Abstract

This paper examines the issues of, first, the special assignment of the Minister of BUMN (State Owned Enterprise) and the Minister of Transportation to PT. Angkasa Pura I (Persero) in land procurement forthe construction of the New Yogyakarta International Airport (NYIA) airport in Kulon Progo Regency, DIY Province whether it can invalidate the obligations of PT. Angkasa Pura I (Persero) to pay BPHTB. Second, it is regarding the land procurement for the construction of the New Yogyakarta International Airport (NYIA) airport in Kulon Progo Regency, Special District of Yogyakarta whether it can be qualified as  "land  acquisition  for  the  development  of  public interest"  which  is  freed  from  the  obligation  to  payBPHTB.  This  is  a  normative  legal  research  using  primary  and  secondary  legal  materials  obtained through literature studies and is analyzed juridical. From the research results, it can be concluded that, first, special assignments could not invalidate the obligations of PT. Angkasa Pura I (Persero) to payBPHTB.  Secondly,  PT.  Angkasa  Pura  I  (Persero)  in  Kulon  Progo  Regency  of  Special  District  of Yogyakarta Province cannot be qualified as "land acquisition for development for public interest" freed from the obligation to pay BPHTB.

Abstract

This research is aimed at examining the relationship between the implementation of the principle of openness of the government to the fulfillment of the right to information in the land acquisition activity of the Sleman Cultural Park. The problems in this research are, first, what is the concept of fulfilling the right to information in the land acquisition policy for the public interest? Second, does the implementation of the Sleman Cultural Park land acquisition reflect the fulfillment of the right to information? This study uses an empirical legal research method with a statutory approach and a conceptual approach. The results of the study concluded that in the implementation of the Sleman Cultural Park land acquisition, the fulfillment of the right to information by the government was limited to a formalistic framework and had not yet reached the fulfillment of the right to information substantially, so that the community did not have full rights to information. This has led to public distrust of the government and resulted in the failure of land acquisition activities for the Sleman Cultural Park.

Abstract

Legal issues, including the criminal acts of corruption which are still widely committed by the State Civil Service (ASN) at this time are no longer a matter of formal legality, regarding the proper interpretation and application of articles of statutory regulations, but rather move to the direction of using the law as a means to participate in shaping a new life order or in accordance with current conditions. Law and society are closely related. Therefore, it is necessary to use social science or legal sociology to analyze and study legal issues, one of which is the structural functionalism theory to study law enforcement in Indonesia. The purpose of this study is to determine the analysis of corruption cases conducted by ASN in Indonesia using structural functionalism theory. In this study is a normative juridical research. The approach taken in this paper is a conceptual approach. This research is a library research. The result of this research is that the criminal act of corruption committed by ASN can be studied using structural functionalism theory as a science of legal sociology. According to the structural functionalism theory, if one of the elements in the structure does not function, the law will not work or be unstable. ASN is an element or implementing structure (government). Judging from the structural functionalism theory, acts of corruption by ASN make the law not function properly. Besides that, there is also a system and emphasis in studying structural functionalism, there is an AGIL paradigm in the structural theory of functionalism. It can be seen that the act of corruption by ASN has made ASN unable to perform its function properly in providing public services or is dysfunctional, and the law becomes unstable.AbstrakPersoalan-persoalan tentang hukum, tidak terkecuali tindak pidana korupsi yang masih banyak dilakukan oleh Aparatur Sipil Negara (ASN) pada saat ini tidak lagi merupakan persoalan tentang legilitas formal, tentang penafsiran serta penerapan pasal-pasal peraturan perundang-undangan secara semestinya, melainkan bergerak ke arah penggunaan hukum sebagai sarana untuk turut membentuk tata kehidupan yang baru atau sesuai dengan kondisi saat itu. Hukum dan masyarakat memiliki keterkaitan erat. Oleh karena itu dibutuhkan pemanfaatan ilmu sosial atau sosiologi hukum untuk menganalisis dan mengkaji persoalan-persoalan hukum, salah satunya pada teori funsionalisme struktural untuk mengkaji penegakan hukum di Indonesia. Tujuan dalam penelitian ini adalah untuk menegtahui analisis kasus korupsi yang dilakukan ASN di Indonesia menggunakan teori fungsionalisme struktural. Dalam penelitian ini merupakan penelitan yuridis normatif. Pendekatan yang dilakukan dalam tulisan ini adalah pendekatan konseptual. Penelitian ini merupakan penelitian kepustakaan (Library Research).  Hasil dari penelitian ini adalah Tindak pidana korupsi yang dilakukan oleh ASN dapat dikaji menggunakan  teori fungsionalisme struktural sebagai ilmu sosiologi hukum. Menurut teori fungsionalisme struktural jika salah satu elemen dalam struktur tersebut tidak berfungsi maka hukum tidak akan berjalan atau tidak stabil. ASN merupakan elemen atau struktur  pelaksana (pemerintah). Dikaji dari teori fungsionalisme struktural tindakan korupsi yang dilakukan ASN menjadikan hukum tidak berfungsi dengan baik. Selain itu juga terdapat sistem dan penekanan dalam mempelajari fungsionalisme struktural, terdapat paradigma AGIL dalam teori struktural fungsionalisme ini. Dapat terlihat bahwa tindakan korupsi yang dilakukan ASN tersebut menjadikan ASN tidak dapat melakukan fungsinya dengan baik dalam melakukan pelayanan publik atau terdapat disfungsional, serta hukum menjadi berjalan tidak stabil.

