Abstract

One of the contents used by YouTubers to reach subscribers is by conducting product reviews. Based on their competencies, YouTubers convey an assessment of goods and services to the public and as a form of education to the public. This condition has the potential for legal problems if according to the producer or related parties that the results of the assessment by the YouTuber actually drop the goods or services being marketed. In this study, there are two problems discussed, namely, first; criminal policy of insult / and or defamation offenses in cyberspace, second; the principle of truth and public interest as the boundary between education or insulting and / or defamation. This research is a normative juridical method that examines the obscurity of norms regarding insult and / or defamation of product reviews submitted by YouTubers. The criminal policy for insult and / or defamation is regulated in Article 27 paragraph (3) of Law Number 11 of 2008 concerning Electronic Information and Transactions which must be linked to Articles 310 and 311 of the Criminal Code. Testing the principles of truth and public interest is very important to free YouTubers from criminal charges on charges of defamation / and or defamation

Abstract

Tujuan dari penelitian ini adalah untuk menjawab permasalahan yaitu menganalisisbudaya hukum masyarakat yang melakukan investasi ilegal dan menganalisis serta menemukanpenegakan hukum terhadap investasi ilegal. Kebebasan finansial (financial free) dapat dicapaidengan berinvestasi. Berbagai bentuk investasi dalam masyarakat ditawarkan oleh para pelakuusaha. Ekspektasi untung besar justru memicu tumbuhnya investasi ilegal. Padahal, ada hal yangsangat mudah yang bisa membedakan investasi aman dengan investasi ilegal, yaitu investasiilegal, keuntungan yang dijanjikan di luar kewajaran. Namun, keuntungan besar tersebut justrumembuat banyak orang tergiur untuk menginvestasikan dananya. Investasi ilegal menggunakanskema money game atau skema Ponzi yaitu dengan menggunakan dana yang didapat dari nasabahbaru untuk membayar bonus kepada nasabah lama. Kerugian yang ditimbulkan dari praktekinvestasi ilegal tidak hanya kerugian materiil tetapi juga kerugian immateriil.

Abstract

Children are part of the younger generation who are the successors of the ideals of the nation's struggle as well as human resources for the development of the country in the future. Laws are made with the aim of regulating and maintaining order, justice so that chaos in society can be controlled or prevented. The purpose of this study was carried out to determine the form of sanctions given to perpetrators of Criminal Acts of Obscenity against and the efforts of the Bali Regional Police in Law Enforcement for Perpetrators of Criminal Acts of Sexual Abuse against children. This research refers to several relevant literature and concepts as a reference source. The theory used to analyze the problem formulation is: Soerjono Soekanto's Law Enforcement Concept. The research methods used in this study are empirical research types, descriptive research properties, qualitative data forms, primary and secondary data sources, data collection using interview methods, literature studies, determination of research informants using non-probality sampling techniques, research instruments using mobile phones and recording. The data analysis used is descriptive qualitative. The results of the research obtained are as follows: 1) The forms of sanctions for perpetrators of child molestation crimes are as follows: principal and additional crimes, fines and cover-up crimes. 2) the Bali Regional Police has 2 Law Enforcement efforts for Perpetrators of Child Abuse Crimes, among others, preventive and repressive efforts

Abstract

Social media provides facilities for citizens to exchange information, upload photos, videos and their daily activities. The activity of sharing personal information is too often referred to as oversharing. Psychological oversharing is a human need for attention and social support. But indirectly, this activity actually endangers the uploader. This study will discuss two problems, namely 1) the context of privacy and protection of personal data and its vulnerabilities and 2) digital literacy for the citizen community to overcome oversharing behavior. The concept of privacy basically provides an option for everyone to sort out private and public spaces for themselves. Personal data is transformed into public data when the owner shares the personal data in cyberspace. Digital literacy is needed to protect netizens from threats in cyberspace such as cyberbullying, intimidation, and even direct crimes such as robbery due to the behavior of netizens who show off their wealth on social media. Digital literacy will increase the social intelligence of netizens to determine what can and should be uploaded on social media. Key words: digital literacy, oversharing, social media.
