Abstract

In the new system of coaching inmates, inmate treatment is applied as a subject as well as the object. The subjects here as similarities, parallels, equally as human beings, are equal as creatures of God, both as a specific creature, capable of thinking and able to make decisions. As objects because basically there is no difference in the coaching position, the difference in coaching and not as human beings. Based on the information, the classification of prisoners according to the correctional objectives with regard to the guidance and upbringing. Guidance and education will be maximized if no classification of prisoners. For example, the classification of inmates by age. Prisoners who are still children or aged under 18 years (correctional education of children), coaching and education in contrast to older age. They got special treatment and should be fostered in childrens prisons.Keywords: Inmates, Correctional Institutions, Classification

Abstract

Recognition of the existence of legal values and sense of justice that life is constitutionally recognized as the author explained earlier. One of the key concepts that evolved form of legal recognition or live in the community is the adoption of the system of sanctions in customary law (customary criminal) in the national legal system. Recognition and protection of sanction customary law becomes an important thing in the life of indigenous peoples, for the customary sanctions, then it can be constructed or create a balance and social harmony, interests between the human race and the individual, between the alliance (group) and wider society that is the basis from the minds of traditional Indonesian nation. Recognition of the importance of values in society as customary law (customary criminal) in the renewal of the national criminal law as the national law reform agenda is a necessity and demand to the fulfillment of social justice in accordance ideals of the Indonesian nation.Keywords: Customary, Existence, Criminal Law Reform

Abstract

Victims are an important element in the continuation of legal evidence as a victim witness or reporter. As is the case with the problem of human trafficking crime. Victimology with its various kinds of views extends the criminal etiological theories needed to understand the existence of crime as a better structural and non-structural victimization. besides the views in viktimology encourage people to pay attention and serve each party who can be victims of mental, physical, and social. From the explanation of the victim's typology and the factors that led to the crime of trafficking in persons, it was concluded that there were three types of victims of trafficking in persons, namely Latend or Prodisposed Victims who were economic contributors. Participating Victims were victims who because the cause is a low education factor, and False Victims which is being a victim because the cause is a consumptive behavior factor.

Abstract

This article examines the application of restorative justice theory as an alternative approach to resolving human rights violations in two complex conflicts: the Rohingya crisis in Myanmar and the Syrian civil war. Both cases highlight the limitations of international legal frameworks and retributive justice in addressing large-scale violations, including genocide, forced displacement, and systemic discrimination. Restorative justice, emphasizing victim recovery, offender accountability, and community reconciliation, offers a more inclusive and sustainable solution to these crises. In Myanmar, the Rohingya community has faced decades of systemic persecution, culminating in military operations in 2017 that forced over 700,000 people to flee, primarily to Bangladesh. In Syria, the prolonged civil war since 2011 has caused widespread displacement and destruction, leaving over 8.6 million people internally displaced by 2022. Traditional mechanisms, such as International Court of Justice (ICJ) proceedings and United Nations interventions, have been hindered by political obstacles and enforcement challenges. This study explores the potential of restorative justice in both contexts, focusing on mechanisms such as inclusive dialogues, reparations, and reconciliation. Drawing on theoretical frameworks by Howard Zehr, Johan Galtung, and John Braithwaite, the article proposes practical applications for rebuilding trust and addressing the root causes of the conflicts. The findings suggest that restorative justice can not only address the immediate needs of victims but also foster long-term peace and stability by transforming social relationships and reducing the likelihood of recurrent violence. By shifting the focus from punitive measures to holistic recovery, this approach offers valuable insights into the resolution of modern humanitarian crises..

Abstract

Pengabdian ini dilaksanakan dengan tujuan selain mendukung program pendidikan tinggi dalam mengadvokasi perbuatan-perbuatan penyalahgunaan media sosial yang dikategorikan sebagai suatu kejahatan juga ditujukan untuk menyebarluaskan informasi pada masyarakat mengenai tanggung jawabnya dalam upaya mencegah terjadinya penyalahgunaan media sosial, dan mengingatkan kembali kepada masyarakat mengenai kewajibannya untuk memberikan perlindungan kepada korban penyalahgunaan media sosial. Adapun metode yang digunakan dalam pengabdian ini adalah ceramah dan diskusi interaktif. Hasil ceramah dan diskusi secara interaktif dalam pengabdian ini menunjukkan bahwa memahami dengan baik terhadap materi yang disampaikan. Secara umum pelaksanaan kegiatan pengabdian kepada masyarakat terlaksana dengan baik, tertib dan lancar. Seluruh elemen masyarakat menunjukkan antusiasmenya melalui pertanyaan-pertanyaan yang disampaikan secara variatif dan direspons dengan jawaban-jawaban yang baik pula. Melalui seluruh tahapan pelaksanaan kegiatan pengabdian ini, masyarakat Desa Galo-Galo juga menyampaikan harapan agar kegiatan serupa dapat terus terlaksana di desanya dengan tema atau pokok pembahasan lain sesuai dengan kondisi objektif serta kebutuhannya sebagaimana masyarakat yang hidup di desa dan berada pada pulau kecil.

