Abstract

The users of electronic service provider often suffered losses caused by internet services did not work properly including losses due to leakage of personal data protection stored in cloud computing.  The study aims to examine electronic service provider liability upon their failure performing internet services properly and security attacks on cloud computing. This study was normative legal research by examining national and international legal materials. The finding shows that the electronic provider shall be responsible based on right and obligation agreed under the agreement.  Related to cloud computing, providing adequate security to avoid security attacks and misuse of private data that caused losses to the users becoming the liability of service provider. Based on the Federal Trade Commission Act, the liability arises on the grounds of deceptive and unfair trade practices.  Under the General Data Protection Regulation of the European Union, the liability arises on the basis as the controller then provider liable for compensation for user’s suffered damage. In Indonesia, based on the Electronic Information and Transaction Law Amendment, the liability to the owner of personal data whose rights are violated and suffered losses arises due to a failure of ISP protect the data security. For better protection in Indonesia, the protection of big data and clear territorial scope of protection become necessary to consider.

Abstract

ABSTRACTPublic Service Entity „Badan Layanan Umum‟ which is governed in the Governmental Regulation concerning the Financial Management of the Public Service Entity refers to any government institution which gives services to the public in the forms of products and/or services but benefit is not the main objective. It does its activities based on the principles of efficiency and productivity. The objective is to improve the services provided to the public as an attempt to increase the public welfare and to sharpen the nation‟s life. Finance is flexibly managed based on the principles of economy, productivity, and the application of healthy business practice. In short, the Public Service Entity does what the government is supposed to do when undertaking its serving functions.Keywords: Public Services, Public Service Entity, and Government Function

Abstract

Setiap kali Badan Usaha Milik Negara (BUMN) yang berbentuk Perseroan Terbatas mengalami kerugian, maka organ perseroan, khususnya diarahkan kepada direksi akan dianggap telah memenuhi Pasal 2 ayat (1) Undang-Undang tentang Pemberantasan Tindak Pidana Korupsi. Dalam hukum perusahaan mengenal suatu doktrin imunitas yaitu Business Judgment Rule yaitu ajaran tentang tidak dapatnya dimintakan pertanggungjawabannya keputusan direksi oleh siapapun walaupun pada akhirnya keputusan tersebut berdampak pada ruginya perseroan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan undang-undang dan kasus. Hasil dari penelitian ini Manifestasi dari fiduciary duty di Indonesia dapat ditemukan dalam Pasal 97 ayat (2) serta mengenai Business Judgement Rule telah ditemukan dalam Pasal 97 ayat (5) Undang-Undang Nomor 40 Tahun 2007 Tentang Perseroan Terbatas. Salah satunya adalah terkandungnya prinsip Business Judgement Rule dalam Putusan Mahkamah Agung No. 130 PK/Pid.Sus/2013 dimana para pejabat PT. Bank Mandiri (Persero) Tbk. dapat menerapkan Business Judgement Rule karena adanya fiduciary duty yang telah dilakukan. Kata Kunci: Business Judgement Rule., Direksi Perseroan Terbatas.

Abstract

The development of tourism in Bali is growing rapidly so do not rule gave rise to an unlicensed tour guide or often called guide illegal, as the license is a license that grants the right to organize a company. Licenses are used to express permission allows a separately run a company with a special permit or special. Each guide is required to have a license in order to support tourism in the area, but there are guides Badung particularly guide illegal that do not have a license to harm the tourism industry, therefore, this article will explain the importance of licenses for tour guides and the advancement of the tourism industry in the area of Badung. In addition, this paper also explains the role of the government in dealing with illegal guide in Badung district. to get the most out of writing the research method used is empirical legal research techniques of data collection through interviews with informants. The function is as a guide license for legal protection for tour guides in their profession, while the actions of the Bali provincial government in dealing with the guides without permission is sweeping / raids against guides at tourist spots and supervision to unlicensed guides are caught.

