AbstrakIndonesia telah memiliki pengaturan mengenai transaksi elektronik sejak Pemerintah Indonesia menetapkan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) dan Peraturan Pemerintah Nomor 82 Tahun 2012 tentang Pelaksanaan Sistem dan Transaksi Elektronik (PP PSTE). Peraturan mengenai kegiatan transaksi elektronik tersebut dalam praktiknya masih banyak terjadi kesalahan penerapan. Penulisan artikel ini bertujuan untuk menggambarkan: (1) Konsep perlindungan konsumen yang diatur dalam UU ITE dan PP PSTE, dan (2) Penerapan dari konsep perlindungan konsumen dalam transaksi elekronik. Konsep perlindungan konsumen dalam transaksi elektronik harus didasarkan pada Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UU PK). Pemerintah Indonesia harus meningkatkan upaya dan dukungan dalam menerapkan peraturan-peraturan tersebut terhadap transaksi elektronik. Selain itu kerja sama para pihak pengguna atau pelaku transaksi elektronik sangat diperlukan untuk dapat mewujudkan kepastian hukum.Kata Kunci: transaksi elektronik, perlindungan konsumen, konsumen transaksi elektronik, UU ITE, pelaku usaha. However, regulation misconducts still take place in their implementation. The purpose of this article is to illustrate: (1) The concept of consumer protection in UU ITE and PP PSTE, and (2) The implementation of the regulations, specifically ones dedicated for consumers protection in eletronic transaction (e-consumers). The concept of consumers protection in electronic transaction should be based on Law Number 8 Year 1999 Concerning Consumer Protection (UU PK). Indonesian government needs to increase their effort and support to enforce said regulations in electronic transaction. ABSTRACTThe use of film works without the author's permission to make a lyric video that aims to promote songs by musicians is a phenomenon that often occurs in the music industry today. This study discusses the extent to which Law Number 28 of 2014 concerning Copyright provides protection in the use of cinematographic works and what legal actions are taken if there is use of cinematographic works without permission. behavior that is appropriate for humans is used as a material for review. The data used is secondary data in the form of an assessment of the literature and laws and regulations related to copyright. The results showed, protection of cinematographic works in Indonesia protects the moral and economic rights of the creator or copyright holder. resolution if there is unauthorized use can be reached through out-of-court dispute resolution, namely alternative dispute resolution and complaints to the Minister for copyrights that are in the digital realm. Data privacy that attached to every social media user has become a target of crime. One of the crime types that utilizes social media is doxing. Nowadays, the cases of doxing are increasing. There are still no specific and comprehensive normative rules that cover the data privacy protection to avoid doxing on social media. The fact makes the law enforcement still not optimal. This study is a descriptive study to answer some questions. Firstly, how to regulate doxing on social media based on the perspective of Indonesian law compared to the perspectives of other states in similar issue? Secondly, how the implementation of the right to be forgotten in doxing cases can optimize data privacy protection in Indonesia? This study used a normative juridical and case study approach. This study has resulted several results. Firstly, Indonesia needs special regulation for doxing on social media to protect the user data privacy. Secondly, the regulation of right to be forgotten should be reformulated and must be applied as a solution to doxing content. Doxing on social media regulation with the right to be forgotten can be further regulated through the legal regulation to provide a better data privacy protection.DOI: https://doi.org/10.22304/pjih.v9n1.a2

