Abstract

Efforts to eradicate drug crimes present a law that has criminal sanctions, namely Law Number 35 of 2009 concerning Narcotics (abbreviated as the Narcotics Law) that criminal sanctions in the Narcotics Law are one of them with a death penalty. The Narcotics Law regulates the policy of criminal sanctions for drug abusers which are divided into two categories, namely the perpetrators as “Users” and/or “Dealers”. It is possible for perpetrators as dealers to be subject to the most severe criminal sanctions in the form of capital punishment as regulated in Article 114 paragraph (2). The method of legal discovery (rechtsvinding) that is often used by judges is the method of interpretation or interpretation. The results of the study state that the interpretation of the provisions that have been stated expressly must not deviate from the intent of the legislators. The judge has the authority to interpret the law if the content of the article used is unclear or incomplete. Analytical interpretation in the field of criminal law is prohibited insofar as it makes a formulation of the offense to be expanded. Analogous interpretation is permitted if it is used to fill the voids contained in the law because it has not been regulated in the provisions of the law.Keywords: Disparity; Judge; Drugs AbstrakUpaya untuk memberantas kejahatan narkoba menghadirkan sebuah Undang-Undang yang memiliki sanksi pidana yaitu Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika (disingkat UU Narkotika) bahwa Sanksi Pidana dalam Undang-Undang Narkotika salah satunya adalah sanksi pidana mati. Undang-Undang Narkotika mengatur mengenai kebijakan sanksi pidana bagi pelaku penyalahguna narkoba yang dibagi kedalam dua kategori yaitu pelaku sebagai “Pengguna” dan/atau “Pengedar”. Terhadap pelaku sebagai pengedar dimungkinkan dikenakan sanksi pidana yang paling berat berupa pidana mati seperti yang diatur dalam Pasal 114 ayat (2). Metode penemuan hukum (rechtsvinding) yang sering digunakan hakim yaitu metode interpretasi atau penafsiran. Hasil penelitian menyatakan bahwa Penafsiran terhadap ketentuan yang telah dinyatakan dengan tegas tidaklah boleh menyimpang dari maksud pembentuk Undang-Undang. Hakim mempunyai kewenangan untuk melakukan penafsiran hukum apabila isi pasal yang digunakan tidak jelas atau kurang lengkap. Penafsiran secara analogis di dalam lapangan hukum pidana terlarang sejauh ia membuat suatu rumusan delik itu menjadi diperluas.  Penafsiran secara analogi diizinkan apabila digunakan untuk mengisi kekosongan-kekosongan yang terdapat di dalam Undang-Undang karena belum diatur dalam ketentuan Undang-Undang tersebut.Kata Kunci: Disparitas; Hakim; Narkoba

Abstract

In Indonesia, the faking of birth certificates is extremely widespread. Marriages between minors are among the factors that contribute to the falsification of birth certificates. The purposeful forgery of birth certificates is done so that a child can easily obtain permission to marry and is not restricted by laws protecting minors who marry. The study employs a qualitative research methodology that combines a literature approach and a legal approach. According to the findings of the study, the falsification of birth documents in the marriage of minors also violates the law. Counterfeiting is a sort of norm violation, namely of the truth or public order. No identity fraud will occur if the marriage is performed in accordance with the applicable procedures. Due to the lack of education and information of parents, children, and the community, underage marriage is prevalent. This is one of the most powerful causes because their lack of education and information influences their children who marry before the age of majority.Keywords: Birth Certificate Forgery; Marriage Law; Minors AbstrakPemalsuan akta kelahiran yang terjadi di Indonesia sangat sering terjadi. Beberapa hal yang menjadi salah satu penyebab pemalsuan akta lahir adalah karena adanya pernikahan anak dibawah umur. Pemalsuan akta lahir ini sengaja dilakukan agar seorang anak mendapatkan ijin menikah dengan mudah dan tidak dibatasi dalam undang-undang perlindungan anak yang menikah dibawah umur. Penelitian menggunakan metode penelitian kualiatatif dengan pendekatan literature dan pendekatan perundang-undangan. Hasil penelitian menyatakan bahw pemalsuan akta lahir pada pernikahan anak di bawah umur juga mengakibatkan hukum pidananya. Perbuatan pemalsuan merupakan suatu jenis pelanggaran norma yaitu kebenaran atau kepercayaan dan ketertiban masyarakat. Pemalsuan identitas tidak akan terjadi apabila perkawinan dilaksanakan dengan mengikuti prosedur yang berlaku. Rendahnya tingkat pendidikan maupun pengetahuan orang tua, anak dan masyarakat, menyebabkan adanya kecenderungan untuk mengawinkan anaknya yang masih di bawah umur. Hal ini menjadi salah satu faktor yang sangat berpengaruh karena pendidikan dan pengetahuan yang tidak mereka dapatkan menjadi imbas bagi anak-anak mereka yang dikawinkan di bawah umur.Kata Kunci: Pemalsuan Akta Lahir; Hukum Pernikahan; Anak Dibawah Umur

