Abstract

Abstract This study aims to find out how the implications of the abuse of Administrative Authority in the Village Apparatus Selection in Demak Regency. The research is a concise study based on cases that were consulted at the Legal Consultation Board, Faculty of Law, University of Diponegoro. Research Results Aimed that the abuse of authority occurred in the process of selecting village officials in Demak Regency. The authority to determine the selection committee of the village apparatus is the authority of the Village Head as mandated by the Law - Invitation on the Village, and not the authority of the Regent of Demak Regency. Keywords: Power Utilization, Village Officials, Demak Regency.  Abstrak  Penelitian ini bertujuan untuk mengtahui bagaimana implikasi penyalagunaan Wewenang Administrasi Dalam Seleksi Perangkat Desa di Kabupaten Demak. Penelitian merupakan kajian ringkas berdasarkan pada kasus yang dikonsultasikan pada Badan Konsultasi Hukum, Fakultas Hukum Universitas Diponegoro. Hasil Penelitian Menujukan bahwa penyalagunaan wewenang terjadi pada proses seleksi perangkat desa di Kabupaten Demak. Kewenangan untuk menetapkan panitian seleksi perangkat desa merupakan kewenangan dari Kepala Desa sebagaimana amanat Peraturan Perundang – Undangan tentang Desa, dan bukan berada pada kewenangan Bupati Kabupaten Demak. Kata Kunci: Penyalagunaan Wewenang, Perangkat Desa, Kabupaten Demak.

Abstract

Countries in the world are currently facing shocks and challenges that are not easily faced with the COVID-19 pandemic, including Indonesia. Under these conditions, the performance of the governance system in dealing with a pandemic is tested transparently in public. The implementation of good governance by the government itself is carried out by steps and decisions that will be taken and implemented by the government to the community in order to suppress the positive number of COVID-19. The application of good governance also needs support other crucial elements, one of which is public communication.  Keywords: Government Strategy, Good Governance, COVID-19, Pandemic, Abstrak Negara-negara di dunia saat ini sedang menghadapi guncangan dan tantangan yang tidak mudah dihadapi dengan pandemi COVID-19, tidak terkecuali Indonesia. Abstract

This study aims to determine the application of the omnibus law concept as a solution to hyper-regulation towards synchronization and harmonization of laws and regulations in Indonesia. The research method used is legal research using a comparative approach and a comparative approach. Overall data analyzed using synthesis analysis. The results of the study show that the application of the concept of the omnibus law as a solution to the regulation in Indonesia. Hyperegulation in Indonesia occurs at every level of laws and regulations. The potential for overlapping legal regulations including 7621 ministerial regulations, 765 Presidential Regulations, 452 government regulations, and around 30,000 regional regulations. The hyperregulation puts a burden on the synchronization and harmonization of laws and regulations in Indonesia. There is not even one institution that can monitor and evaluate the existence of the hyper-regulation. The synchronization and alignment are carried out within the framework of the four pillars as the basis of the Indonesian Republic. Thus, it is necessary to implement a study on the application of Omnibu law as a solution to the hyper-regulation of legislation in Indonesia. Keywords: Omnibus Law, Hyperregulation, Singronization, Harmonization, Regulation.  Abstrak  Penelitian ini bertujuan untuk mengetahui penerapan konsep omnibus law sebagai solusi hiperregulasi menuju sonkronisasi dan harmonisasi peraturan perundang undangan di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum yang menggunakan pendekatan perbadingan, dan pendekatan perbandingan. Keseluruhan data dianalisis mengguanakan analisis sitesis. Hasil penelitian menujukan bahwa penerapan konsep omnibus law sebagai solusi hiperregulasi regulasi di Indonesia. Hiperegulasi  di indonesia terjadi pada setiap tingkatan peraturan perundang undangan. Potensi tumpang tindih peraturan perundang undagan diantarannya terdapat 7621 peraturan menteri, 765 peraturan presiden, 452 peraturan pemerintah dan sekitar 30.000 peratruan daerah. Hiperregulasi tersebut memberikan beban dalam melakukan  sonkronisasi dan harmonisasi peraturan perundang undangan di Indonesia. Bahkan tidak ada satupun lembaga yang dapat melakukan monitoring dan evaluasi terhadap adanya hiperegulasi tersebut. Sonkronisasi dan Harmonisasi dilakukan dalam kerangka empat pilar sebagai dasar negara Rebublik Indonesia. Dengan demikian, perlu dilakukan diterapkannya kajian penerapan omnibu law sebagai solusi atas hiperregulasi perundang undangan di Indonesia. Kata Kunci: Omnibus Law, Hiperregulasi, Singronisasi, Harmonisasi, Peraturan.

