Abstract

The current development of technology supports the use of e-commerce for fulfillment of public needs. Nowadays, more start-ups and digital companies in Indonesia, including Micro, Small and Medium Enterprises (MSME) are targeting sharia market through selling halal goods on e-commerce shop and provide sharia investment products for Muslims. However, the high usage of e-commerce in Indonesia, which has become a necessity for Muslim societies, is not comparable with halal certification on MSME products in e-commerce. Based on the problems, this paper examines the urgency and mechanism of halal certification in MSME products in e-commerce in Indonesia. This research uses juridical-normative research methods to address this issue. Based on the research result, researchers found that coordination with all parties is needed, ranging from the government to the industrial actors, so that all MSME products from e-commerce can easily carry out halal certification. The government needs to form a digital economic interconnection of sharia so that the sharia economy is also not left behind in terms of financial technology, Islamic financial institutions, online commerce, and social finance. Various parties including the Ministry of Trade, the National Sharia Council (DSN) MUI need to make regulations and fatwa in support of halal certification in e-commerce. Keywords: e-commerce; halal certification; Indonesian economy; MSME; products.

Abstract

The synergy between Sharīʿah fintech regulation and halal tourism must be grounded in the objectives of Islamic law (maqāṣid al-sharīʿah), which prohibit usury (ribā), uncertainty (gharār), and gambling (maysir), to foster a fair, transparent, and sustainable economic ecosystem that empowers local communities. In practice, however, this synergy faces several challenges, including regulatory oversight gaps, superficial Sharīʿah compliance, cross-sectoral regulatory fragmentation, low levels of Sharīʿah financial literacy, and limited digital infrastructure. In Indonesia, Sharīʿah fintech is regulated by POJK No. 77/2016 on technology-based lending services, DSN-MUI Fatwa No. 117/2018 on Sharīʿah-compliant fintech operations, and PBI No. 19/2017 concerning fintech implementation and financial system stability. Halal tourism, meanwhile, is governed by Law No. 33/2014 on Halal Product Assurance, which mandates halal certification for goods and services, including tourism-related activities. This normative legal research employs legislative, conceptual, and analytical approaches, drawing on primary and secondary legal materials obtained through literature review and document analysis. The findings indicate that regulatory integration between Sharīʿah fintech and halal tourism is essential for promoting sustainable and inclusive economic growth. Such synergy enhances transparency, accountability, and trust, while enabling halal tourism operators to access ethical financing through instruments such as muḍārabah and mushārakah. Ultimately, this collaboration strengthens Indonesia’s national halal ecosystem, supports SMEs, enhances economic development, and increases global competitiveness in halal market.

Abstract

The rapid growth of Islamic financial technology (fintech), particularly Sharī’ah-compliant peer-to-peer (P2P) financing, has played a significant role in promoting financial inclusion. Islamic fintech possesses unique characteristics and risks due to its compliance with Sharī’ah principles. Sharī’ah risk arises from non-compliance with Sharī’ah principles and is closely linked to legal risk, as such compliance is shaped by the applicable regulatory framework. Although previous studies have examined legal and Sharī’ah risks, limited attention has been paid to their interaction within the regulatory framework governing Islamic P2P financing. Therefore, this study aims to analyze the legal and Sharī’ah risks associated with Islamic fintech P2P financing and to examine the role of regulation in mitigating these risks. This study adopts a doctrinal legal research approach, using a case study of Sharī’ah-compliant P2P financing platforms in Indonesia and employing literature review, leximetric analysis, and content analysis. The findings identify several weaknesses in the existing regulatory framework that may undermine legal certainty and Sharī’ah compliance, and highlight the importance of strengthening regulation, supervisory mechanisms, and Sharī’ah governance as integrated risk-mitigation strategies for Islamic P2P financing. These findings contribute to the development of a regulatory governance framework for the Islamic fintech ecosystem
