Abstract

Hukum tidak lepas dari kehidupan manusia. dalam masyarakat yang paling sederhana sekalipun keberadaan norma hukum sebagai suatu pranata sosial secara nyata telah menjadi qonditio sine quanon bagi keberlangsungan masyarakat tersebut sebagai suatu entitas. Norma merupakan aturan, pedoman atau petunjuk bagi seseorang untuk berbuat dan bertingkah laku sebagaimana mestinya, sebagaimana seharusnya terhadap sesama manusia dalam lingkungan suatu masyarakat tertentu. Hakiki dari hukum di mana di satu pihak hukum harus mengandung unsur kepastian, dan prediktabilitas, sehingga dia harus stabil. Tetapi di lain pihak hukum haruslah dinamis, sehingga selalu dapat mengikut dinamika perkembangan kehidupan manusia.

Abstract

Program kegiatan pengabdian masyarakat di Desa Karangmojo, Kecamatan Tasikmadu, Kabupaten Karanganyar bertujuan untuk memberikan pengetahuan, wawasan serta ilmu yang bermanfaat terkait permohonan hak atas tanah sesuasi dengan peraturan perundang-undangan yang berlaku, dimana permasalahan yang dihadapi oleh masyarakat adalah kurang informasi dan wawasan terkait permohonan hak atas tanah. Metode yang digunakan adalah jenis penelitian normatif dimana jenis penelitian ini berpaku pada peraturan perundang-undangan dan juga tinjauan Pustaka. Hasil penelitian dapat disimpulkan bahwa proses pengajuan permohonan hak atas tanah harus sesuai dengan peraturan perundang-undangan yang berlaku, dan pentingnya sosialisasi ini agar peran dari masyarakat untuk mendukung program-program dari pemerintah untuk menegakan aturan dan menghindari konflik sengketa permohonan hak atas tanah serta memberikan masyarakat jaminan untuk hidup dan mengelolah dari tanah milik negara maupun milik perorangan agar mendapat kepastian hukum berupa sertipikat. Kegiatan yang telah dilaksanakan juga memberi dampak positif kepada masyarakat setempat mereka mendapatkan informasi, sesuai peraturan perundang-undangan secara nyata dan jelas, serta antusiasme dan keinginan serta ketertarikan untuk belajar lebih lanjut

Abstract

This study aims to analyse the strategic role of the Constitutional Court (MK) in the enforcement of human rights (HAM) in Indonesia. Using a literature review method and a normative legal approach, this study positions the MK as a key actor in the constitutional mechanism for protecting human rights. The MK's authority to review laws against the 1945 Constitution of the Republic of Indonesia makes it an important instrument in upholding the principles of justice and equality before the law. Several MK rulings have demonstrated its commitment to human rights values, particularly through the invalidation of discriminatory legal norms and the strengthening of citizens' constitutional rights. However, the MK's vital role still faces challenges, especially in the implementation of rulings, which are often not optimally responded to by executive and legislative institutions. This indicates a gap between the judicial and political spheres in efforts to comprehensively enforce human rights. Thus, this study affirms that the Constitutional Court not only acts as the last bastion of human rights protection, but also as a driving force for national legal reform to be more responsive to human rights values and principles. Going forward, synergy between state institutions is key to strengthening the effectiveness of the Constitutional Court in guaranteeing respect for and protection of human rights in Indonesia

Abstract

The practice of paddy field pawning is still a prevalent phenomenon in Indonesian rural communities, despite the existence of regulations governing it. The practice of paddy field pawning from a legal and ethical perspective, and formulate recommendations for the protection of the rights of the parties involved. The results showed that the practice of paddy field pawning is often not in accordance with applicable legal provisions, especially regarding the time limit and mechanism for returning the pawned land. From an ethical perspective, gadai sawah raises moral dilemmas related to justice, transparency, and the economic sustainability of rural communities. Although it provides a short-term solution, this practice has the potential to perpetuate economic inequality. This research recommends a comprehensive approach in addressing the issue of gadai sawah, including: (1) revision and strengthening of regulations by considering socio-economic conditions and local wisdom; (2) development of alternative financing products by formal financial institutions that better suit the needs of rural communities; (3) expansion of financial education and literacy programmes; (4) economic empowerment of village communities through the development of BUMDes and agricultural cooperatives; and (5) further research on alternative models of agricultural financing.The implementation of these recommendations is expected to improve legal and ethical protection in the practice of paddy field pawning, as well as contribute to the improvement of welfare and socio-economic justice in Indonesia's rural communities.

Abstract

The function of village heads in the implementation of the restorative justice concept in Indonesia, particularly at the village governance level. Restorative justice is understood as a legal approach that emphasizes restoring social relations among offenders, victims, and the community through dialogue and mutual agreement. This study employs a descriptive qualitative method based on literature review, regulatory analysis, and documentation of a legal awareness program conducted in Mulur Village, Bendosari District, Sukoharjo Regency. The findings indicate that the principle of the Indonesian rule of law, grounded in Pancasila, promotes justice that is not only retributive but also substantive and socially equitable. Village heads play a crucial role in maintaining social harmony, strengthening deliberative democracy at the village level, and acting as a bridge between the community and law enforcement agencies, in accordance with Law No. 6 of 2014 on Villages and the new Criminal Code (Law No. 1 of 2023). However, to strengthen this role, regulatory support, legal education, and synergy with law enforcement institutions are required. Therefore, village heads can become key actors in realizing restorative justice that is humanistic, democratic, and inclusive in line with Pancasila values
