Abstract

This study aims to find out and examine licensing for the adaptation of the Bian Thiong Tjan Cultural Heritage Building in the city of Yogyakarta as well as to assess the background of permits granted even though the adaptation of buildings is contrary to the basic principles of preservation of Cultural Heritage Buildings. The results of the study were permits for the adaptation of the Bian Thiong Tjan Cultural Heritage Building in the city of Yogyakarta, not a permit to adapt but to apply for a building permit to establish a new building in the form of a hotel.

Abstract

 Pandowan Village is one of the most populous villages located in Galur District, Kulon Progo, Yogyakarta. This village is a village that has various potentials ranging from nature, society to very interesting arts. This is evidenced by the existence of 8 art activities that are divided into each village, and the event of Reog Pandu Budaya (Ramayana Story) was held in this Pandowan Village. In addition, Pandowan Village also has extensive agricultural land and is fed by rivers for irrigation of the rice fields, however, the existence of parties carrying out MCK in the river will eventually pollute the river and of course have a bad impact on the health of the community around Pandowan Village. Thus, the writing of this KKN Journal Papers discusses these 2 topics. The data collection method used is literature study and the data collection process is through websites, journals, previous reports and carried out online. Our observations show that Pandowan Village has a lot of excellent potential and deserves to be developed. KKN is a place for students to develop their competencies and as a place to contribute to the surrounding community.

Abstract

This research aims to obtain an overview of ultra petita decisions in corruption cases from a law enforcement perspective. The method used in this research is a normative legal research method, using a case approach. The research was conducted by analyzing the views of several judges regarding ultra petita decisions in corruption cases. The research results show that judges in handling corruption cases refer to regulations from the Supreme Court. In accordance with these guidelines, judges use comprehensive considerations in making decisions. According to the judge in the ultra petita decision against a convict in a corruption case, something like this could have happened because of the public prosecutor's error in making charges. Some judges are of the view that when deciding cases, including corruption cases, the judge must consider all the facts in the trial as well as various things that give the judge confidence. Judges view that they are not bound by the prosecutor's demands alone, but rather by the indictment, the facts of the trial, truth and justice.

Abstract

This research departs from the author’s observation that Indonesian government officials are currently very wary and worried being criminally charged for corruption and at the same time brought before the administrative court for abuse of power. The main question here is whether the possibility of being brought before the Administrative Court may or may not have positive effect. The main finding, using a legal normative approach, is that the final decision on the issue, whether there is abuse of power or not, as decided by the Administrative Court, would be important in proving disproving, the corruption charge brought before the criminal court.

Abstract

This research aims to identify the licensing authority over architectural works and modification of designated Cultural Heritages. In addition, this research examines the antinomy of legal concepts, including the antinomy of the legal concept of a licensing authority, the antinomy of the legal concept of modification of creation, and the antinomy of the legal concept of cultural heritage. With normative research, this study reveals that there is no legal certainty, between the local and central government, concerning licensing authority to cultural heritage building adaptation. There is no such a unitary system or firm and clear SOPs, which has resulted in the demolition and destruction of cultural heritage buildings. There are differences of opinion regarding the authority to permit the alteration of architectural works of cultural heritage buildings that have been stipulated. Permits for the restoration of cultural heritage buildings are obtained not through a building permit but through BPPM DIY (Licensing and Investment Service). These permits include restoration permits, adaptation permits, and development permits, especially for revitalization and utilization. There is no balance between moral and economic rights of the owner of the cultural heritage building. The preservation is more likely to emphasize moral rights but still overlooking the economic rights of the creator/owner.Keywords: licensing authority, architectural work, adaptation, cultural heritage building. Konsep Otoritas Perizinan Modifikasi Karya Arsitektur Bangunan Cagar Budaya AbstrakPenelitian ini bertujuan untuk mengidentifikasi kewenangan perizinan atas karya arsitektur dan modifikasi Cagar Budaya yang ditetapkan. Selain itu, penelitian ini mengkaji antinomi konsep hukum, antara lain antinomi konsep hukum otoritas perizinan, antinomi konsep hukum modifikasi ciptaan, dan antinomi konsep hukum warisan budaya. Dengan kajian normatif, kajian ini mengungkapkan bahwa belum ada kepastian hukum, antara pemerintah daerah dan pusat, mengenai kewenangan perizinan terhadap adaptasi bangunan cagar budaya. Tidak ada sistem kesatuan atau SOP yang tegas dan jelas sehingga mengakibatkan pembongkaran dan perusakan bangunan cagar budaya. Terdapat perbedaan pendapat mengenai kewenangan izin perubahan karya arsitektur bangunan cagar budaya yang telah ditetapkan. Izin pemugaran bangunan cagar budaya diperoleh bukan melalui izin mendirikan bangunan melainkan melalui BPPM DIY (Dinas Perizinan dan Penanaman Modal). Izin tersebut meliputi izin restorasi, izin adaptasi, dan izin pembangunan, terutama untuk revitalisasi dan pemanfaatan. Tidak ada keseimbangan antara hak moral dan ekonomi pemilik bangunan cagar budaya. Pelestarian tersebut lebih cenderung mengedepankan hak moral namun tetap mengabaikan hak ekonomi pencipta/pemilik.Kata Kunci: perizinan, karya arsitektur, adaptasi, bangunan cagar budaya.

Abstract

The aim of this research is to analyze the effectiveness of the threat of criminal fines in amendments to the Law on Minerals and Coal. One of the things that stands out in the amendments to the Law on Mineral and Coal is the change in the threat of criminal sanctions against perpetrators of mining without a permit, from the original threat of a maximum prison sentence of 10 years to 5 years, and a maximum fine of 10 billion rupiah to 100 billion rupiah. This article examines these arrangements. In this paper, doctrinal research and comparison of a number of judicial decisions is carried out. From research it is known that there are many decisions that impose light fines and there are also some decisions that impose very heavy fines but are accompanied by very light substitute imprisonment. From a number of existing decisions it can be seen that setting the threat of such high criminal fines in law does not guarantee effectiveness in law enforcement. Under these conditions, the objectives of punishment cannot be achieved properly. There are a number of alternatives to solve this problem.
