Abstract

Abstract: In the Qur’an, the issue of polygamy is only mentioned in verses 3 and verse 129. In verse 3 talks about the permissibility of polygamy, in verse 129 it talks about the difficulty and inability of a husband to do justice to wives. This means that the permissibility of polygamy is bound by strict conditions which means if the condition is not met, then polygamy should not be done. In the perspective of ushul fiqh to be reviewed is the polygamy verse which includes amr shigat and its legal implications and ta’arud al-adillah in the polygamy verse related to fair terms for polygamy perpetrators against his wives. The three editors used in the Qur’an are the orders of marrying women -women are considered good, so scholars differ when giving the meaning of the verse. Some say a maximum of 4, there are 8, there is also a limit of 16. Furthermore scholars also differed whether the rukhsah one, or more than one. In this case, the author is more likely to say that polygamy is rukhsah, while his azimah remains one. Polygamy is permissible if the situation requires polygamy, but if with monogamy there is no problem, then monogamy is better.

Abstract

The obligation of a husband to his wife in the book 'Uqudulujjain is mu'asyarah When women get higher education, divorce is more prevalent. This is a problem that must be resolved. In addition, students at Islamic boarding schools are known for their obedience to their husbands compared to those who do not study at Islamic boarding schools. The assumption is because there is an influence from family coaching education in the book `Uqud al-Lujjain fi bayani huquqi zaujain which is taught in the pesantren. The focus of the study is how the substance and moral message about the rights and obligations of husband and wife contained in the book so that it can equip muslim women as wives in fostering families well. This research is a library research with descriptive-analytical method with a normative-philosophical approach. The results showed that the wife's right to her husband was the right to get good treatment, get teachings from the husband, get protection from the husband, and get proper food and clothing. While the wife's obligation to her husband is to obey his orders as long as he does not violate God's rules, safeguarding the husband's wealth, respecting the husband's family, and dressing to look beautiful according to the husband

Abstract

This study explains in detail the question of fair meaning in polygamy marriages. So far, the meaning of fair is always different from everyone. Therefore, there is a need for a comprehensive study to decipher the issue of the meaning of scientific fairness. Substantive justice in Islam is always associated with the maker of the syara' (Allah). In relation to polygamy, The fair is a condition for a man to be allowed to do polygamy. justice aspects in polygamy is not an easy thing to do. Islam does not forbid or encourage let alone rule polygamy, this is because polygamy is a behavior that has existed since the time of ignorance and then tightened requirements in Islam. Islam is very strict in giving conditions until it is almost said not to be, because the argument contained in the Al Qur'an, maybe on fair terms but followed by another verse which says that "will not be able to act justly despite trying as much as possible" Although in the end the scholars agreed that it was fair qualitatively humans will not be able to, so ,in the end the scholars agree that what is meant is the minimum limit that can be done to do justice, namely turn time, income and shelter

Abstract

Ledakan jumlah penduduk yang tidak terkontrol akan menimbulkan beragam persoalan, baik dari segi sosial, ekonomi, politik hinga persoalan keamanan. Oleh karenanya dalam rangka menekan jumlah penduduk pemerinatah pemerintah menbuat program keluarga berencana untuk mewujudkan keluarga yang bahagia dan sejahtera. Salah satu varian program kelurga bencana adalah kontrasepsi vasktomi. Vasektomi adalah melakukan tindakan mengikat atau memotong saluran spermatozoid yang berasal dari testis, sehingga semen (air mani) tidak lagi  mengandung spermatozoid (sel kelamin pria). Untuk mengetahui hukum vasektomi dalam perspektif maslahah mursalah secara lengkap dan detail dengan memperhatikan beberapa aspek, antara lain: Manfaat kontrasepsi vasektomi, Mudharat kontarasepsi vasektomi, Motif melakukan kontarasepsi vasektomi, Teknik operasi vasektomi. Setelah melakukan penelitian yang mendalam tentang mudhorot dari kontrasepsi dikota bengkulu, peneliti mendapatkan kesimpulan bahwa vasektomi tidak memiliki efek yang bersifat merugikan. Kata Kunci: Kontrasepsi, Vasektomi, Maslahaha Mursalah.
