat and marriage agreements in Islamic law. The research model used is normative juridical with a legislative approach and a conceptual approach. Thus, the result is that joint property, based on qiyas, can be managed through a marriage agreement. If not specified in the marriage agreement, then using the principle of balanced justice found in Islamic inheritance law.

Abstract

The government conducts land registration throughout the territory of the Republic of Indonesia to ensure legal certainty. Landowners are also obliged to register their land ownership rights through sporadic land registration or Systematic Land Registration. Sporadic land registration or Systematic Land Registration produces a land title certificate as proof of land rights, issued by the Regency/City Land Office. With the issuance of a land title certificate, a guarantee of legal certainty has been realized for the owner of the land title certificate, including certainty of land title status, certainty of land title subjects, and certainty of land title objects. A guarantee of legal protection is also realized for the owner of the land title certificate, namely the ownership of the land title certificate cannot receive interference or lawsuits from other parties and the land title certificate cannot be withdrawn or cancelled by anyone.   Abstrak Perlindungan Hukum dan Kepastian Hukum Kepemilikan Tanah: Pengabdian Masyarakat di Tambak Kemerakan-Sidoarjo.Pemerintah mengadakan pendaftaran tanah di seluruh wilayah Negara Republik Indonesia dalam rangka menjamin kepastian hukum. Pemilik tanah juga berkewajiban mendaftarkan tanah Hak Miliknya melalui pendaftaran tanah secara sporadik atau Pendaftaran Tanah Sistematik Lengkap. Pendaftaran tanah secara sporadik atau Pendaftaran Tanah Sistematik Lengkap menghasilkan sertipikat hak atas tanah sebagai surat tanda bukti hak atas tanah, yang diterbitkan oleh Kantor Pertanahan Kabupaten/Kota. Dengan diterbitkan sertipikat hak atas tanah terwujud jaminan kepastian hukum bagi pemilik sertipikat hak atas tanah, meliputi kepastian status hak atas tanah, kepastian subjek hak atas tanah, dan kepastian objek hak atas tanah. Juga terwujud jaminan perlindungan hukum bagi pemilik sertipikat hak atas tanah, yaitu pemilik sertipikat hak atas tanah tidak mendapatkan gangguan atau gugatan dari siapapun dan sertipikat hak atas tanah tidak dapat dibatalkan oleh siapapun.

Abstract

Baitul Maal wat Tamwil is a financial institution with a sharia concept that was born as a choice that changes the concept of maal and tamwil in one institution. The concept of maal was born and became part of the lives of Muslim communities in terms of collecting and distributing funds for zakat, infaq and shadaqah) productively. While the Tamwil concept was born for purely business activities to benefit from the middle to micro sectors of society. One of the financing activities carried out by BMT is financing based on profit sharing principles. Profit sharing is done by two types with mudharabah and musyarakah contracts. musyarakah is derived from the word syirkah, also called syarikah, which means a cooperation agreement between two or more parties for certain businesses, each party providing the assistance fund, and will be borne together in accordance with the aid fund, or mutual agreement. The methods used in the writing of this article are normative research using a statute approach and a conceptual approach.the result of this research indicates distribution of funds or financing must pay attention to various matters relating to caution both from within and from outside the Islamic Financial Institutions of Islamic Banks and Non-Islamic Banks. Matters issued from internships are in the form of Legal Lending Limit (LLL), financing guidelines, operational aspects. Aside from internal, things that are of caution are also excluded from the external supported by 5C analysis (Character, Condition, Capacity, Capital, Guarantee) and sharia compliance). This analysis must be considered in channeling financing to avoid elements forbidden in Islam.
