Abstract

Clinical Legal Education is an interesting subject to be developed at the Faculty of Legal, Universitas Udayana. Unlike other subjects, clinical legal education participants get an education in the classroom and go directly to the field (community) to increase students' knowledge and practical abilities in solving problems in society. The purpose of writing this journal is to find out how the form of clinical education-based learning, especially in the form of Street Legal Clinic at the Faculty of Law, Universitas Udayana, and to find a model for developing learning methods based on clinical legal education in the form of street legal clinic that can answer legal problems that develop in society. More optimally, the author uses normative legal research methods with the statutory approach and conceptual approach. The results showed that the form of the clinical legal education which is implemented at the Faculty of Law of Universitas Udayana consisted of three stages of the process, namely the planning component, the experiential component, and the reflection component with the learning models that had been used so far, namely In House Clinic, Out House Clinic, Combination and Street Legal Clinic. The development model suggested in implementing the Street Legal Clinic is to be more optimal in answering problems in the community, namely by accommodating several stages in its implementation, namely the pre-implementation, implementation, and evaluation stages into a single unit that is packaged creatively and comprehensively in collaboration with Clinical Partners.

Abstract

This study aims to examine whether the current industrial relations court procedural law system is sufficiently ideal as a reference for the settlement of industrial relations disputes in Indonesia and to test the urgency of regulating independent procedural law in the Court of Indonesian Industrial Relations. This is a normative legal research with a statutory approach, a conceptual approach and comparative approach. The result shows that the industrial relation court procedural law system is not ideal enough to accommodate the development and complexity of disputes that occur in Indonesian labor today. Simple, quick and inexpensive way of settling dispute is difficult to occur when the procedural law that is enforced still adopts or is unable to escape from HIR, RBg, RV as civil procedural law (colonial product), which has a general character. The Industrial Relations Court as one of the Special Courts must be able to show its independent character, including in regulating procedural law. Comparative studies with the state of Thailand, Malaysia and Japan are used in this paper in order to illustrate the importance of the regulation concerning the Industrial Relations Court procedures. Changes to the procedural law of the Industrial Relation Court are urgent to do in order to provide an effective and efficient means of dispute resolution that is able to represent simple, quick and inexpensive principles according to the needs or demands of workers and employers today

Abstract

Tujuan Studi ini adalah untuk mempelajari dan mendalami pemahaman apakah pamer harta merupakan pelanggaran disiplin PNS berdasarkan PP Nomor 94 Tahun 2021 dan bagaimana penerapan PP Nomor 94 Tahun 2021 terhadap fenomena pamer harta PNS. Penelitian ini merupakan hukum normatif yang dimana fokus utamanya adalah untuk menganalisis ketentuan hukum positif yang berlaku, khususnya mengenai kewajiban disiplin PNS sebagaimana diatur dalam PP 94 Tahun 2021. Pendekatan Perundang-undangan (statue approach) digunakan untuk menelaah apakah tindakan flexing oleh PNS di media sosial dapat dikategorikan sebagai bentuk pelanggaran disiplin. Penelitian ini mengkaji norma hukum dengan cara menganalisis peraturan perundang-undangan, asas hukum dan prinsip yang seharusnya pada seorang ASN. Kewajiban PNS telah diatur di dalam PP Nomor 94 Tahun 2021 Tentang Disiplin PNS bahwa PNS harus "Menunjukkan integritas dan keteladanan dalam sikap, perilaku, ucapan, dan tindakan kepada setiap orang, baik di dalam maupun di luar kedinasan”. Pamer harta kekayaan adalah hal ini tidak selasar dengan gaya hidup yang sederhana karena sederhana tidak mengenal istilah pamer, pamer yang dimaksud tindakan yang menunjukan sesuatu dengan tujuan mendapatkan pengakuan dan hal tersebut berlawanan dengan nilai-nilai yang seharusnya dimiliki seorang aparat.  The purpose of this study is to examine and explore whether flaunting wealth constitutes a violation of civil servant discipline based on Government Regulation No. 94 of 2021 and how Government Regulation No. 94 of 2021 applies to the phenomenon of civil servants flaunting their wealth. This study is a normative law whose main focus is to analyze applicable positive legal provisions, particularly regarding civil servant disciplinary obligations as stipulated in Government Regulation No. 94 of 2021. The statutory approach is used to examine whether flexing by civil servants on social media can be categorized as a disciplinary offense. This study examines legal norms by analyzing legislation, legal principles, and the principles that should apply to civil servants The obligations of civil servants are regulated in Government Regulation No. 94 of 2021 concerning Civil Servant Discipline, which states that civil servants must “demonstrate integrity and exemplary conduct in their attitude, behavior, speech, and actions towards everyone, both inside and outside of work”. Flaunting wealth is not in line with a simple lifestyle because simplicity does not involve showing off. Showing off refers to actions that display something with the aim of gaining recognition, and this is contrary to the values that an official should have.