Abstract

Penulisan ini berjudul “Dampak Pengenaan Pajak Progresif Kendaraan Bermotor Terhadap Wajib Pajak Khususnya di Provinsi Bali” yang juga sebagai tujuan dari penulisan ini. Dalam penelitian ini penulis menggunakan metode penelitian Empiris dimana pendekatan kualitatif adalah suatu cara analisis hasil penelitian yang menghasilkan data deskriptif analisis, yaitu data yang dinyatakan oleh responden secara tertulis atau lisan serta juga tingkah laku yang nyata, yang diteliti dan dipelajari sebagai sesuatu yang utuh terkait tentang pajak. Kesimpulan yang dapat ditarik dari penelitian ini bahwa dampak dari pengenaan tarif pajak progresif kendaraan bermotor terhadap wajib pajak (Khususnya di Provinsi Bali) menimbulkan 2 (Dua) dampak yakni positif dan negatif. Dampak positifnya terjadinya peningkatan pendapatan ke Pendapatan Asli Daerah (PAD) dalam Anggaran pendapatan dan belanja daerah (APBD) Provinsi Bali meningkat, dan menekan angka kepemilikan kendaraan pribadi sehingga bisa memecahkan kemacetan. Disisi lain dampak negatif yang ditimbulkan yakni di dalam masyarakat yaitu masyarakat sebagai wajib pajak merasa terbebani atas pengenaan pajak progresif tersebut.

Abstract

ABSTRAK Penulisan artikel ini bertujuan untuk mengetahui pengaturan mengenai tanggung jawab hukum perusahaan pialang berjangka pada para nasabahnya. Artikel ini menerapkan metode penelitian hukum normatif, yaitu penelitian yang didasari pendekatan bahan hukum, secara primer maupun sekunder. Hasil menunjukan kegiatan investasi berjangka komoditi selalu memiliki resiko kerugian serta potensi keuntungan perdagangan dengan jangka komoditi adalah bentuk investasi dengan potensi keuntungan dan resiko tinggi. Oleh sebab itu, untuk melindungi hak – hak dari para nasabah dari tindakan pelanggaran aturan yang diterapkan oleh perusahaan pialang berjangka, Badan Pengawas Perdagangan Berjangka Komoditas (Bappebti) sebagai badan pengawas perdagangan dengan jangka komoditi dengan aktif merumuskan bermacam regulasi serta peraturan guna menjaga kepentingan tiap pihak pada kegiatan perdagangan dengan jangka serta komoditi, melalui kewenangan yang diberi pada bappebti, masyarakat ataupun nasabah mendapat perlindungan yang represif serta preventif. Kata Kunci: Tanggung Jawab, Pialang Berjangka, Investasi, Nasabah ABSTRACT The purpose of writing this article is to find out the arrangements regarding the legal liability of a futures brokerage firm to its customers. This article applies a normative legal research method, namely research based on a legal material approach, both primary and secondary. The results show that trading with the commodity term is a form of investment with high potential returns and risks. Therefore, to protect the rights of customers from violating the rules applied by the futures brokerage company, the Commodity Futures Trading Supervisory Agency (Bappebti) as a commodity-term trade supervisory body actively formulates various regulations and regulations to protect the interests of each party. In trading activities with terms and commodities, through the authority given to Bappebti, the public or customers receive repressive and preventive protection. Abstract