Abstract

In Article 1 point 4 of Law no. 5 of 2014 states that, "Government Employees with Work Agreements, hereinafter abbreviated as PPPK, are Indonesian citizens who meet certain requirements, who are appointed based on work agreements for a certain period of time in order to carry out government duties." One of the characteristics of civil servants who work in government agencies is to have a relationship between civil servants and the government. This relationship is known as opebare dienstbetrekking or Public Service Relations. A voluntary agreement or a special contract due to the appointment that gives rise to the HDP is a one-sided legal act (aanstelling) from the Government. This one-sided government action was marked by the issuance of a Decree of appointment given to Civil Servants. Meanwhile, PPPK is appointed based on a work agreement. Appointments with this work agreement will be understood by their appointments based on ordinary contracts or two-sided government actions. The purpose of this study is to find out the appointment of PPPK is normatively reviewed and analyzes related to PPPK which can be classified or not as Civil Servants who have the characteristics of Public Service Relations with the Government due to the appointment of PPPK based on a work agreement. This type of research is a normative juridical research based on primary and secondary legal materials. The study was carried out using a conceptual approach and a statutory approach. This research is a library research.

Abstract

This study analyzes about the responsibilities of civil servants (PNS) who does cases of illegal levies. The problem formulation is why do PNS who does illegal levies will be subject to personal responsibility not job responsibilities. This article concludes that violations of norms committed by PNS will incur legal consequences in the form of responsibility to the injured party. The norms that must be obeyed by civil servants in carrying out their duties are the norms of government (bestuursnorm) and norms of behavior (gedrasnorm). Accountability for violations of government norms will later be directed to government positions, with compensation imposed on agencies, with a touchstone using the principles of legality, principles of specialty, and general principles of good governance. While accountability for violations of the norms of behavior will be addressed to the relevant office holders or civil servants, with a touchstone using maladministration. Illegal levies are included in the category of maladministration, therefore in conducting maladministration which is a violation of the norms of behavior will cause legal consequences in the form of personal responsibility. Abstrak Artikel ini membahas tentang tanggung jawab pegawai negeri sipil (PNS) yang melakukan kasus pungutan liar. Permasalahan yang dibahas adalah mengapa PNS yang melakukan pungutan liar dikenakan tanggung jawab pribadi dan bukan tanggung jawab jabatan. Artikel ini menyimpulkan bahwa pelanggaran norma yang dilakukan oleh PNS akan menimbulkan konskuensi hukum berupa tanggung jawab kepada pihak yang dirugikan. Adapun norma yang yang harus dipatuhi pegawai negeri sipil dalam melaksanakan tugasnya adalah norma pemerintahan (bestuursnorm) dan norma perilaku (gedrasnorm). Pertanggungjawaban terhadap pelanggaran norma pemerintahan tersebut nantinya akan ditujukan kepada jabatan pemerintahan, dengan ganti rugi dibebankan kepada instansi, dengan batu uji menggunakan asas legalitas, asas spesialitas, dan asas-asas umum pemerintahan yang baik. Sedangkan pertanggungjawaban terhadap pelanggaran norma perilaku akan ditujukan kepada pemangku jabatan atau PNS yang bersangkutan, dengan batu uji menggunakan maladministrasi. Pungutan liar termasuk dalam kategori perbuatan maladministrasi, oleh karena itu dalam melakukan maladministrasi yang merupakan pelanggaran terhadap norma perilaku akan menimbulkan konsekuensi hukum berupa tanggung jawab pribadi.

