Abstract

Online gambling (judol) has become one of the significant challenges in the digital era, causing multidimensional effects, including economic losses, threats to social stability, and weakening of the law. Despite various efforts such as blocking sites and cutting off funding streams, quick adaptation by perpetrators, lack of coordination among agencies, and limitations in technology and human resources remain major obstacles. This study aims to evaluate the performance of stakeholders related to handling online gambling, map the obstacles faced by stakeholders, and formulate strategies for handling online gambling through stakeholder collaboration. The research method used in this study is a qualitative approach with interview techniques with stakeholders, namely Komdigi, Polri, and PPATK, using formal evaluation analysis. The results show that Komdigi's performance is not effective due to resource limitations and technological capacity, POLRI faces obstacles in legal instruments and international cooperation, while PPATK also has resource constraints and secondary data limitations. This study finds that site blocking and cutting off funding streams are effective but hindered by perpetrators' technological adaptation and suboptimal cross-agency coordination. Low public awareness also complicates the handling. Recommendations include strengthening coordination, optimizing detection technology, adaptive regulation, public education, and international cooperation for a more holistic and sustainable approach.

Abstract

Pelanggaran keimigrasian yang dilakukan warga negara asing merupakan suatu ancaman bagi Indonesia. Untuk itu proses sekuritisasi yang dilakukan oleh aktor negara dengan melihat adanya ancaman dari pelanggaran keimigrasian merupakan langkah preventif pemerintah Indonesia untuk melindungi keamanan nasionalnya. Selain itu diperlukannya pelaksanaan fungsi keimigrasian sebagai bentuk upaya pencegahan dari tindakan keimigrasian, agar hanya warga negara asing yang mendapat izin tinggal benar-benar yang bermanfaat untuk negara. Penelitian ini bertujuan untuk mengetahui bagaimana proses sekuritisasi terhadap pelanggaran keimigrasian Warga Negara Asing. Metode penelitian yang digunakan adalah pendekatan kualitatif, teknik pegumpulan data dapat berupa studi literature dan wawancara. Wawancara yang di peroleh selanjutnya dianalisis untuk disajikan dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa Kantor Imigrasi Kelas I Khusus Non TPI Jakarta Selatan melalui penerapan sekuritisasi telah melakukan penindakan segala bentuk pelanggaran keimigrasian warga negara asing melalui tiga tahap proses yaitu profiling, pengawasan, dan penindakan pendeportasian penangkalan. Namun terdapat hambatan dalam prosesnya yaitu kendala komunikasi, kendala keterangan fiktif alamat domisili, dan kendala biaya warga negara asing tersebut untuk pulang kenegara asalnya. Saran dari riset ini adalah memperkuat kebijakan selektif dan memeperkuat pengawasan juga berkoordinasi kepada beberapa instansi lain seperti kedutaan negara asal orang asing tersebut untuk dapat bekerjasama dalam proses pendeportasian terhadap warga negaranya yang melakukan pelanggaran.

Abstract

The revision of the Broadcasting Law 2024, particularly Article 50B paragraph 2  (c) which prohibits the "exclusive investigative journalism," has sparked controversy among media and democracy stakeholders in Indonesia. This study aims to (1) analyze stakeholders' perspectives on this provision, (2) examine the differences and similarities in perspectives in the context of democratic resilience, and (3) synthesize the underlying issues to provide recommendations for strengthening democracy. Grounded in  democracy theories, this research adopts a qualitative approach using document studies from national media sources and official documents between May and November 2024. The data is analyzed using assumption analysis to identify stakeholder perspectives. The findings reveal a polarization between policymakers, who emphasize restrictions as a protective tool, and the press, which perceives them as a threat to freedom. However, a consensus emerges on the need for clearer media regulation and the protection of public interests. From a democratic resilience perspective, the macro-institutional level is identified as the weakest due to regulatory ambiguity and overlapping institutional authority, which may undermine democratic oversight and impede media control functions. The study concludes that Article 50B paragraph 2 (c) of the Broadcasting Act has the potential to threaten democratic sustainability. It therefore recommends a reassessment of the law and the article, as well as strengthening institutional coordination to harmonize regulations.
