Abstract

Penelitian ini bertujuan untuk menganalisis tentang perkembangan hukum mengenai build operat and transfer (BOT) terkait tahapan dalam proses pembuatan perjanjiannya dan peranan Notaris dalam pembuatan Akta BOT. Jenis penelitian ini adalah penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan. Sumber bahan hukum yang digunakan terdiri dari bahan hukum primer dan sukunder. Mengenai tehnik penggumpulan bahan hukum menggunakan tehnik bola salju dan metode analisis yang digunakan adalah analisis deskriptif. Hasil dari penelitian ini adalah bahwa dalam pembuatan perjanjian BOT antara pihak Badan Usaha Milik Negara (BUMN) dengan pihak swasta harus melalui beberapa tahap, yakni tahap awal kontrak (prakontrak), tahap kontrak dan tahap selesai kontrak (pasca kontrak). Adapun peranan Notaris pada pembuatan perjanjian BOT adalah sebagai pihak yang ditengah atau netral untuk memberikan saran kepada pihak untuk menuangkan keinginannya dalam bentuk perjanjian. This study aims to analyze the legal developments regarding the making of build operat and transfer (BOT) in the stages of making the agreement and the notary business in making it. This type of research is a normative juridical research using a statutory approach. The resource of legal material is used consists of primary and secondary legal materials. The technique of collecting legal materials using snowball techniques and the analytical method used is descriptive analysis. The results of this research are: first, in making BOT agreements between State-Owned Enterprises (BUMN) and the private sector, it must go through several stages, the initial stage of the contract (pre-contract), the contract stage and the contract completion stage (post-contract). The role of the notary in making the BOT agreement is as a middle or neutral party to provide suggestions to parties to express their wishes in the form of an agreement.

Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui implementasi pembinaan Narapidana yang dijatuhi pidana penjara 3 bulan sampai dengan 1 tahun (Narapidana golongan B.IIA) dan kendala apa saja yang dihadapi selama proses pembinaan pada diri Narapidana. Penelitian ini merupakan penelitian deskriptif kualitatif dengan menggunakan metode penelitian hukum empiris. Penelitian berlokasi di Lembaga Pemasyarakatan Kelas IIB Karangasem. Sumber data adalah data primer dan sekunder. Data primer diperoleh dari hasil wawancara dan kuesioner dengan responden, dan data sekunder diperoleh dari buku-buku, literatur, perundang-undangan dan berbagai dokumen tentang pemasyarakatan. Hasil penelitian menunjukkan bahwa implementasi pembinaan bagi Narapidana golongan B.IIA yang menjalani pidana penjara singkat dibagi menjadi pembinaan kemandirian dan keterampilan. Pembinaan kepribadian meliputi pembinaan agama dan rohani, sementara pembinaan kemandirian meliputi pelatihan kerajinan tangan, bengkel las, dan reparasi alat-alat elektronika. Pidana penjara singkat yang dijalani Narapidana golongan BIIA tidak menimbulkan kendala terhadap diri Narapidana itu sendiri, walaupun dengan waktu yang singkat namun pembinaan dirasa memberi banyak manfaat ssehingga ketika keluar dari LAPAS Narapidana dapat hidup mandiri dengan skill yang diperoleh. Namun, yang menjadi hambatan adalah terbatasnya waktu pembinaan dikarenakan kebijakan Covid-19. Kata kunci : Narapidana, Pembinaan, Pidana Singkat ABSTRACT This study aims at determining the implementation of inmates development for those sentenced for three months to one year (prisoners of class B.IIA) of imprisonment and knowing the obstacles faced during the development period. It is a qualitative descriptive study with an empirical legal approach. The study was carried out in the Class IIB Karangasem Penitentiary. The sources of the data were primary and secondary data. The primary data were obtained from interviews and questionnaires with respondents, while secondary data obtained from books, literature, legislation and various documents on the correctional matter. The results showed that the implementation of inmates development program for prisoners of class B.IIA underwent a short imprisonment period divided into independence and skill development coaching. The skill development coaching included religious and spiritual development, while the independence development included handicraft, welding, and electronic appliances reparation training. The short imprisonment period did not impact the prisoners of class B.II A negatively. The short period of development benefited the prisoners to live independently after leaving the Penitentiary with the skills they acquired. The obstacle faced was the limited development time due to the Covid-19 policy. Keywords : Prisoner, Development, Short Imprisonment

Abstract

ABSTRAK Tujuan studi ini untuk mengetahui bagaimanakah ketentuan mengenai iddah berdasarkan hukum islam dan bagaimanakah masa iddah bagi wanita karir yang ditinggal meninggal suamianya. Studi ini menggunakan metode penelitian hukum normatif yaitu penelitian hukum melalui metode pendekatan perundang-undangan hukum syariat islam, serta buku, jurnal, makalah dan pendapat ahli. Hasil penelitian menunjukkan bahwa pada selama masa iddah, perempuan yang ditinggal karena perceraian atau kematian suaminya tidak diperbolehkan meninggalkan rumah atau menikah lagi. Hukum iddah juga berlaku bagi wanita karir yang bercerai dengan suaminya, bercerai karena cerai atau meninggal dunia, kecuali dalam keadaan darurat atau darurat (kebutuhan darurat). Di zaman modern ini, setelah seorang perempuan ditinggalkan oleh suaminya, ia harus mencari nafkah untuk memenuhi kebutuhan keluarganya. Karena ia harus menyelesaikan aktivitas pekerjaan, perempuan tersebut boleh keluar rumah, dan ada keadaan darurat yang mengharuskan perempuan tersebut meninggalkan rumah. Kata kunci : Iddah, Wanita Karir, Ditinggal Meninggal ABSTRACT The purpose of this study is to find out what are the provisions regarding iddah based on Islamic law and what is the iddah period for career women whose husbands die. This study uses a normative legal research method, namely legal research through the method of approaching Islamic law, as well as books, journals, papers and expert opinions. The results showed that during the iddah period, women who were abandoned due to divorce or the death of their husbands were not allowed to leave their homes or remarry. The iddah law also applies to career women who divorced their husbands, divorced due to divorce or passed away, except in emergencies or emergencies (emergency needs). In modern times, after a woman is abandoned by her husband, she has to earn a living to meet the needs of her family. Abstract

