Abstract

Tujuan Penelitian ini untuk mengetahui hubungan hukum yang timbul dalam jual beli dan pemanfaatan rumah  antara konsumen dan developer tidak hanya berlangsung karena adanya perjanjian (perjanjian pengikatan jual beli) semata, tetapi juga timbul karena ketentuan undang-undang (hubungan hukum perikatan). Hubungan hukum tersebut berlangsung pada setiap proses/tahapan transaksi, baik tahap pra transaksi, tahap transaksi maupun tahap purna/pascatransaksi, yang dimulai dari kegiatan developer untuk menyediakan berbagai macam kelengkapan perisinan, proses produksi (penyediaan dan pemanfaatan lahan untuk pembangunan rumah tinggal beserta sarana dan prasarana), promosi dan penawaran (brosur, iklan. Hubungan hukum tersebut berlangsung pada setiap proses/tahapan transaksi, sehingga perlindungan hukum harus pula diperoleh setiap konsumen dalam setiap tahapan transaksi. Perlindungan hukum atas hak-hak konsumen dalam proses tahapan jual beli dan pemilikan rumah tinggal telah diatur dan tersebar dalam berbagai ketentuan hukum dan perundang-undangan seperti: Kitab Undang-Undang Hukum Perdata, Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang No. 4 Tahun 1992 tentang Perumahan dan Permukiman. Permasalahan sengketa yang seringkali dihadapi konsumen dalam jual beli dan pemilikan rumah, menunjukkan kecenderungan konsumen untuk tidak menggunakan sarana/wadah penyelesaian sengketa yang ada (litigasi dan non litigasi), tetapi lebih cenderung melakukan musyawarah dengan developer.

Abstract

Allah swt. telah menjadikan agama Islam sebagai agama yang menaungi berbagai aspek kehidupan manusia baik dan menjadikan Al-Qur’an sebagai pedoman dalam menjalankan agama Islam. Tentunya Allah Swt menuntun makhluknya kepada kebaikan dunia dan akhirat yaitu dengan memberikan arahan mengenai kebenaran dan keburukan yang sejalan dengan fungsi Al-Qur’an terhadap manusia sebagai pembeda antara kebaikan dengan keburukan. Anak menjadi salah satu generasi Islam harus diberikan pendidikan yang layak. Tujuan dari penelitian ini untuk menilik dan menelusuri pola pembinaan anak asuh pada panti asuhan Amrillah, dalam persfektif hukum Islam dan Undang-Undang Perlindungan Anak. Metode penelitian yang digunakan adalah penelitian lapangan (field research) dan bersifat kualitatif dan komparatif. Sumber data yang dipergunakan dalam penelitian ini bersumber dari data primer dan sekunder. Hasil penelitian ini adalah bahwa kewajiban pola pembinaan anak yatim perspektif hukum Islam dan undang-undang perlindungan anak, maka perlu ada upaya untuk melakukan terobosan baru dalam mensosialisasikan perlunya mengadopis pola pembinaan dalam Islam maupun Undang-Undang agar dijadikan sebagai rujukan dalam pola pembinaan panti asuhan. Peneliti menemukan, ada empat pola pembinaan yang digunakan pada pola pembinaan Panti Asuhan Amrillah, pertama pola pembinaan rohani yang erat kaitannya dengan agama, kedua pola pembinaan akhlak yang berkaitan dengan kehidupan sosial anak asuh, ketiga pola pembinaan mental dan keempat pola pembinaan fisik atau jasmani.Kata Kunci: Pola Pembinaan, Anak Yatim, Hukum Islam, UU Perlindungan Anak

Abstract

This study aims 1) to determine the timing of the Isha prayer from the perspective of the Qur'an and Hadith 2) to determine the timing of the Isha prayer from the perspective of astronomy. This type of research is library research “Library Research” with syar'i and astronomical approaches. The results of this study indicate that the timing of the Isha prayer based on the Qur'an has not explained in detail when the beginning and end of the Isha prayer time. Meanwhile, according to the hadith of the Prophet Muhammad. that the beginning of the Isha time coincides with the end of the Maghrib time. As for the end of the Isha time according to the hadith, the longest is at midnight. Although there are other opinions that understand the end of Isha time is just before dawn. As for the timing of the Isha prayer from the perspective of astronomy, namely when the syafak in the west has disappeared from the horizon with a sun height of -18°. Although the height of the sun at the time of Isha stated by astronomers is quite varied. However, this does not become an obstacle in developing and continuing to do research on Isha time. So that the next schedule circulating in the community will vary. This study focuses on the beginning and end of Isha time. This research should be followed by further research for the sake of scientific perfection. Because today's era where skyscrapers are increasingly being built, which of course will affect the duration of the prayer.

Abstract

The discussion in this article is about the perspective of astronomy in determining the beginning of prayer times. The main issues in this article are: 1.) How is the influence of the position of the sun in determining prayer times? 2.) What is the role of astronomy in determining prayer times? This article is classified as library research, data is collected by quoting, adapting, and analyzing representative literature that has relevance to the problems discussed, then reviews, and concludes. After holding a discussion about the Analysis of the Effect of the Position of the Sun on the Early Determination of Prayer Times from the Astrological Perspective, the authors can conclude that the determination of the beginning of prayer times is not always the same every day so that it will change depending on the position of the sun and solar data. Likewise in knowing the end of the prayer time that has been determined. The method used to determine the beginning of the prayer time in this study was the calculation method (reckoning). For this reason, it is very important to study more deeply about astronomy, especially regarding the determination of the beginning of prayer times because every day the position of the sun will be different so that the prayer times change differently. The implication of the research in this article is that the author hopes that the government, astronomy experts, Islamic organizations, especially students, will continue to study more deeply the books of astronomy written by contemporary scholars in order to broaden their understanding of the early determination of prayer times. regarding the early determination of prayer times to the community, especially in remote areas so that people also know how to determine the early prayer times and understand that prayer times are not always the same every day.