Abstract

Abstract This study aims to determine the Reform of Oil and Gas Management with a Vertical Integrated System to Realize Welfare Based on the Constitution. The approach method used in this research is the Legal Research approach, the research is obtained from library research and legal documents, which means that the research is carried out by reviewing library data and existing references. The results of the research show that first, the oil and gas management system through open access and unbundling that is currently being implemented is the result of the implementation of Law No. 22 of 2001 concerning Oil and Gas, this system is contrary to the constitutional mandate, namely Pancasila. Second, the management of oil and gas through a vertical integrated system can be a means for the welfare of the Indonesian people, this system is a solution to solve oil and gas management problems in Indonesia, the vertical integrated system is a system that has triumphed in the new order era, Keywords: Oil and Gas, Governance, Welfare, Constitution AbstrakPenelitian bertujuan untuk mengetahui Reformasi Pengelolaan Migas dengan Vertical Integrated System guna Mewujudkan Kesejahteraan Berdasarkan Konstitusi. Abstract

AbstractThis study aims to determine the implementation of new energy and renewable energy policies in the context of national energy security. The research method used is legal research that uses a regulatory approach. The results of the study show that the implementation of new energy and renewable energy policies in the context of national energy security has proceeded as it should. This can be seen from the role of the government in making policies (beleid) and management actions (bestuursdaad), arrangements (regelendaad), management (beheersdaad) and supervision (toezichthoudensdaad) for the purpose of maximizing the people's prosperity. Abstract

Berdasarkan Pasal 1 Angka 3 Undang-Undang Nomor 18 Tahun 2017 tentang Perlindungan Pekerja Migran Indonesia, Pekerja Migran Indonesia adalah setiap warga negara Indonesia yang akan, sedang, atau telah melakukan pekerjaan dengan menerima upah di luar wilayah Republik Indonesia. Human Capital Index (HCI) menempatkan Indonesia berada pada peringkat ke-87 atau urutan ke-6 di Asia Tenggara sehingga berpengaruh terhadap kualitas Pekerja Migran Indonesia. HCI Indoneisa yang rendah tentu perlu ditingkatkan untuk meningkatkan pula daya saing dan kualitas Pekerja Migran Indonesia yang akan menunjang daya tawar Pekerja Migran Indonesia di tingkat global. Penelitian ini dilakukan untuk mengetahui urgensi diperlukannya Peningkatan Posisi Daya Tawar Sebagai Upaya Meningkatkan Jaminan Perlindungan Pekerja Migran Indonesia Oleh Pemerintah.  Kata Kunci: Pekerja Migran Indonesia, Daya Tawar, Kualitas. Abstract Based on Article 1 Number 3 of Law Number 18 Year 2017 concerning the Protection of Indonesian Migrant Workers, Indonesian Migrant Workers are any Indonesian citizens who will, are or have done work by receiving wages outside the territory of the Republic of Indonesia. The Human Capital Index (HCI) ranks Indonesia at 87th or 6th in Southeast Asia so that it affects the quality of Indonesian Migrant Workers. The low Indonesian HCI certainly needs to be improved to improve the competitiveness and quality of Indonesian Migrant Workers who will support the bargaining power of Indonesian Migrant Workers at the global level. Abstract

Abstract The presence of online transportation services provides benefits in terms of easy and fast mobilization. This scientific article aims to determine the pattern of partnerships between online transportation drivers and companies and the government's opportunities to provide more protection for online transportation drivers. The narrative review method is used by examining various scientific literature that specifically discusses online transportation. The data extraction procedure is carried out by deepening the idea, methodology, and reviewing the scientific literature. The results showed that the practice of the partnership relationship between online transportation drivers and companies was not in accordance with the principles of partnership and protection practices for online transportation drivers through bestuurshandeling instruments that were not optimal.Key words: Administrative act, Protection, Online Transportation.AbstrakKehadiran jasa transportasi online memberikan manfaat dalam hal mobilisasi yang mudah dan cepat. Artikel ilmiah ini bertujuan untuk mengetahui pola hubungan kemitraan antara pengemudi transportasi online dengan perusahaan dan peluang pemerintah untuk lebih memberikan perlindungan bagi pengemudi transportasi online. Metode narrative review digunakan dengan menelaah berbagai literatur ilmiah yang khusus membahas transportasi online. Prosedur ekstrasi data dilakukan dengan melakukan pendalaman terhadap ide, metodologi, dan telaah literatur ilmiah. Hasil penelitian menunjukkan bahwa praktik pola hubungan kemitraan antara pengemudi transportasi online dan perusahaan tidak sesuai dengan prinsip kemitraan dan praktik perlindungan bagi pengemudi transportasi online melalui instrumen bestuurshandeling yang belum maksimal.  Kata kunci: Bestuurshandeling, Perlindungan, Transportasi Online.

