Abstract

The quality of planning and synchronization in implementation can be seen from the large number of community participation in the development process. So that public participation in the 4.0 industrial revolution can be realized through the use of technology. The concept offered by this research is the role of Strategic Quality in improving the performance of local government, which places ICT as a moderating variable.

Abstract

The research objective was to study and analyze the control of plastic waste use in Semarang City and how to control the use of plastic waste in Semarang City. Plastic waste is still a big problem in Indonesia, one of which occurs in the city of Semarang. The problem faced is that every day plastic waste continues to increase, one example in TPA Jatibarang every day Semarang residents can produce household plastic waste of 1,300 tons. This research method uses empirical juridical. This research concludes that the Semarang City Government to address the increasing problem of plastic waste has issued Semarang Mayor Regulation Number 27 of 2019 concerning the control of plastic use. In addition, the Semarang City government issued a mayor's circular regarding the elimination of the use of plastic bags in modern shops such as Alfamart, Alfamidi & Indomaret and to support this, companies also disseminate the regulation to the public. The Mayor's Regulation is ineffective due to the lack of socialization to the public and the lack of awareness of the use of plastic as a grocery bag and lack of supervision by the related institutions due to lack of personnel and no clear sanctions for violating the Mayor's Regulation so that there is no deterrent effect for violators.

Abstract

Indonesia memliki sumberdaya alam yang sangat mumpuni dibandingkan Negara lain. Pantas saja investasi yang salah satunya pertambangan yang ada di Indonesia menjadi bidikan yang paling menarik investor asing untuk menamkan sahamnya di Indonesia. Persoalan yang mendasar dalam konteks pengelolaan pertambangan tentunya mengacu pada beberapa pasal yang diantaranya UUD 45 pasal 33 ayat yang menyebutkan ; Bumi, air dan kekayaan alam yang terkandung didalamnya dikuasai oleh Negara dan dipergunakan untuk sebesar-besarnya kemakmuran rakyat. Namun dalam praktinya dominasi penguasaan hanya pada segelintir pihak utamanya adalah pihak asing yang sangat dominan dalam mendapatkan untuk dari sumber daya alam yang dimiliki. Model pengelolaan yang demikian tentunya bertentangan dengan konstitusi kita. Pasal 33 UUD 1945 beserta penjelasannya, melarang adanya penguasaan sumber daya alam ditangan orang ataupun seorang. Dengan kata lain monopoli, tidak dapat dibenarkan namun fakta saat ini berlaku di dalam praktek-praktek usaha, bisnis dan investasi dalam bidang pengelolaan sumber daya alam sedikit banyak bertentangan dengan prinsip pasal 33. Disinilah kita perlu kembali pada konsep pembangunan berkelanjutan yang merupakan ruh dari pengelolaan sumber daya alam di Indonesia. Konsep pembangunan berkelanjutan bukan hanya menyeimbangkan antara ekonomi, social dan lingkungan dalam upaya menjalankan pembangunan yang ada, akan tetapi juga menitiktekankan pada upaya mengakomodir prinsip keadilan antar generasi.

Abstract

Salah satu instrument pendukung dalam hukum islam yang termasuk bagaian dari muamalah adalah waqaf. Waqaf merupakan bentuk ajaran yang menitiktekankan bukan hanya implementasi hubungan antara tuhan dan manusia akan tetapi juga menkankan terjalinnya hubungan manusia dengan manusia. Persoalan waqaf dalam tinjauan hubungan antara manusia inilah yang kemudian perlu dicermati dari sisi  upaya dan peran waqaf dalam pemberdayaan ummat yang utamanya dalam perspektif Undang-Undang Nomor 41 tahun 2004 tentang Waqaf. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normative. Dalam penedekatannya tersebut penelitian diarahkan untuk menganalisis teks dan norma-norma dan kaidah-kaidah yang berkembang dalam untuk kemudian menguji keberlakuannya dengan norma yang ada di atasnya. Sedangkan data yang digunakan dalam hal ini adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum tersier dan bahan hukum sekunder. Melalui penelitian yang dilakukan diharapkan dapat menjadi instrument penegas kebijakan-kebijakan strategis pada masa yang akan datang terkait bagaimana implementasi waqaf dalam upay apemberdayaan ekonomi ummat. Disamping itu, hasil kajian yang dilakukan dalam menambah referensi utamanya dalam kajian hukum islam terkait pemberdayaan waqaf yang diajarkan utamanya diperguruan tinggi. Kebutuhan optimalisasi pemberdayaan waqaf melalui Undang-Undang Nomor 41 tahun 2004 tentang Waqaf tidaklah sebuah wujud wawasan yang strategis untuk diterapakan apabila budaya hukum baik masyarakat maupun struktural kelembagaan waqaf tidak berjalan dengan baik.