Teknologi pembayaran berkembang dengan pesat. Bank bukan lagi menjadi satu-satunya lembaga pembayaran yang ada. Merupakan financial technology, suatu inovasi dalam bidang finansial yang marak digunakan masyarakat terutama dikarenakan adanya gelombang revolusi industri 4.0. Salah satu bentuk financial technology yang digandrungi masyarakat dalam mencari dana adalah donation-based crowdfunding, yaitu suatu media pembayaran yang mengutamakan pengumpulan dana dari sejumlah banyak kontributor, digunakan untuk menggalang dana kemanusiaan. Namun, platform donation-based crowdfunding terutama yang berbasis sistem elektronik, memiliki kekurangan, di antaranya lemahnya pengaturannya di Indonesia, serta adanya penyelewengan dana terkumpul. Dalam penelitian ini dilakukan metode penelitian kualitatif dengan metode pendekatan yuridis normatif, berspesifikasi deskriptif analitis dan teknik pengumpulan data studi dokumen. Dengan adanya penelitian ini, instrumen hukum mengenai donation-based crowdfunding berbasis sistem elektronik dapat diketahui sehingga dapat ditelaah prosedur perizinan yang harus dimiliki platform serupa donation-based crowdfunding, meminimalisir terjadinya penyelewengan dana, serta agar masyarakat dapat lebih berhati-hati dalam menggunakan platform financial technology di Indonesia

ABSTRAK Pandemi COVID-19 berdampak pada aktivitas bisnis online yang semakin digemari oleh masyarakat, perkembangan bisnis online ini didukung oleh pemanfaatan teknologi informasi. Artificial Intelligence (AI) yang merupakan bagian dari teknologi informasi membantu pelaku usaha memfasilitasi komunikasi dengan konsumen, sehingga pemasaran dari produk yang mereka tawarkan dapat meningkat. AI yang dirancang dan digunakan untuk memudahkan pelaksanaan kegiatan manusia dibidang bisnis dapat membantu pengusaha mengolah setiap data dan informasi dari konsumen, sehingga memudahkan dalam pemetaan perilaku calon konsumen yang menjadi target pemasaran produk. Artikel ditulis dengan tujuan untuk menunjukkan urgensi regulasi yang mengatur AI di bidang bisnis, agar tidak menimbulkan penyalahgunaan terhadap data yang diambil dan diolah menggunakan AI, sehingga menimbulkan kerugian bagi pemilik data. Metode yang digunakan adalah yuridis empiris disertai pendekatan kualitatif. Data yang diteliti adalah data sekunder berupa tulisan-tulisan dari para ahli di bidang teknologi informasi dan ahli hukum, untuk melihat hubungan antara teknologi informasi di bidang bisnis. Hasil penelitian menunjukkan bahwa penggunaan AI harus diatur dan diawasi oleh badan khusus untuk memberikan perlindungan kepada pihak yang memanfaatkannya. Selain itu juga untuk memberikan batasan pertanggungjawaban atas penggunaan yang tidak sesuai dengan tujuan pembuatannya. Kata kunci: artificial intelligence; bisnis online; pengaturan. ABSTRACT The COVID-19 pandemic has an impact on online business activities that are increasingly favored by the public, which is supported by using information technology. Artificial Intelligence (AI) which is part of information technology helps businesses facilitate communication with consumers, which can increase their products marketing. AI that is designed and used to facilitate the human activities in business sectors can help businesses to update every data and information from consumers and making it easier to mapping the behavior of potential consumers. The aim of this article is to show the urgency of regulations governing AI in the business sector that cause misuse of data captured and processed by using AI. The method used is juridical empirical accompanied by a qualitative approach. The data studied are secondary data in the form of writings from experts in the field of information technology and from legal experts, to see how the relationship between information technology in business sector. The result shows that AI must be regulated and supervised by special body in order provide protection to its users. In addition, to provide limits on liability for use that is not in accordance with the purpose for which it was made. Keywords: artificial intelligence; online business; regulation.

This article aims to find out about the misuse of social media to commit criminal acts of fraud. The problem is focused on how to avoid online buying and selling scams. Data were collected through secondary data sources. This scientific article aims to determine the regulation of forms of fraud in online transactions, especially on Instagram media. This research uses primary, secondary and tertiary legal materials research methods. The analytical technique used is to use deductive thinking patterns, namely a way of thinking on basic principles. This study concludes that Based on the foregoing description, the conclusion is that legal arrangements regarding criminal acts of fraud are generally regulated in Article 378 of the Criminal Code, namely regarding acts of benefiting oneself or others by violating the law by using a false name or false dignity by deceit or by using false names. a series of lies that move other people to hand over something to him or to give debts or write off receivables is different from online fraud which is specifically regulated in article 28 paragraph (1) of Law Number 11 of 2008 concerning Electronic Information and Transactions as amended into Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE), namely the act of intentionally and without rights spreading false and misleading news that results in consumer losses in Electronic Transactions onic.

