Abstract

The number of corruption cases that occur in Indonesia is not sufficiently countered by repressive means. Preventive measures must also be synergized. The most appropriate effort is to instill anti-corruption values ​​in the younger generation, including high school students. The existence of the Student Council (OSIS) at SMA Negeri 2 Kota Tanjungpinang has an important role in grounding and implementing these values ​​in the school environment. This service was carried out by using the methods of lecturing, discussion, and brainstorming. The results show that the activity has succeeded in achieving its stated goals. This was evidenced by the enthusiasm and high response from the participants. In addition, OSIS SMA Negeri 2 Kota Tanjungpinang has been agreed to become an anti-corruption based OSIS. As astep first, the programs initiated in the discussion session were determined as part of the OSIS work program for SMA Negeri 2 Kota Tanjungpinang.

Abstract

This brief writing tried to challenge the old thinking that led everyone to the Raja Ali Haji figure as a literary and cultured man in the 19th century of the Malay Kingdom of Riau-Lingga. Whereas he was a multidisciplinary of science, who also included the politics, government, and constitutional law. His expertise on that subject was inseparably based on his experience as a kingdom adviser. As well as two books that specifically containing a law thought that are Muqaddimah fi Intizam and Tsamarat Al-Muhimmah. This study uses a normative juridical approach with the quality of research is analytic descriptive. The studies explain that: First, the legitimacy of Raja Ali Haji as a jurist, among other things: Gurindam Dua Belas is not a mere literacy work, it also includes the idea of contitutional law; the kingdom adviser; and review of his books. Second¸the general principles that are included in Muqaddima fi-Intizam and Tsamarat al-Muhimmah include the principle of consensus, the principle of prudence, the principle of juctice, the principle of unfairness, the principle of professionality, the principle of accountability, the principle of legality, the principle of public interest, and the principle of not mixing authority.

Abstract

This research attempts to analyze the implementation of the Pancasila ideology amid current digitalization. One of the markers of this digital era is the erosion of space and national boundaries for every citizen. Indonesia's large population can be a strength or weakness of the Pancasila ideology. For this reason, systematic steps are needed to make the values of Pancasila remain as a way of life for the Indonesian. This type of research is normative research that uses literature as a primary data source. The presentation of the data is conveyed by a qualitative descriptive method. The conclusion of this study is the need to strengthen Pancasila ideology in the digital era through efforts to reaffirm the fundamental values of Pancasila to society in general and the younger generation in particular. To ground the values of Pancasila, it is deemed necessary to involve millennial participation through digital influencer programs and the development of digital literacy based on Pancasila values and the doctrine of national values.

Abstract

The stagnation of discussions to accommodate independent presidential and vice-presidential candidates may be because an appropriate pattern of implementation has not been found. Therefore, it is important to learn from best practices in other countries. From this comparison, it is hoped that this will be the basis for the idea of implementing it in Indonesia. To discuss this, this paper uses a combination of statute approach, conceptual approach, and comparative approach. The results show, first, that the United States and Egypt are more flexible in managing the nominations for President and Vice President by implementing a multi-track system. Second, there are two implementation models that can be adopted, namely public support and nominations by state institutions. In the Indonesian context, both can be applied with some adjustments because in principle they have been practiced.

Abstract

In this article the author seeks to answer, within the context of the Indonesia state organizational system, why and how Indonesia should establish a single government authority entrusted with supervising the making of ministerial policy regulations or regional government regulations. To that purpose a comparison with other countries is conducted.  It is a fact in Indonesia that regulatory powers or function is shared by and among different ministries and by regional governments. The result of which is the problem of sectoral approach and the existence of numerous overlapping and conflicting regulations. To overcome this problem, in consideration of best practices in other countries, the author suggests the establishment of a single government agency entrusted with, inter alia, previewing ministerial or regional government draft regulations.

Abstract

Choosing ‘shortcuts’ is not always the best approach, especially when establishing national legal policy. For example, the establishment of Law No. 6 of 2023 on job creation (Job Creation Law) was intended to replace and eliminate the conditionally unconstitutional status of Law No. 11 of 2020 on job creation (Law No. 11 of 2020). The issue arises because the Job Creation Law was established through the issuance of government regulations instead of laws. This approach is more expedient than standard legislative amendments, but it reflects the government’s arrogance in the development of Indonesia’s law. Therefore, this article aims to analyse the establishment of the Job Creation Law, examine its justification based on a purported compelling exigency and explore its implications for national legal development in light of Constitutional Court Decision No. 91/PUU-XVIII/2020. Through a socio-legal inquiry, this study demonstrates that establishing Job Creation Law through a Perppu fails to meet the requirement of compelling exigency and undermines meaningful participation in improving Law No. 11 of 2020, as mandated by the Constitutional Court. The findings further suggest that the enactment of the Job Creation Law reflects an authoritarian approach to national law development, with its substance leaning towards orthodox law development.

