Abstract

: In this qualitative research, the reseachers described the instructional methods which were applied by Early Childhood Education (PAUD) Permata Bunda. The documentation, observation, and interview were used as instruments to collect the data. The results revealed that Early Childhood Education of Permata Bunda used the instructional methods 1) playing blocks method; 2) memorizing method; 3) role play method; 4) playing music and sing method; 5) playing card method; and 6) experimental method. The results implicated to the teachers should have strong motivation to upgrade students’ knowledge and create the creative instructional media to apply the instructional methods were organized. Abstrak: Penelitian ini bertujuan untuk mengetahui metode pembelajaran yang digunakan di PAUD Permata Bunda. Jenis penelitian ini adalah deskriptif kualitatif. Data dikumpulkan dengan menggunakan metode dokumentasi, observasi, dan wawancara. Hasil penelitian tentang metode pembelajaran yang digunakan di PAUD Permata Bunda adalah: 1) metode bermain balok; 2) metode hafalan; 3) metode bermain peran; 4) metode bermain musik dan bernyanyi; 5) metode bermain kartu; 6) metode eksperimen. Hasil temuan dalam penelitian ini mengharuskan guru memiliki motivasi yang kuat untuk meningkatkan pengetahuan dalam menciptakan media-media pembelajaran yang kreatif demi terlaksananya metode pembelajaran yang telah disusun

Abstract

Fatwa is believed to be a container having an important and significant role in the religious life of the Islamic community. The urgency and significance can be seen from its function as a mediating between the ideals of Islamic law on the one hand with the factual reality-communities on the other. This is where all the problems, concerns, hopes, aspirations and experiences presented and confronted people to look for common ground with the ideals of moral and religious ethics in Shari'ah mediated by the intellectual prowess of a mufti. One of the institutions that are semi-formal fatwa is the fatwa issued by the Fatwa Commission of the Indonesian Ulema Council (MUI), because these institutions are formally established by the government, but its provisions can not be forced as the decision of the judiciary. Since its establishment in 1975 MUI fatwa has been issued either at the request of individuals, community groups and at the request of the government. This simple article will try to look at and examine some of the MUI fatwa has been issued, to then be viewed and analyzed, especially in terms of legal istinbat method used in formulating his fatwa. Fatwa diyakini sebagai wadah yang memiliki peran penting dan signifikan dalam kehidupan beragama komunitas Islam. Urgensi dan signifikansinya terlihat dari fungsinya sebagai mediasi antara cita ideal hukum Islam di satu pihak dengan realitas-faktual masyarakat di pihak lain. Di sinilah setiap problem, keprihatinan, harapan, aspirasi dan pengalaman masyarakat disampaikan dan dikonfrontasikan untuk dicarikan titik temu dengan cita moral dan etika religius dalam syari’ah yang dimediasi oleh kecakapan intelektual seorang mufti. Salah satu lembaga fatwa yang bersifat semiformal adalah fatwa yang dikeluarkan oleh Komisi Fatwa Majelis Ulama Indonesia (MUI), karena lembaga ini resmi dibentuk oleh pemerintah, namun ketetapannya tidak dapat memaksa sebagaimana keputusan lembaga peradilan. Sejak berdiri tahun 1975, MUI telah banyak mengeluarkan fatwa baik atas permintaan individu, kelompok masyarakat maupun atas permintaan pemerintah. Tulisan sederhana ini akan mencoba untuk melihat dan meneliti beberapa fatwa yang telah dikeluarkan MUI, untuk kemudian dilihat dan dianalisis, terutama dari segi metode istinbat hukum yang digunakan dalam merumuskan fatwanya.

Abstract

Dalam artikel ini ada tiga hal yang  menjadi permasalahan yaitu tentang Bagaimana bentuk-bentuk pemberdayaan, bentuk usaha simpan pinjam dilihat dalam perspektif syariah dan Apa saja Faktor-faktor penghambat dalam pemberdayaan ekonomi berbasis syariah pada KPRI SMAN 1 Kota Solok.Jenis penelitian yang dilakukan adalah penelitian lapangan (field research) dengan menggunakan pendekatan kualitatif. Tujuan penelitian untuk mengetahui bentuk-bentuk pemberdayaan, bentuk usaha simpan pinjam dilihat dalam perspektif syariah dan bentuk factor-faktor penghambat dalam pemberdayaan ekonomi berbasis syraiah di KPRI SMAN I Kota Solok.Teknik pengumpulan data adalah wawancara, dan dokumentasi untuk mendapatkan data-data yang berhubungan dengan masalah yang diteliti, kemudian membaca dan menelaah, selanjutnya menganalisis data yang diperlukan dengan berbagai landasan teori dan terakhir menarik kesimpulan.Hasil penelitian menunjukan bahwa Bentuk-bentuk pemberdayaan berbasis syariah pada KPRI Syariah SMAN I Kota Solok Pertama, koperasi telah dikelola dengan pola syariah Kedua, simpan pinjam dan pembiayaan syariah yang telah diberikan kepada anggota telah mencapai Rp. 70.000.000,- (Tujuh Puluh Juta Rupiah); Ketiga, dengan jasa/ujrah/nisbah/fee sebesar 0,8 yang disepakati dengan anggota dalam setiap simpan pinjam dan pembiayaan syariah Keempat, meningkatkan pemahaman dan kemampuan pengurus dan anggota dalam pengelolaan koperasi dengan pola syariah Kelima, berpartisipasi dalam kegiatan yang dilakukan oleh DEKOPINDA Kota Solok, Dinas Koperasi dan Perindusrtian Kota Solok dan KPRI Pusat di Provinsi Sumatera Barat; Keenam, mendistribusikan dana sosial, reward bagi anak anggota yang berprestasi dan zakat produktif bagi masyarakat sekitarnya.