Abstract

This research is a development research of learning methods for Pancasila Education in the Faculty of Law UII using Student Center Learning (SCL) learning methods based on student activities. Learning problems that will be solved in this study include: First, is how the SCL learning method based on activity in the Pancasila Education Course at the Faculty of Law UII. Second, is whether the SCL method based on activity in the Pancasila Education subject is in accordance with Learning Outcomes. This study uses experimental research methods and class action (experiment and action research) by using 2 parallel classes, one class as an experimental class implementing SCL learning methods based on activity, while the other class is used as a class that does not use SCL methods based on activity. The results showed: First, the right methods to be used in learning Pancasila Education courses include brain stroming, discussion, observation, and presentation of the results of discussion and observation, and reflection. Second, classes that use the activity-based SCL learning method are more effective and efficient at achieving the learning outcomes specified in the Semester Learning Plan (RPS) compared to classes that do not use the activity-based SCL method.

Abstract

Penelitian ini merupakan penelitian pengembangan metode pembelajaran mata kuliah Pendidikan Pancasila di Fakultas Hukum UII dengan menggunakan metode pembelajaran Problem Based Learning berbasis pembelajaran dalam jaringan (daring). Masalah pembelajaran yang akan dipecahkan dalam penelitian adalah: Pertama,Bagaimana ketercapaian learning outcome Mata Kuliah Hukum Acara Peradilan Tata Usaha Negara metode pembelajaran Problem Based Learning berbasis pembelajaran dalam jaringan (daring). Kedua, Bagaimana pengaruh metode pembelajaran Problem Based Learning berbasis pembelajaran dalam jaringan (daring) dalam meningkatkan keaktifan mahasiswa pada Mata Kuliah Hukum Acara Peradilan Tata Usaha Negara di Fakultas Hukum UII. Penelitian ini menggunakan metode penelitian deskriptif dengan pendekatan kuantitatif dengan menggunakan dua macam instrumen yang diterapkan di dua kelas Hukum Acara Peradilan Tata Usaha Negara, yaitu menggunakan pengukuran nilai dan kuisioner. Hasil penelitian menunjukkan bahwa, telah terdapat ketercapaian learning outcome dalam Mata Kuliah Hukum Acara Peradilan Tata Usaha Negara dengan pengukuran nilai rerata dari 79,6% atau 39 mahasiswa yang menunjukkan ketercapaian learning outcome (CPMK 1-4) dengan benggunakan standar yang ditapkan oleh tim yakni standar nilai B dan hasil kuisioner menyimpulkan mahasiswa memberikan nilai di atas nilai baik baik pada aspek penilaian pelaksanaan PBL dan Video Pembelajaran. Dengan adanya PBL meningkatkan keaktifan mahasiswa di dalam kelas, serta video pembelajaran membantu mahasiswa dalam memahami materi perkuliahan. Adapun terkait keberlanjutan program hibah, terhadap luaran program hibah berupa video pembelajaran direncanakan untuk mendapatkan legalisasi Hak Cipta atas video pembelajaran. Bagi Program Studi dan Jurusan hendaknya menindaklanjuti hasil refleksi dari hibah ini dengan melakukan revisi CPMK dan Bahan Kajian yang ditemukan pengulangan dengan mata kuliah lain. Selain itu juga mendorong dosen-dosen lain untuk mengikuti hibah pembelajaran yang diselenggarakan oleh DPA dan diharapkan dapat mengadopsi model PBL ini khususnya bagi mata kuliah yang memiliki level kognitif sama. Kemudian, perlunya dibuat buku saku penerapan metode PBL sebagai panduan dalam pembelajaran di berbagai mata kuliah.

Abstract

ABSTRACT The purpose of this study is to find out the harmonization of disciplinary provisions based on the ASN Law and the Civil Servant Discipline Regulation in ensuring legal certainty. The type of this research is normative juridical research. The study was carried out using a conceptual approach and a statutory approach. This research is a library research. The results of this study are first, the existence of disharmony in the Civil Service Disciplinary Administration towards the ASN Law, among others regarding the provisions regarding respectful dismissal, the prohibition of ASN from becoming members and/or administrators of political parties. and the existence of a provision stating that all disciplinary provisions in the PP Discipline of Civil Servants apply to PPPK in the PP Discipline of Civil Servants. Second, harmonization efforts that can be carried out are of course with improvements made by officials who are authorized to make and stipulate Government Regulations related to the provisions in the Civil Service Disciplinary Regulations adjusted to the provisions in the ASN Law, among others related to the provisions regarding honorable dismissals, there is a prohibition of ASN from becoming members and/or administrators of political parties. and the existence of a provision stating that all disciplinary provisions in the PP Discipline of Civil Servants apply to PPPK in the PP Discipline of Civil Servants. Penelitian ini merupakan penelitian kepustakaan (Library Research).Hasil dari penelitian ini adalah pertama, adanya disharmonisasi di PP Disiplin PNS terhadap UU ASN, antara lain tentang ketentuan tentang pemberhentian dengan hormat, adanya larangan ASN menjadi anggota dan/atau pengurus partai politik. dan adanya ketentuan yang menyatakan bahwa keseluruhan ketentuan disiplin di PP Disiplin PNS berlaku bagi PPPK di dalam PP Disiplin PNS. Kedua, Upaya harmonisasi yang dapat dilakukan tentunya dengan pembenahan yang dilakukan oleh pejabat yang berwenang membuat dan menetapkan Peraturan Pemerintah terkait dengan ketentuan yang ada di PP Disiplin PNS disesuaikan dengan ketentuan yang ada di UU ASN, antara lain berkaitan dengan adanya ketentuan tentang pemberhentian dengan hormat, adanya larangan ASN menjadi anggota dan/atau pengurus partai politik. dan adanya ketentuan yang menyatakan bahwa keseluruhan ketentuan disiplin di PP Disiplin PNS berlaku bagi PPPK di dalam PP Disiplin PNS. Abstract