Abstract

Abstract This paper aims to describe the existence of the decisions of the industrial relations court, especially related to the execution of the decisions of the industrial relations court. This article only elaborates on the empirical issues that have become the problem in carrying out the execution of the decisions of the industrial relations court. The interim findings show that efforts must be made to provide space for the execution of the industrial relations court. So far, the execution of barren industrial relations court decisions has not been implemented. One reason is the lack of regulation on the procedure for the execution of industrial relations court decisions in Law No. 2 of 2004 concerning the Settlement of Industrial Relations Disputes. The solution is left to the execution procedure at Herzien Inlandsch Reglement (HIR) and Rechtsreglement voor de Buitengewesten (Rbg). Keywords: Decision Execution, Industrial Relations Court, Indonesian Civil Procedure  Abstrak Tulisan ini bertujuan untuk menguraikan keberadaan putusan pengadilan hubungan industrial, khusunya terkait dengan eksekusi putusan pengadilan hubungan industrial. Tulisan ini hanya menguraikan sekilan permasalahan empiris yang menjadi kendalam dalam melaksanakan eksekusi putusan pengadilan hubungan industrial. Hasil temuan sementara menunjukan bahwa harus ada upaya untuk memberikan ruang bagi pelaksanaan eksekusi pengadilan hubungan industrial. Selama ini eksekusi putusan  pengadilan hubungan industrial mandul, tidak dapat dilaksanakan. Salah satu penyebabnya adalah tidak adanya pengaturan tata cara eksekusi putusan pengadilan hubungan industrial dalam Undang Undang Nomor 2 tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial. Penyelesaiannya diserahkan kepada tatacara eksekusi pada Herzien Inlandsch Reglement (HIR) dan Rechtsreglement voor de Buitengewesten (Rbg). Kata Kunci: Eksekusi Putusan, Pengadilan Hubungan Industrial, RUU Hukum Acara Perdata

Abstract

This paper aims to find out how the principles of participation in the election of regional heads in Indonesia. The conventional method is an approach that uses a conceptual approach that can be used to analyze synthetic. The results of the study indicate that the basic principles for conducting the election of regional heads must be conducted at the time of openness as a basic principle of community participation. Abstract

Abstract: Job loss insurance (JKP) is an additional post-employment social security program the issuance of the Job Creation Act is given specifically to workers who have termination of employment. This program is not fully running, because there is a minimum requirement for the contribution period and participant activity before to apply for benefits. This research aims to find out and understand the prospect of providing JKP in protecting workers who have termination of employment and the readliness of the organizer in implementing JKP. The research method used in writing this law is empirical juridical descriptive. The results of this study indicate the prospect of providing JKP has not been able to fully protect workers have been terminated. The existence of checking the participation of the social security program as a membership requirement will cause many workers not having the opportunity to take part in the program. Cash benefit is of low value and will not be enough for capital trying to be independent. Almost one year after the implementing regulations were issued, the organizers are not fully ready to implement a loss guarantee program work yet, it can be seen from the low level of understanding of workers about JKP, technical guideline that are not available yet, as well as systems and guidance human resources act as service implementers are still in the process. Keywords: Job Loss Insurance; Workers; Termination of Employment; Protection Abstrak: Jaminan kehilangan pekerjaan (JKP) merupakan program jaminan sosial tambahan pasca terbitnya UU Cipta Kerja yang diberikan secara khusus kepada pekerja yang mengalami PHK. Program ini belum sepenuhnya berjalan karena adanya ketentuan minimal masa iur dan keaktifan peserta sebelum dapat mengajukan manfaat. Penelitian bertujuan untuk mengetahui dan memahami prospek pemberian JKP dalam melindungi pekerja yang mengalami PHK dan kesiapan badan penyelenggara dalam menyelenggarakan program JKP. Penelitian ini menggunakan metode yuridis empiris bersifat deskriptif. Hasil penelitian menunjukkan, prospek pemberian JKP belum sepenuhnya dapat melindungi pekerja yang mengalami PHK. Pengecekan kepesertaan program jaminan sosial sebagai persyaratan kepesertaan akan mengakibatkan banyak pekerja tidak berkesempatan atas program, manfaat uang tunai bernilai rendah dan tidak akan cukup untuk modal berusaha mandiri. Hampir satu tahun pasca peraturan pelaksanaan terbit, badan penyelenggara belum sepenuhnya siap menyelenggarakan program JKP, terlihat dari rendahnya tingkat pemahaman pekerja terhadap JKP, petunjuk teknis belum tersedia, serta sistem dan bimbingan SDM masih dalam proses.­­ Kata Kunci: Jaminan Kehilangan Pekerjaan; Pemutusan Hubungan Kerja; Perlindungan