Abstract

In Indonesia, the criminal law system is the one that decides the appropriate punishment for crimes and other legal transgressions. The use of the death sentence is still permitted under Indonesia's Criminal Code (KUHP), as well as some extra-criminal provisions. A translation of the Wetboek van Strafrecht voor Nederlandsch-Indie, which has been in effect in the Dutch East Indies (now known as Indonesia) since 1918 under the administration of the Dutch colonial government, can be found within the articles of the Criminal Code that govern the use of the death penalty. However, the Netherlands did away with the death sentence in 1870. Instead, a literature-based approach is used employing a qualitative research method currently being used. The study's findings indicate that significant crimes and the use of the death penalty throughout the history of criminal Law are two aspects of the problem that are strongly related. The legal system reserves the death penalty for those who have committed the most severe crimes. Therefore, many believe that the death penalty is the most severe punishment.

Abstract

The rise of social media has facilitated communication between people, but it has also made it simpler to spread false information, which can lead to hate speech. At the height of the COVID-19 pandemic, all public gatherings were canceled, and people stayed home. Due to the ease with which information may be shared and disseminated and the difficulty in determining the authenticity of user claims, online hate speech is commonplace. The author incorporates legal research methods from qualitative and normative perspectives into this paper. As the results show, social media use has skyrocketed during the COVID-19 pandemic due to government restrictions on activities that can be carried out outside the home. Thus, many people like spending time on social media, and some even deliberately post remarks that amount to hate speech.Keywords: Crime; Hate Speech; Social media Abstrak Maraknya media sosial telah memfasilitasi komunikasi antar manusia, tetapi juga mempermudah penyebaran informasi palsu, yang dapat mengarah pada ujaran kebencian. Pada puncak pandemi COVID-19, semua pertemuan publik dibatalkan, dan orang-orang tetap tinggal di rumah. Karena mudahnya informasi dibagikan dan disebarluaskan serta sulitnya menentukan keaslian klaim yang dibuat oleh pengguna, ujaran kebencian online menjadi hal yang lumrah. Penulis memasukkan metode penelitian hukum baik dari perspektif kualitatif maupun normatif ke dalam makalah ini. Hasilnya, penggunaan media sosial meroket di masa pandemi COVID-19 sebagai akibat dari pembatasan pemerintah terhadap aktivitas yang boleh dilakukan di luar rumah. Sehingga, banyak orang yang suka menghabiskan waktu di media sosial, bahkan ada yang sengaja memposting ucapan yang berbau ujaran kebencian.Kata Kunci: Tindak Pidana; Ujaran Kebencian; Media Sosial

Abstract

The right to justice, and human rights more generally, requires the filing of a judicial review (PK) in Indonesia. A judicial review (PK) can be requested by an individual who believes that his rights have been infringed or that the court's judgment is incorrect. The cassation decision can be challenged in court by either the convicted person or the prosecution if they believe it violates basic principles of fairness and legal certainty. However, the Constitutional Court can in its decision revoke the prosecutor's authority to submit a judicial review (PK) because it is considered contrary to human rights, especially in terms of recognition, guarantees, protection and fair legal certainty and equal treatment before the law. This study used a qualitative research method with a statutory and literature approach. The results of the study stated that it was very important for the prosecutor to have the right to submit a judicial review (PK) on the cassation decision of the Supreme Court which was deemed not to have fulfilled legal certainty and justice for the victim and the state. If this is omitted, it will cripple law enforcement. The reason for submission, guarantee, protection and legal certainty for the convict cannot be fully recognized, because there are still rights to guarantee, protection and legal certainty for the victim and the people of Indonesia which must also be maintained and respected.