The purpose of this study is to find out and analyze how the legality of BPJS Health membership arrangements is a condition of public service. The research method used covers, first, this type of research is normative juridical research which is based on primary and secondary legal materials. Second, the review is carried out using a conceptual approach (conceptual approach) and statutory approach (statute approach). Third, this research is a library research. The results of this study state that administrative sanctions in the form of not providing public services because they are not registered as BPJS participants have fulfilled the legality principle, because they have been regulated in Article 17 of the BPJS Law which is then regulated further in PP 86 Number 2013, while Presidential Instruction 1 of 2022 is a guideline that apply internally to implement the two regulations. However, in accordance with the principle of legality, based on the attribution of authority granted by Article 17 paragraph (5) of the BPJS Law, PP 86 Number 2013 only regulates the procedure for imposing administrative sanctions, does not regulate the determination of membership in the JKN program as a requirement for obtaining public services as well as mentioning the types of The types of public services referred to, and both of these things should be regulated in law.

Abstract

The need for employees in government agencies is problematic due to the lack of recruitment formations for Civil Servants and Government Employees with Work Agreements (PPPK) causes the appointment of auxiliary employee through governor regulations in Yogyakarta Special Region to fill formations or positions in government administration. However, the existence of auxiliary staff employees is not clearly regulated in the employment law. Furthermore, it is needed to find the status, position and legal protection of Auxiliary Personel staff. This study aims to analyze, provide clarity and solutions regarding the status of the position and legal protection, based on Government Regulation No. 49 of 2018 concerning Management of Government Employees with Work Agreements in Yogyakarta Special Region. The method used in this research is empirical juridical by conducting interviews and statute approach. The conclusion of this study is that the Governor's Regulation on the Management of Auxiliary Personnel is invalid and null and void which resulted in unclear status and position of auxiliary staff within the Yogyakarta Special Region Government. Moreover, the legal protection for auxiliary personnel is not yet maximized and Auxiliary personnel should be given the same protection as PPPK for the same workload and work responsibilities.Kebutuhan akan pegawai di instansi pemerintah mengalami problematika dikarenakan kurangnya formasi recrutmen Pegawai Negeri Sipil dan Pegawai Pemerintah dengan Perjanjian Kerja (PPPK), hal ini menyebabkan Pemerintah Daerah Istimewa Yogyakarta melalui peraturan gubernur melakukan pengangkatan tenaga bantu guna mengisi formasi atau jabatan dalam penyelenggaraan pemerintahan. Meskipun demikian sampai saat ini pegawai tenaga bantu keberadaannya tidak diatur secara jelas dalam aturan hukum kepegawaian, sehingga diperlukan untuk menegaskan status dan kedudukan serta perlindungan hukum bagi tenaga bantu itu sendiri. Penelitian ini bertujuan untuk menganalisis dan memberi kejelasan mengenai status kedudukan dan perlindungan hukum, berdasar Peraturan Pemerintah Nomor 49 tahun 2018 tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja serta memberikan solusi bagi permasalahan tenaga bantu Pemerintah Daerah Daerah Istimewa Yogyakarta. Metode yang digunakan dalam penelitian ini yaitu yuridis empiris dengan melakukan wawancara dan pendekatan peraturan perundang-undangan. Kesimpulan dari penelitian ini yaitu Peraturan Gubernur tentang Pengelolaan Tenaga Bantu adalah tidak sah dan batal demi hukum yang mengakibatkan tidak jelasnya status dan kedudukan tenaga bantu dilingkungan Pemerintah Daerah Istimewa Yogyakarta, dan perlindungan hukum kepada tenaga bantu belumlah maksimal karena masih terdapat ketidakpastian hukum bagi tenaga bantu yang mana seharusnya tenaga bantu memiliki perlindungan yang sama dengan PPPK karena memiliki beban kerja dan tanggungjawab kerja yang sama.
