Abstract

The study focuses on the practical concept of the unregistered marriage at the Marawola Sub-district. It seeks to understand factors that cause the practices and their sociological impacts. The study aims to recognize the practical concept of the unregistered marriage, factors affecting the practices, and their sociological impacts. The study is a descriptive research by nature. It employs different data collection techniques while adopting qualitative approach in its data analysis. The setting of the study is at the Marawola Sub-district. The findings of the study show that there were a lot of people in the community under the authority of the Marawola Sub-district practiced unregistered marriages. They made mention that the reasons for their practices which were derived from their interviews were legal because they believed that the unregistered marriages have fulfilled terms and conditions for lawful marriages. They argued that a marriage registration is only for the legalization of the marriage. The reasons for the unregistered marriage practices covered many factors. First, it is due to the ignorance of the community in regards to procedures for a marriage registration at the Marawola Sub-district. Other reasons are related to administrative requirements for a marriage registration and marriages by accident due to pregnancies. In addition, unlawful actions of irresponsible individuals in the community who helped perpetrators to find a shortcut for the Unregistered Marriages could also cause the insurgence of the practices. These all brought sociological impacts in their society especially for wives and children where there is no legal protection for them. Hence, there was no recognition from formal law which then resulted in long-term social impacts and negative turmoil in the community.

Abstract

Women were perceived as having a nasty and disturbing image in pre-Islamic times. They are considered worthless and subordinated beings whose presence causes many problems. They have no personal independence, their rights can be taken away from them, and their bodies can be trafficked or passed down through the family, which puts them in a precarious situation. Women are considered not worthy of being treated humanely in these circumstances. In Buol Regency, problems have been related to this iwadh khulu'. In this case, the wife did not receive the iwadh khulu' payment that was handed down to her because, during the time of marriage, the wife was treated improperly by her husband, such as not given a living to support her and her children, often being left alone without news, and not infrequently the husband commits domestic violence to the wife. Based on that, the researchers are interested in further researching this issue and have written a thesis entitled "Rejection of Wife towards Iwadh Khulu from a Maqashid Sharia Perspective (Case Study at the Buol Religious Court). The approach used in this research is qualitative. Data was gathered through observation, interviews, and documentation. The analysis was done through data reduction, data presentation, and verification. To ensure that the data obtained was valid and credible, analysis and checking of the validity of the data were carried out. The results of this study indicate that the wife's rejection of iwadh khulu' in the Buol district is based on a mental inability to accept all the burdens she has received during the marriage period. In the view of maqasid sharia, this is included in Hifdz Akl and Hifdz Nasl because refusal is made only based on the wife's mental condition in facing Khulu' (Divorce Lawsuit).

Abstract

This article discusses optimizing the role of productive waqf in Palu City and the factors inhibiting maximizing the role of productive waqf in the welfare of the people of Palu City. This research uses empirical legal research with a qualitative approach. The data collection technique is by direct observation at the Indonesian Waqf Board in Palu City, then by conducting interviews and documentation to complete the research information. The data analysis techniques used are data reduction, data presentation, and conclusion from general to specific. The results of this research explain that the optimization of productive waqf operations in Kolta Palu is carried out in various ways to promote community welfare, namely continuous socialization. Activities are also deliberately carried out to ensure the existence of new wakifs (waqf). Asset mobilization means looking for ways to consolidate public assets into waqf assets. The Indonesian Waqf Board has increased the capacity of recipients of waqf assets (Nazir). They will be trained and developed by the Indonesian Waqf Board to manage the waqf assets that have been allocated. Second, productive waqf in Palu has so far not been running optimally, and this collaboration is due to several contributing factors, namely the problem of the community's understanding of waqf procedures, waqf administration and management, waqf property, waqf nazir and budget funds for registration of land certificates.
