Abstract

Putusan Mahkamah Konstitusi dalam perkembangannya tidak efektif dalam implementasinya. Untuk itu perlu direkonstruksi agar dapat memberikan kepastian hukum yang berkeadilan. Penelitian ini merupakan penelitian yuridis normatif  dengan menggunakan data sekunder yang dianalisis secara kualitatif dengan pendekatan hukum progresif. Kesimpulan dalam penelitian ini adalah dalam hukum progresif anak yang lahir akibat perkawinan sirri mempunyai kedudukan yang berbeda dengan anak luar kawin lainnya. Bentuk perlindungan hukum dapat berupa pencatatan secara administratif dan hak-hak lain yang berkaitan dengan nasab, kewarisan, wali nikah, nafkah dari ayahnya.

Abstract

This study aims to explore the judges' legal culture in the Kudus Religious Courts in dealing with the high number of applications for marriage dispensation during the Covid-19 pandemic. Making a decision on a case becomes problematic for judges because they have to make it on their personal considerations. This research was analyzed qualitatively using a constructivism paradigm with a socio-legal research approach based on primary data by interviewing 2 (two) judges, 3 (three) advocates, and 3 (three) applicants for a marriage dispensation. Moreover, it also employed secondary data, including the marriage law, marriage regulation and its implementation, relevant literature, and academic journals. The research findings are: First, the high number was caused by Kudus people’s perception of the minimum legal age of marriage which is based on customary belief, which is maturity in social life, rather than legal regulation which is numerical age. Second, in making a decision about the case, the judges make considerations based on legal facts in the trial court and the values of justice living in the society while paying attention to the Supreme Court rules. Third, the legal culture of judges in deciding the application is making dialogue with some fellow judges while advising applicants to revoke their application.

Abstract

Law Number 33 of 2014 and Government Regulation Number 31 of 2019 in Indonesia shifted halal certification from voluntary to mandatory on October 17, 2019, contrasting with Malaysia's voluntary system under the 2011 Akta Perihal Dagang (APD). This study aims to scrutinize the legal regulations of halal certification in both countries and assess their impacts on business entities. Employing a qualitative method with a phenomenological approach reveals differences in certification procedures, notably in application-to-issuance stages. Indonesia provides a self-declaration mechanism for micro and small businesses, while Malaysia lacks such a provision. Nonetheless, material inspection principles align in both nations. Most respondents perceive halal certification as crucial for sales turnover, despite challenges posed by the COVID-19 pandemic. This research is significant for businesses and governments on how to manage halal certification in both countries.