Abstract

giatan ini bertujuan untuk merevitalisasi Bobango sebagai sanksi hukum dalam tradisi masyarakat Desa Wayaua Kabupaten Halmahera Selatan yang mengalami degradasi pasca-konflik horizontal 1999-2000. Metode pelaksanaan kegiatan dilakukan melalui tiga tahapan, yaitu survei pendahuluan dan Focus Group Discussion untuk mengidentifikasi kondisi eksisting praktik Bobango, penyuluhan hukum partisipatif dan lokakarya untuk melatih tokoh adat dalam mengelola prosesi Bobango secara terstruktur serta pendampingan penyusunan Peraturan Desa, dan evaluasi berkelanjutan berbasis komunitas untuk mengukur efektivitas program. Hasil kegiatan menunjukkan bahwa revitalisasi Bobango berhasil memulihkan kharisma lembaga adat, meningkatkan kesadaran hukum masyarakat khususnya generasi muda, serta menciptakan draft Peraturan Desa yang memberikan legitimasi formal bagi mekanisme penyelesaian sengketa berbasis kearifan lokal. Keberhasilan ini membuktikan bahwa integrasi hukum adat ke dalam kebijakan desa mampu menciptakan stabilitas sosial berkelanjutan dan menawarkan paradigma baru penyelesaian konflik yang lebih kultural, humanis, dan berkeadilan di tingkat akar rumput.

Abstract

Criminal-law systems grounded in the principle of nullum crimen sine lege face a doctrinal challenge in accommodating unwritten societal norms as a source of criminal liability. Post-colonial states in Southeast Asia with pluralistic populations have developed divergent constitutional architectures for recognising living law within their criminal justice systems. Systematic comparative scholarship on the constitutional models through which Southeast Asian jurisdictions recognise living law remains limited. This article compares the constitutional construction of living law recognition in the criminal law of Indonesia, Malaysia, Brunei Darussalam, and the Philippines, identifying the constitutional bases, normative mechanisms, and implications of each model for the principle of legality, human-rights protection, and state legal sovereignty. The study employs normative legal research with the functional method of comparative law as articulated by Zweigert and Kötz. The analysis yields a typology of four constitutional limitation models: substantive limitation (Indonesia), jurisdictional limitation (Malaysia), authoritative limitation (Brunei Darussalam), and communitarian limitation (Philippines). Indonesia's dual-legality model under Article 2 of Law No. 1 of 2023 occupies the most complex position relative to the formal legality principle, while incorporating substantive human-rights safeguards absent from religion-based models. Implementation in Indonesia requires national standardisation of subnational formalisation, operationalisation of limitation clauses, safeguards against discriminatory application, and strengthening constitutional oversight.

Abstract

The Bugo tradition in Sangowo Village, Morotai Island Regency, is the practice of taking fruit or goods from someone's garden by leaving a sign as notification to the owner. This practice raises legal issues when confronted with theft under the Criminal Code and sariqah in fiqh al-jināyāt. This study employs a legal-empirical or socio-legal method with conceptual and comparative approaches to analyse Bugo's legal status from the perspectives of positive and Islamic criminal law. The results show that although Bugo formally fulfills the elements of Article 476 of the Criminal Code, its material unlawfulness is nullified because it is a living law accepted by the community and qualifies as a reason for criminal exemption outside the law. From the fiqh al-jināyāt perspective, Bugo does not fulfill the elements of khufyah and qaṣd al-sariqah, while strong shubhah from ʿurf nullifies the ḥadd based on the rule of "idrāʾ al-ḥudūd bi al-shubuhāt" (ḥudūd are averted by doubt). Both legal systems have flexible safety valves and consider social context, yet differ in focus: positive criminal law nullifies the act's unlawful nature, whereas Islamic criminal law nullifies the ḥadd penalty even when the act remains shubhah.   Abstrak Tradisi Bugo di Desa Sangowo, Kabupaten Pulau Morotai, adalah praktik mengambil buah atau barang dari kebun milik orang lain dengan meninggalkan tanda sebagai pemberitahuan kepada pemiliknya. Praktik ini menimbulkan problematika yuridis ketika dihadapkan pada delik pencurian dalam KUHP dan delik sariqah dalam fikih jinayat. Penelitian ini menggunakan metode yuridis-empiris atau socio-legal research dengan pendekatan konseptual serta pendekatan komparatif untuk menganalisis status hukum tradisi Bugo dalam perspektif hukum pidana positif dan hukum pidana Islam. Hasil analisis menunjukkan bahwa meskipun tradisi bugo secara formil memenuhi unsur delik Pasal 476 KUHP, sifat melawan hukum materiilnya gugur karena merupakan living law yang diterima masyarakat dan dapat dikualifikasikan sebagai alasan penghapus pidana di luar undang-undang. Dalam perspektif fikih jinayat, tradisi Bugo tidak memenuhi unsur khufyah dan qaṣd al-sariqah, serta menimbulkan shubhah yang kuat dari ʿurf yang menggugurkan ḥadd berdasarkan kaidah “idrāʾ al-ḥudūd bi al-shubuhāt”. Kedua sistem hukum memiliki katup pengaman yang fleksibel dan mempertimbangkan konteks sosial, namun berbeda dalam fokus: hukum pidana positif menggugurkan sifat melawan hukum perbuatan, sementara hukum pidana Islam menggugurkan sanksi ḥadd meskipun perbuatan masih bersifat shubhah.
