Abstract

a clayed soil characterized by reddish in colour, thick solum and neutral acidity. Farmers in Parakan area, Parigi District of Pangandaran, usually cultivate cash crops in terra rossa. Nowadays, farmers have no information about the properties of the soil, which is an important factor to maintain and increase plant productivity. The objective of this descriptive quantitative study was to verify the soil characteristic included physicochemical and microbiological properties in a selected agricultural field of Parakan. The soil samples were taken from three different areas covered with different vegetation. The study showed that terra rossa in the karst area is a non-saline soil with neutral acidity and low electrical conductivity. The texture of all soils were clay contained >50% clay particle. The soils were low in organic carbon, total nitrogen and available phosphor; but high in total phosphor and potassium, as well as cation exchange capacity. The population of soil microbes include total and fungal bacteria, as well as nitrogen-fixing Azotobacter and phosphate solubilizing bacteria, were average. In order to increase the organic carbon level; and the availability of phosphor and nitrogen, organic matter amendment is needed.

Abstract

The Development Plan of Sibisa Lake Toba Tourism Area as The National Strategic Area for Tourism by performing a land conversion on protected forests and communal lands had stirred up a problem dilemma regarding the resistance from indigenous people around Toba Lake. It is crucial to be questioned, whether the conversion policy of protected forests and communal lands by the Indonesian Government to develop Sibisa Danau Toba Tourism Area is in accordance with related laws and regulations? As the answer, it can be concluded that the mentioned policy opposes: Article 18b of the 1945 Constitution; Article 15 of the Law of 2009 Number 32 on Environmental Protection and Management; Presidential Regulation Number 81 of 2014 on The Spatial Planning of Lake Toba Area; The Law of 1999 Number 39 on Human Rights; The Law of 2016 Number 6 on Village Government, and lastly, the United Nation Declaration on Human Rights of Indigenous People (UNDHRIP).Telaah Kritis atas Kebijakan Hukum Pemerintah Indonesia terkait Alih Fungsi Hutan Lindung dan Tanah Ulayat Masyarakat Adat Batak di sekitar Danau Toba AbstrakRencana Pembangunan Kawasan Pariwisata Sibisa Danau Toba sebagai Kawasan Strategis Nasional Kepariwisataan dengan melakukan alih fungsi hutan lindung dan tanah ulayat telah menimbulkan permasalahan yang dilematis karena mendapat perlawanan dari masyarakat adat di sekitar Danau Toba. Terhadap kebijakan tersebut penting untuk dipertanyakan apakah kebijakan alih fungsi hutan dan tanah ulayat oleh Pemerintah Indonesia untuk pembangunan Kawasan Pariwisata Sibisa Danau Toba telah sesuai dengan peraturan perundang-undangan yang terkait? Abstract

Penyediaan lahan bagi pembangunan infrastruktur pertahanan keamanan dan jaringan jalan di kawasan perbatasan darat Indonesia – Malaysia di Kalimantan tidak dipungkiri akan melalui kawasan lindung telah didukung dengan legal policy Pemerintah dalam Perpres No.31 Tahun 2015, menjadi landasan hukum bagi instansi pemerintah yang membutuhkan tanah untuk penyelenggaraan kegiatan pembangunan infrastruktur hankam dan jaringan jalan yang dilaksanakan berdasarkan UU No.2 Tahun 2012. Pengambilalihan tanah pribadi untuk kegiatan kepentingan umum, bukan pedang bermata dua, karena penempatan aturan pengadaan tanah ke dalam UU sudah merefleksikan unsur “persetujuan” dari pemegang hak yang bersangkutan untuk melepaskan haknya atas tanah bagi kepentingan yang lebih besar dari sekedar kepentingan pribadi dijiwai oleh asas fungsi social hak atas tanah mengakibatkan berakhirnya hak atas tanah.

Abstract

This research aims to find out the state's obligation in organizing occupancy lost due to land destruction. The form of this research is normative juridical with a statute approach and case approach. The type of research used is descriptive research and the data used is secondary data which is then All data obtained is collected and analyzed normatively qualitative. The results showed that the impact of the loss of land was that the community lost their shelter. Shelter is a basic right of all citizens, especially those affected by the disaster. The state is responsible for the fulfillment of the basic rights of the community, namely organizing and providing housing / shelter that is feasible and safe from disasters.  If the state is absent then the state is violating the mandate of the Constitution and Pancasila.

Abstract

Agrarian disputes in Indonesia often face challenges in ensuring legal certainly, including the execution of Supreme Court Decision No. 109/PK/Pdt/2022 concerning the Dago Elos land dispute. This study aims to analyze the legal certainly of the execution involving the Muller family’s claim based on the colonial Eigendom Verponding system and the physical control of the land by local communities. Using a normative judicial approach and descriptive qualitative analysis, primary legal documents and legal literature were purposively selected as the main data sources. The study found significant barriers to execution due to local community resistance and conflicts between colonial and national agrarian systems. The main conclusion highlights challenges in implementing the principle of legal certainty, even though the old rights have been recognized. The novelty of this research lies in its analysis of the relationship between colonial and national regulations in agrarian disputes. This study recommends comprehensive agrarian law reform to prevent similar conflicts and strengthen public trust in the national legal system.