Perkembangan teknologi, informasi, dan komunikasi sudah tidak dapat dipungkiri kembali. Kini teknologi sudah terus berkembang sehingga menjadikannya bagian dari kehidupan sehari-hari. Salah satu bentuk perkembangan teknologi terkni adalah hadirnya Metaverse di tengah-tengah masyarakat. Merek-merek terkenal dan ternama pun kini berlomba-lomba memasuki dunia Metaverse untuk memasarkan produknya. Sayangnya, pelanggaran merek terkenal masih marak terjadi tidak di dunia nyata namun di dunia siber pun dialami oleh merek terkenal. Umumnya pelanggaran yang terjadi bersifat merusak reputasi merek terkenal di mata masyarakat, di mana hal ini tercerminkan melalui kasus Nike v StockX. Penelitian ini bertujuan untuk mengetahui perbandingan hukum merek Indonesia dan Amerika Serikat atas perlindungan sebuah merek terkenal di Metaverse beserta sanksi hukum yang dapat diberikan kepada pihak yang menggunakan merek terkenal tanpa izin dalam Metaverse. Metode penelitian yang digunakan dalam penelitian ini adalah Metode Yuridis Normatif yang dimana peneliti akan mengutip data yang bersifat sekunder seperti peraturan perundang-undangan, jurnal ilmiah, dan buku-buku hukum. Hasil penelitian menunjukkan adanya perbedaan antara perlindungan merek terkenal di Indonesia dan Amerika Serikat di mana Indonesia belum secara eksplisit dan menyeluruh memberikan perlindungan terhadap merek terkenal layaknya Amerika Serikat yang sudah memberikan perlindungan eksplisit dan menyeluruh terhadap merek terkenal.

Personal data leaks have become one of the major issues in cybercrime. The government has attempted to overcome this issue by implementing Law on Personal Data Protection (UU PDP) and establishing law enforcement agencies for Personal Data Protection. Despite the existence of laws that regulate and agencies responsible for this issue, personal data leaks still occur frequently. One of the cases was the leak of customer data from Bank Syariah Indonesia (BSI). This study analyzes the assurance of privacy rights concerning data managed by Big Data Controllers under the Personal Data Protection Law and identifies legal actions that victims of data hacking due to the data controller’s negligence regarding the Big Data security systems. This research uses normative juridical methods with a descriptive-analytical approach. The results of the research show that Indonesia has regulations to protect the privacy rights of its citizens, specifically in the Personal Data Protection Law which regulates actions and restoration of the right to privacy if data leaks occur by the limitations of this article.

The basis of electronic transaction is the free will from everyone who bind himself to others, without coercion from any party, and without the necessity to meet directly. This requires regulations other than the existing law as guidelines for the perpetrators. The agreement is made under lex Informatica, particularly the rules made and agreed upon by the parties in electronic transaction. This article is written to discuss the use of lex Informatica concerning the self-regulation approach carried out along with its examples of electronic transaction in Indonesia. The focus of the discussing is about the benefits of using lex Informatica in electronic transaction and the relation between lex Informatica and self-regulation as theory and approacch in electronic transaction. This study using juridical normative research methods, and descriptive-analytical specifications, through library research and field studies. The results obtained indicate that lex Informatica as a fondation law in internet can underlying an agreement between the parties regarding matters that are not regulated in statutory regulations and self-regulation relating to lex Informatica can be as a regulatory model that provides an opportunity for parties to regulates electronic transaction activities.