ABSTRAK Penelitian ini memiliki tujuan untuk mampu menganalisa dan menguraikan aturan hukum terkait bagi pelaku usaha yang berkendala dalam hal persaingan usaha ditengah arus pasar digital yang meningkat penggunaannya atau yang dapat disebut sebagai e-commerce, serta untuk mengetahui aspek akibat hukum yang timbul dari adanya persaingan usaha yang tidak sehat dalam suatu transaksi e-commerce dalam perspektif hukum di Indonesia. Analisa permasalahan pada penelitian ini menggunakan penelitian hukum normative. Adapun hasil pembahasan menguraikan bahwa peraturan hukum dari persaingan usaha pada ­e-commerce diatur dalam beberapa peraturan perundang-undangan yakni UU ITE, UU Perdagangan dan UU Persaingan Usaha serta tindak lanjut dari pengaturan tersebut tertuang dalam PP No 80 Tahun 2019 yang mengatur perdagangan digital. Akibat hukum dari timbulnya perilaku pelaku usaha yang tidak sehat dalam transaksi e-commerce yakni diatur dalam UU Persaingan Usaha yang terkualifikasi atas akibat hukum secara administratif dan pengenaan sanksi pidana. Lembaga yang berhak mengawasi dan menjatuhkan sanski atas adanya pelanggaran usaha tersebut adalah KPPU sebagai lembaga independen yang diberikan kewenangan atributif dalam UU Persaingan Usaha sebagaimana tertuang dalam Pasal 36 untuk menjatuhkan sanksi dalam Pasal 47 sebagai sanksi administratif serta Pasal 48 sebagai pidana pokok yang dijatuhkan oleh pelaku usaha dalam hal ini dapat perorangan maupun korporasi yang ada diwilayah hukum Republik Indonesia dapat ditindaklanjuti berdasar pada UU Persaingan Usaha . Kata Kunci: pengaturan hukum, pelaku usaha, transaksi e-commerce. ABSTRACT The detention is to describe the relevant legal rules for actors involved in constrained businesses in terms of increasing the use of digital markets or what can be called e-commerce, as well as to find out aspects of legal consequences arising from increasing business competition. . unhealthy in e-commerce transactions from a legal perspective in Indonesia. Analysis of the problems in this study uses normative legal research with an approach to empowering legislation, a case approach and a legal concept approach related to businness copetition. The results of the discussion explained that business competition law regulations in the e-commerce sector are regulated in several laws and regulations, namely the ITE Law, the Trade Law and the Business Competition Law and the follow-up to these regulations is contained in PP No. 80 2019 which regulates digital trade. The legal consequences for business actors conducting unfair business competition in e-commerce transactions are regulated in the Quality Business Competition Law for administrative legal consequences and the imposition of criminal sanctions. The government which has the right to supervise and impose sanctions on the existence of such business violations is KPPU as an independent institution that is given attributive authority in the Business Competition Law as referred to in Article 36 to impose sanctions in Article 47 such as administrative sanctions and articles. 48 as the principal punishment imposed by the business actor. in this case an individual or legal entity domiciled or conducting business activities in the jurisdiction of the Unitary State of the Republic of Indonesia can be followed up on based on the Law on Business Competition. Abstract

This study aims to determine the regulations regarding standard contracts in the banking sector after the existence of the authority of the Otoritas Jasa keuangan, to find out the legal consequences of violations of the provisions of standard contracts carried out by banking financial services and to determine efforts to prevent violations of standard contracts by banking financial services. This is normative legal research with with statutory approach and a conceptual approach. The results show that the regulation regarding the standard contract after the existence of the OJK as a financial service consumer protection agency is regulated through the Financial Services Authority Regulation (POJK) No.1/POJK.07/2013 concerning Consumer Protection in the Financial Services Sector and in the Financial Services Authority Circular Letter (SEOJK) No. 13 /SEOJK.07 / 2014 regarding the Standard contract. The legal consequences of violating the provisions of the standard contract are not regulated in the POJK and the SEOJK. When it compared with the provisions of article 18 paragraph (3) of the Consumer Protection Law which explicitly states that violations of article 18 paragraphs (1) and (2) result in standard clauses being null and void, POJK and SEOJK only require financial service actors to make action plan, hence it is deemed to have no clear legal consequences. One of the efforts that must be made by banking financial service actors to prevent violations of the provisions of the standard contract is by making standard contract regulations independently and elaborating them in the internal banking regulations.