ABSTRAK Tujuan penulisan artikel ini yaitu untuk mengetahui kebijakan pemerintah terkait perlindungan pengupahan pekerja pada perusahaan terdampak Covid-19 di Indonesia dan untuk mengetahui akibat hukum pengusaha jika melakukan pemutusan hubungan kerja terhadap pekerjanya. Artikel ini menggunakan metode penelitian hukum normatif. Pendekatan yang digunakan dalam penelitian ini menggunakan pendekatan Peraturan Perundang-undangan dan pendekatan konsep. Kebijakan pemerintah terkait perlindungan pengupahan pekerja pada perusahaan terdampak Covid-19 di Indonesia yaitu melalui Kementerian Ketenagakerjaan Republik Indonesia mencetuskan suatu kebijakan saat berlangsung pada masa-masa pandemi Covid-19 yaitu dikeluarkannya Surat Edaran Nomor M/3/HK.04/III/2020 yang prinsipnya menjamin bahwa pekerja yang dikualifisir sebagai Orang Dalam Pengawasan (ODP) dan pekerja yang menjadi suspek Covid-19 maka upah pekerja tersebut harus tetap dibayarkan oleh pengusaha dengan menunjukan surat keterangan dokter serta apabila perusahaan terdampak Covid-19. Akibat hukum pengusaha jika melakukan pemutusan hubungan kerja terhadap pekerjanya yaitu pengusaha wajib memenuhi segala hak-hak dari seorang pekerja yang terkena pemutusan hubungan kerja yaitu memberikan Uang Pesangon, Uang Penghargaan Masa Kerja dan Uang Pengganti Hak sebagaimana diatur pada Pasal 81 angka 44 UU Cipta Kerja mengubah Pasal 156 ayat (1) UU Ketenagakerjaan, uang-uang tersebut sudah seharusnya diterima oleh pekerja berdasarkan lamanya masa kerja pekerja tersebut. ABSTRACT The purpose of this article is to find out government policies related to the protection of workers' wages in companies affected by Covid-19 in Indonesia and to find out the legal consequences of employers if they terminate their employment. This article uses a normative legal research method. The approach used in this study uses the Legislation approach and the concept approach. The government's policy regarding the protection of workers' wages at companies affected by Covid-19 in Indonesia, namely through the Ministry of Manpower of the Republic of Indonesia, initiated a policy during the Covid-19 pandemic, namely the issuance of Circular Letter Number M/3/HK.04/III/2020 which The principle guarantees that workers who are qualified as Persons Under Supervision (ODP) and workers who are suspected of Covid-19, the wages of these workers must still be paid by the employer by showing a doctor's certificate and if the company is affected by Covid-19. The legal consequences of an entrepreneur if he terminates his/her employment relationship, namely that the entrepreneur is obliged to fulfill all the rights of a worker affected by the termination of employment, namely providing severance pay, gratuity for tenure and compensation as regulated in Article 81 number 44 of the Employment Creation Law. Article 156 paragraph (1) of the Manpower Law states that the money should have been received by the worker based on the length of the worker's working period. Abstract

The notary's role is to provide legal protection to the people who use his services. The presence of a Notary is indispensable for the community concerned to hold a legal relationship with other individuals so that the Notary may also be liable. In the provisions of Article 16 paragraph (1) letter c of the Amendment Law, it is stipulated that in carrying out his position, the Notary is required to attach fingerprints on the minutes of the deed, giving rise to various polemics, because the said provisions do not stipulate further if in this case the smoker suffers from finger defects or events that result in damage to fingerprints which makes the investigator unable to put his fingerprint. The purpose of this research is to find out how the efforts that can be done by a notary against those who are unable to put fingerprints and the legal consequences of the absence of fingerprints against the strength of the deed. This research is a type of normative legal research. The results of this study indicate that efforts can be made by a notary if there are those who suffer from finger defects or experience events that cause fingerprint damage so that they cannot attach their fingerprints to the minutes of the deed, the relevant Notary can explain the matter at the end of the deed. he made it because the fingerprints attached to the address are an act that is required to a notary that can lead to administrative sanctions as contained in the Amendment Law. Due to the legal absence of fingerprints attached to the strength of the deed that is the deed made by the relevant Notary Public remains an authentic deed even though the fingerprints of the tappers are not attached based on Article 1869 of the Civil Code and the deed is valid and legally binding as long as the provisions contained in Article 1320 are fulfilled Civil Code.
