Abstract

Wacana tentang slametan dalam masyarakat Muslim Surinam keturunan Jawa di Belanda sesungguhnya, di satu sisi, merepresentasikan sebuah pertarungan identitas kultural keagamaan di antara mereka dan, di sisi lain, menunjukkan sebuah hubungan yang kompleks antara Islam ‘resmi’ dengan tradisi Jawa. Tulisan ini membuktikan bahwa praktek slametan dalam masyarakat Muslim Surinam keturunan Jawa di Belanda ternyata hampir tidak mengalami perubahan. Perubahan yang ada hanya berkaitan dengan aksesoris upacara sebagai akibat dari penyesuaian terhadap kondisi geografis dan iklim setempat. Hal ini tidak ada artinya dibandingkan dengan antusiasme yang sangat besar --khususnya bagi kelompok masyarakat Muslim Kejawen untuk melestarikan semua warisan budaya dari pendahulu mereka yang adalah orang Jawa. Tulisan ini pada akhirnya menunjukkan adanya pertarungan identitas antara kelompok Muslim Kejawen yang bangga dengan “agama jawa”-nya dan kelompok moderat dan reformis yang ingin menjadi Muslim yang sebenarnya.

Abstract

This article elaborates a new paradigm in the interpretation of Qur’anic legal verses conducted by a Syrian thinker, Mohammad Shahrour. This study shows that, according to Shahrour, Islamic jurisprudence is not “‘ayniyya”, but “h‍‍ududiyya” since for him, all legal rules carried by the verses represent the limits of Allah which people can behave. Shari‘a h‍ududiyya proves that Shahrour’s approach to the Quranic legal verses can be characterized as an open-ended process of socio-political and moral codes. Still holding on to the tool of textual analysis but combining it with a new perspective, h‍ududiyya, Shahrour manages to be faithful to the text and at the same time, compatible with the ideas and values of modernity and humanism. Elaborated by other theories from other disciplines, especially mathematics and physics, Shahrour provides six types of limits which encapsulate all Shari‘a cases equipped with their characteristics, differentiations and implementations.[Artikel ini menjelaskan paradigma baru dalam menafsirkan ayat-ayat hukum dalam al-Quran seperti diperkenalkan oleh seorang pemikir berkebangsaan Syria, Mohammad Shahrour. Artikel ini memperlihatkan bahwa, menurut Shahrour, ayat-ayat hukum dalam al-Quran itu tidak bersifat “‘ayniyya”, namun “h‍ududiyya” karena berfungsi untuk membatasi. Shari‘a h‍ududiyya yang diperkenalkan Shahrour menjelaskan bahwa pendekatan terhadap ayat-ayat hukum dalam al-Quran  bersifat terbuka. Dengan tetap berpijak pada pendekatan tekstual terhadap al-Quran sembari memperhatikan pandangan baru, h‍ududiyya, Shahrour berhasil mempertemukan teks al-Quran dengan ide-ide dan norma-norma modernitas dan humanisme. Abstract

This study aims to analyze in depth the concept of fiqh al-aqalliyyat from the perspective of wasathiyyah based on the thought of Abdullah bin Bayyah, as well as explain the contribution of this concept to the development of minority Muslim fiqh today. The focus of the research is on the methodological aspect in the formation of Islamic law for minority Muslim communities who often face conflicts between the normative provisions of sharia and modern social conditions. This study uses a qualitative approach with normative and conceptual analysis methods of the main work of Abdullah bin Bayyah as a primary data source, supported by various jurisprudence literature and contemporary Islamic thought. The findings of the study show that there is a pattern of legal thinking that emphasizes maqāṣid al-syarī'ah, the principle of maslahat, and the value of moderation (wasathiyyah) as the main framework in Fiqh al-Aqalliyyat. The conclusion of the study underlines that the added value of this study lies in the systematic elaboration of the relationship between wasathiyyah and Fiqh al-Aqalliyyat, which has not been explicitly explained in previous research.