Abstract

Fakta banyaknya Perda bermasalah telah membawa diskursus hingga ke arah upaya penataan kembali kelembagaan yang menangani pengharmonisasian Perda melalui lembaga khusus regulasi. Sebagai salah satu konsekuensinya, kehadiran lembaga ini menggeser kewenangan Biro Hukum masing-masing level pemerintahan daerah sebagai leader dalam pengharmonisasian Perda. Penulisan ini bertujuan untuk membahas bagaimana diskursus hukum yang terjadi atas pergeseran kelembagaan dalam pengharmonisasian Perda dan solusi alternatif apa yang dapat ditawarkan untuk menyelesaikan diskursus tersebut. Untuk menjawab pertanyaan tersebut, tulisan ini akan menggunakan metode penelitian hukum normatif dengan memadukan pendekatan perundang-undangan, pendekatan perbandingan, dan pendekatan konseptual. Adapun hasil kajian ini menunjukkan adanya dikotomi pandangan terhadap eksistensi lembaga khusus regulasi dalam proses pembentukan Perda. Oleh karena itu, diperlukan skema pengharmonisasian Perda yang mengakomodir keterlibatan Biro Hukum Pemda di masing-masing level pemerintahan. Tujuannya agar peran vital Biro Hukum Pemda tidak benar-benar hilang dan justru disinergikan dengan peran lembaga khusus regulasi dalam membentuk Perda yang berkualitas.

Abstract

In practice, Ombudsprudence is a collection of jurisprudence that highlights the success stories of recommendations issued by the Ombudsman. Consequently, the law's desired consistency and unity in handling maladministration cannot be effectively realized. The Ombudsprudence did not encourage the Ombudsman to consider previous recommendations in similar cases. This was a factor in the failure to achieve the ethics, fairness, and propriety recommended by the Ombudsman. This article aims to critique the adoption of Ombudsprudence in Indonesia. In addition, it seeks to purify the concept of Ombudsprudence to make it a tool for realising ombudsnorm and good administrative norms in public services. This article employs a non-doctrinal approach by collecting data through literature studies and interviews. The findings indicate that Ombudsprudence has been misinterpreted as merely a success story in case handling by the Ombudsman, which deviates from the basic idea and original concept in the Netherlands. In fact, the Ombudsman has established non-legal norms; however, misconceptions have led to its neglect as an ombudsman norm. Therefore, it is necessary to purify the concept by examining the indicators proposed by Langbroek and Rijpkema, so that Ombudsprudence aims to establish ombudsnorms in the form of norms of propriety produced by the Ombudsman, directed at creating good administrative norms as standards for exemplary public service in Indonesia. Ombudsprudensi dalam praktiknya merupakan kumpulan yurisprudensi yang menyoroti kisah sukses rekomendasi yang dikeluarkan oleh Ombudsman. Akibatnya, konsistensi dan kesatuan hukum yang diharapkan dalam menangani maladministrasi tidak dapat terwujud secara efektif. Ombudsprudensi tidak mendorong Ombudsman untuk mempertimbangkan rekomendasi sebelumnya dalam kasus serupa. Hal ini menjadi faktor kegagalan dalam mencapai etika, keadilan, dan kepatutan yang direkomendasikan oleh Ombudsman. Artikel ini bertujuan untuk mengkritisi penerapan Ombudsprudensi di Indonesia. Selain itu, artikel ini juga berupaya untuk memurnikan konsep Ombudsprudensi agar dapat menjadi alat untuk mewujudkan 'ombudsnorm' dan norma administrasi yang baik dalam pelayanan publik. Artikel ini menggunakan pendekatan non-doktrinal dengan mengumpulkan data melalui studi pustaka dan wawancara. Hasil penelitian menunjukkan bahwa Ombudsprudensi telah disalahartikan hanya sebagai kisah sukses dalam penanganan perkara oleh Ombudsman, yang menyimpang dari gagasan dasar dan konsep awal tentang Ombudsprudence di Belanda. Faktanya, Ombudsman telah menetapkan norma-norma non-hukum dan kesalahpahaman tersebut telah menyebabkan Ombudsprudensi diabaikan sebagai norma Ombudsman. Oleh karena itu, perlu dilakukan pemurnian konsep tersebut dengan mengkaji indikator-indikator yang diajukan oleh Langbroek dan Rijpkema, sehingga Ombudsprudensi bertujuan untuk menetapkan norma-norma Ombudsman yang berisi norma-norma kepatutan dan diarahkan untuk menciptakan norma-norma administrasi yang baik sebagai standar pelayanan publik yang patut dicontoh di Indonesia.