Abstract

Undang-undang Peradilan Agama yang disingkat dengan UUPA merupakan ketentuan perundangan-undangan yang mengatur susunan, kekuasaan dan hukum acara Peradilan Agama. Ketentuan tentang ini dituangkan dalam UU Nomor 7 tahun 1989 tentang Peradilan Agama dan Undang-undang Nomor 3 tahun 2006 tentang Perubahan atas Undang-undang Nomor 7 tahun 1989. Kelahiran UUPA ini menandai berakhirnya keanekaragaman peraturan yang mengatur tentang kekuasaan, kedudukan dan tekhnik beracara di Peradilan Agama sebagai salah satu lembaga peradilan yang diakui eksistensinya dan menjadi salah satu lembaga untuk para pencari keadilan dalam persoalan khusus yang terjadi di antara umat Islam di Indonesia. Karena sebelum berlakunya UUPA Pengadilan Agama diatur dengan berbagai macam peraturan dan dengan berbagai nama dan sebutan, di antaranya peradilan serambi, kerapatan qadhi dan lain sebagainya.

Abstract

This article examines the regulation of the guardian of  Nagari Batu Basa number 06 of 2020 concerning the prevention and eradication of community diseases and immoral acts. Because the people of Nagari Batu Basa are all Muslim, this study of the rules of the guardian of the nagari is viewed from the fiqh of siyasah dusturiyah. This Wali Nagari regulation emerged because of immoral acts and public ills in the form of drunkenness with glue media in Batu Basa Village. This action is certainly disturbing and brings discomfort to the residents of Nagari Batu Basa and it is feared that it will be transmitted to other communities. Therefore, Wali Nagari Batu Basa as the leader of Nagari Batu Basa issued a Wali Nagari regulation related to the disease of the community. This research uses field research. The data were obtained through interviews and observations, then the data were narrated descriptively. In this study, it was concluded that the wali nagari as the leader of Nagari Batu Basa in this case was the vizier (government assistant) issued the wali nagari regulation no. 6 tahun 2020 untuk kemaslahatan masyarakat Nagari Batu Basa. From the point of view of fiqh siyasa dusturiyah, it appears that the rules are in line and not contradictory, only in the provision of sanctions for violations that occur, it appears that the sanctions given are not in line with Islamic rules. This is because in Islam the perpetrators of adultery and khamr are subject to flogging and stoning, while in the wali nagari regulations the punishment for adultery and khmar is only subject to a fine.

Abstract

Marriage is sunnatullah as a human being who needs a partner with the aim of producing offspring. However, among the community, sometimes the implementation of marriage is carried out by underage brides, while the marriage requires mental and material readiness that is able to be responsible for carrying out the household. This study aims to reveal the implementation of underage marriages that occur in Lebong society. This research uses qualitative methods with a form of field research and uses normative and empirical research models. This research resulted in the findings of the Lebong Religious Court making decisions and providing dispensation for the implementation of marriage, including Amendments to Law Number 1 of 1974 concerning marriage and Pregnancy outside marriage. The basis for the Judge's consideration in making decisions and providing dispensation to the community who applied for marriage, namely Supreme Court Regulation Number 5 of 2019 and other grounds that need to be considered by the Religious Court Judge, such as girls who are already pregnant first, children are no longer in school, children are already working and so on. Based on the analysis of maqasid Al-Syariah review, it can be reviewed from the level of dharuriyyaat, and Hajiyyaat. However, the elements of the level that need to be maintained in maqashid al-syari'ah, namely Maintaining Religion, Maintaining Life, Maintaining Property and Maintaining Descent.

Abstract

The primary issues in this thesis are the causes of siri polygamy, the effects it has on siri polygamous families, and how Tanah Datar Regency has dealt with siri polygamy. The purpose of this study is to investigate and elucidate the causes of siri polygamy in Tanah Datar Regency, as well as the effects and solutions related to this phenomenon. The study's findings indicate that: 1) There are frequent arguments between husband and wife, the husband feels capable, and it is customary to follow ancient customs. The second wife-to-be has not processed the previous husband's death certificate. The husband is worried and does not get permission from the first wife. 2) Siri polygamy has negative effects on children, spouses are unjust and insufficient in allocating their income, spouses are uncaring and hardly return home, wives feel betrayed, and marriages are not legally binding in Tanah Datar Regency. 3) Tanah Datar Regency's resolution of siri polygamy, Out of the five data sets, two had amicably (non-litigation) resolved their issues, with both families and the mother present. None of the data sets were settled in court. Regarding unregistered polygamous weddings, the local Nagari administration has not issued any particular regulations. 4) Unregistered polygamous marriages are regarded under Islamic family law as having no legal significance, with the children being entrusted to the mother and the woman having no rights to assert in the event of a divorce or inheritance. Islamic law permits polygamy as long as certain requirements are met, such as the need that it be done properly and with no more than four partners. In addition, the law and KHI stipulate that the woman cannot have children, has an irreversible illness, or is disabled. The husband also needs the consent of the first wife. There is also an assurance that the husband would be able to fairly provide for his wife and kids.