Abstract

The spirit of renewal and law enforcement is often considered only based on a process of renewal and change the old Act to the new Act. If the renewal and law enforcement just conceived so, then the law will continue to be considered not present in the midst of society as part of the settlement of the problem. As a solution needs to be established is to integrate the spirit of renewal and law enforcement collaborated with social reality. Thus the ideal model is expected become law unifying identity as an expression of popular sovereignty and the pattern of State laws harmonization purposes.

Abstract

ABSTRACTAlthough BMT (Baitul Maal wat Tamwil) has not had legal peotection, but in its principle these BMT institutions have performed their function asintermediary institutions that manage funds from, for and by the society. Theproblem of Bmt is not only limited to the legal legality that protect them, but alsorelated to the law of guarantee. Based on the above background, the writer formulates the purpose ofwriting, namely To know the Implementation of Mudharabah Agreement in KSPSBaitul Maal Wattamwil "Binama" Semarang and to understand the obstacles andsolutions. The method of approach used in this study is the juridical sociologicalapproach. The specification of this study is descriptive analysis, which is expectedto be able to provide detail, systematic, and comprehensive description of allmatters related to the object to be studied. The data used in this study are primarydata and secondary data, i.e data obtained through interviews and librarymaterials collected through bibliographic data, which then analyzed qualitatively. The conclusion of this study is that the Implementation of Mudharabahagreement in KSPS BMT Binama Semarang is in the form of mudharabah savingand mudharabah financing. In the implementation, saving or mudharabah savingcan be implemented smoothly, while mudharabah financing scheme is stilldifficult to be implemented in KSPS BMT Binama because the financing ofmudharabah is difficult to be implemented due to the constraints such as thedifficulty of transparency of mudhorib regarding to the profit obtained, thusinhibiting the purpose of mudharabah financing according to Islamic sharia. Inaddition, KSPS BMT BINAMA in providing financing must be with assurance. Todeal with these obstacles, the solutions implemented by KSPS BMT BINAMA inaccordance with the principle of justice are as follows: 1) Market penetration,that is by recruiting new members and make the old members loyal throughvarious services programs in BMT; 2) Cooperate with sponsorship pattern withother agencies for synergy; 3) Public awareness on sharia saving and loan. 4)Assess prospective members or customers from various aspects. The aspects offinancing are better known as the 5 C's principles.

Abstract

ABSTRAKPenelitian ini mengkaji secara deskriptif analitis Putusan Mahkamah Agung Nomor 1262 K/Pid/2012 yang mengadili terdakwa SM. Melalui putusan tersebutSM dinyatakan tidak bersalah dan dibebaskan serta mendapat ganti rugi sebesar lima juta rupiah setelah menjalani hukuman kurungan selama tiga belas bulanatas perbuatan yang tidak dilakukannya. Pada putusan pengadilan di tingkat pertama dan banding ia dinyatakan bersalah dan menjalani hukuman. Nilai keadilan yang sesungguhnya harusnya memperhatikan kerugian moril maupun materiil yang dialami SM atas putusan-putusan hakim sebelumnya. SM selayaknya bukan hanya dibebaskan tetapi juga mendapat ganti rugi saatmenjalani proses hukum sesuai dengan ukuran kebutuhan hidup yang layak. Jika hal tersebut diterapkan maka hukum tidak hanya sekadar kata-kata hitam-putih dari peraturan melainkan menjalankan semangat dan makna lebih dalam dari undang-undang atau hukum. Untuk menguatkan kehadiran hukum progresif dalam putusan pengadilan maka harus mengacu pada norma dan asas dalam sila kelima Pancasila yaitu keadilan sosial bagi seluruh rakyat Indonesia.Kata kunci: putusan pengadilan, keadilan, hukum progresif. ABSTRACTThis is a descriptive analysis examining the Supreme Court Decision Number 1262 K/Pid/2012 which adjudicate the defendant initials SM. Through this decision, SM has been proved innocent and released, then got a compensation of five million rupiahs, after serving thirteen months imprisonment for crimes she did not commit. In the court decision at first instance and the appellate she was found guilty and serving a sentence. The ultimate justice should take close consideration on the actual moral and material losses suffered by SM for the judges previous decisions against her. SM should not only be acquitted, but also be compensated during the legal process in accordance to the level of a decent living. If it is implemented, then the law would not just a black and white regulation, rather run the spirit and the meaning the statute or laws in greater depth. To reinforce the presence of progressive law in the courtdecision, it must refer to the norms and principles in the fifth principle of Pancasila, which is of social justice for all Indonesian people.
