Abstract

Instagram platform is used as a media of promoting alcoholic beverages because of its low cost and rapid dissemination of information. However, uploading alcoholic beverage content is against the law because alcoholic beverages cannot be promoted in the mass media, including social media. This study aims to determine how the platform has responsibilities. This research was conducted using a normative juridical approach, that the research was conducted by conducting research through the literature as the main research material. Based on the research conducted, it was found that the legal liability of the Electronic System Operator for the Private Scope of the Instagram Platform is very limited if there is an upload of content that violates the provisions, so that sanctions that can be imposed to suppress the upload of illegal content must be applied to business actors as users of the electronic system.

Abstract

AbstrakDengan berkembangnya sistem bisnis e-commerce di Indonesia diperlukan berbagai peraturan dan regulasi untuk menghadirkan  aturan main yang jelas dan memberikan kepastian hukum kepada para pelaku usaha bisnis e-commerce di Indonesia. Pada tahun 2014, Pemerintah Republik Indonesia telah mengeluarkan peraturan Perundang-undangan yang mengatur bisnis e-commerce di Indonesia dengan terbitnya Undang - undang No. 7 Tahun 2014 tentang Perdagangan. Peraturan ini dijadikan dasar hukum penyelenggara Perdagangan Melalui Sistem Elektronik (PMSE) dan konsumen dalam kegiatan perdagangan via sistem elektronik. Undang - undang No. 7 Tahun 2014 mendefinisikan PMSE sebagai perdagangan yang transaksinya dilakukan dengan serangkaian perangkat atau prosedur elektronik. Dalam hal ini yang termasuk dalam PMSE adalah pedagang/merchant dan PPSE (Penyelenggara Perdagangan Secara Elektronik) seperti penyelenggara komunikasi elektronik, iklan elektronik, penyelenggara sistem aplikasi transaksi elektronik, penyelenggara sistem aplikasi transaksi elektronik, penyelenggara jasa aplikasi sistem pembayaran secara elektronik, serta penyelenggara jasa dan sistem aplikasi pengiriman barang yang secara keseluruhannya digunakan dalam transaksi perdagangan secara elektronik. Kata kunci : bisnis, e commerce, konsumen, perdagangan, transaksi. AbstractThe development of e-commerce business system in Indonesia required a variety of rules and regulations to present clear rules and provide legal certainty to businesses e-commerce in Indonesia. In 2014, the Government of the Republic of Indonesia has issued a regulation legislation governing e-commerce business in Indonesia with the publication of Law - Law No. 7 Year 2014 regarding Trade. This regulation is used as the legal basis organizer Trading Through Electronic Systems (PMSE) and consumers in trading activity via an electronic system. Law - Law No. 7 of 2014 defines PMSE as trade transactions are conducted with a series of devices or electronic procedure. In this case that is included in PMSE is a trader / merchant and PPSE (Organizer Trading Electronically) as providers of electronic communication, electronic advertising, organizing systems for electronic commerce applications, organizer systems for electronic commerce applications, a service provider payment system applications electronically, as well as service providers delivery and application systems in total are used in electronic commerce transactions. Keywords: business, e commerce, consumer, trade, transaction.

Abstract

Rahasia Dagang merupakan suatu produk dari Hukum Kekayaan Intelektual (KI), memiliki kekhususan yang cukup tinggi berkaitan dengan informasi secara ekonomi dan bisnis, salah satu kaitannya yaitu dengan Perlindungan Data berlandaskan Hak Asasi Manusia yang menjadi hak secara universal , dalam hal ini ada kaitan antara Perlindungan Data pada Hukum Telekomunikasi. Dalam ketentuan umum Pasal 1 Undang-Undang Rahasia Dagang (Undang-Undang Nomor 30 Tahun 2000), menyebutkan bahwa Rahasia Dagang merupakan informasi yang tidak diketahui oleh umum dibidang teknologi dan/ atau bisnis, mempunyai nilai ekonomi karena berguna dalam kegiatan usaha, dan dijaga kerahasiaannya oleh pemilik Rahasia Dagang. Latar Belakang Penelitian ini terdapat dua permasalahan hukum, yaitu yang Pertama : Bagaimanakah Perlindungan Hukum Positif pada Jasa Telekomunikasi di Indonesia dan Kedua : Sejauhmana Perlindungan Hukum atas Informasi Data di Indonesia. Metode Penelitian yang dipakai yaitu kajian secara Yuridis Normatif, dimana metode ini menerangkan kajian berupa hukum positif di Indonesia. Dalam Penelitian ini juga berdasarkan kajian pada suatu perbandingan hukum yang berlandaskan pada pendekatan secara Yuridis Komparatif yaitu dengan melakukan perbandingan hukum baik secara nasional maupun internasional dengan ketentuan di negara-negara berkembang lainnya. Hasil Penelitian ini menunjukkan bahwa Informasi Data yang berkembang secara umum melalui Jasa Telekomunikasi merupakan suatu hal yang perlu dilindungi secara hukum, terkait dengan Pengertian Rahasia Dagang sebagai suatu kajian atas Informasi dan juga ada pada ketentuan Undang-Undang Dasar 1945 tentang Perlindungan Data di Indonesia, yang seyogyanya bahwa suatu Informasi milik seseorang harus dilindungi secara utuh berdasarkan kekuatan Hukum Positif di Indonesia. Kata Kunci : Rahasia Dagang, Informasi, Perlindungan Data dan Telekomunikasi.

Abstract

The Covid-19 pandemic has resulted in more people doing activities from home, so almost all activities are carried out online, including for educational activities. The problems on this research are how the comparison between fair use regulations in Indonesia and in the United States during the pre-Covid-19 pandemic? How the regulations of the doctrine of fair use to anticipate the occurrence of a new phenomenon regarding the use of copyright on digital platforms during and/or after the Covid-19 pandemic? The method used in writing this law is a normative juridical method. The results of the study conclude that Fair use rules in Indonesia already regulate that fair use will not harm the legitimate interests of creators but does not provide clear parameters regarding fair interests. While the Fair use Arrangements in the United States are regulated in 17 U.S. Code 107. In this regulation, there are 4 factors, namely: the purpose and character of the use, the nature of the copyrighted work, the quantity and importance of the material used, the effect of the use upon potential market or value of the copyrighted work. The Covid-19 pandemic gave rise to fair use cases that had never occurred before the outbreak of Covid-19, e.g. the case of The Internet Archive, it can be observed that there is an encouragement from the public to further relax copyright protection because of the Covid-19 pandemic resulting in the public interest having to be carried out rather than the creators and copyright holders.
