Abstract

AbstractA special medical court was formed to adjudicate medical disputes between medical personnel and patients. Therefore, a special court is needed to settle medical disputes, in which this special court hears/resolves medical disputes both criminal and civil, which is expected to be able to provide justice to all parties, especially to medical personnel. In this case the authors describe the concept of a special court of medical disputes which has its own peculiarities that is applying legal and medical principles in the court. In this study, the researchers used normative research methods. Where is meant by normative research is library law research. In conclusion, the special court in the settlement of medical disputes should be established to provide justice for the disputing parties, especially for medical staff because medical issues are something specific, so there is also a need for a judiciary that has the quality to resolve medical disputes laterKeywords: medical dispute; special medical court; medical personnel                                                                                          AbstrakPengadilan khusus medis dibentuk untuk mengadili sengketa medis antara tenaga medis dan pasien. Olehnya itu diperlukan pengadilan khusus untuk menyelesaikan sengketa medis, dimana pengadilan khusus ini megadili/menyelesaikan sengketa medis  baik secara pidana maupun perdata yang diharapkan mampu memberikan keadilan kepada semua pihak terutama kepada tenaga medis. Dalam hal ini penulis paparkan konsep pengadilan khusus sengketa medis yang memilki kekhasan tersendiri yang menerapkan prinsip-prinsip hukum dan medis dalam pengadilan tersebut. Dalam penelitian ini, peneliti mempergunakan metode penelitian normatif. Dimana yang dimaksud dengan peneltian normatif adalah penelitian hukum kepustakaan. Pada kesimpulannya pengadilan khusus dalam penyelesaian sengketa medik seyogyanya dibentuk untuk memberikan keadilan bagi para pihak yang bersengketa terutama bagi tenaga medis karena persoalan medik adalah sesuatu spesifik sehingga dibutuhkan juga peradilan yang mempunyai kualitas untuk menyelesaikan sengketa medik nantinya.Kata kunci: sengketa medis, pengadilan khusus medis, tenaga medis

Abstract

Problem of not optimal supervision by the Transmigration and Manpower Office of Southeast Sulawesi on companies in Southeast Sulawesi in the implementation of the Provincial Minimum Wage (UMP). This can be seen from the existence of companies in Southeast Sulawesi that have not paid wages in accordance with the predetermined Provincial Minimum Wage (UMP), even though the agency has mandated each company, so that all pay wages in accordance with the Provincial Minimum Wage (UMP). This study aims to determine: 1) How is the Mechanism of Supervision Authority on the Fulfillment of the Provincial Minimum Wage.This research is a normative and empirical research located in Southeast Sulawesi. Data obtained through surveys, interviews, and documentation. Overall data were analyzed quantitatively. Based on the results of the research that: 1) That the supervision of the implementation of the Provincial Minimum Wage by the Office of Transmigration and Manpower at companies in Southeast Sulawesi in general has been carried out well. However, 1 out of 10 indicators has not been implemented or is not good, namely requests for reports and information verbally from employees

Abstract

This article aims to examine the responsibilities that can be applied by the Board of Trustees and Supervisors of Land Deed Making Officials in terms of fostering and supervising Temporary Land Deed Making Officials (PPATS). The method used is normative or doctrinal legal research, is descriptive-prescriptive, focuses on examining primary legal materials and secondary legal materials, using statutory and conceptual approaches. Based on the results of the analysis that the form of accountability applied by the supervisory board and supervisor of Land Deed Making Officials in terms of fostering and supervising PPATS, namely, only imposing administrative sanctions in the form of; written warning; Temporary suspension; Dismissal with honor; Dismissal with disrespect, against PPATS who commit violations as a form of part of the guidance and supervision. Thus, the PPAT supervisory board and supervisors in being responsible for the task of coaching to PPATS, need to seek formal and informal guidance, as well as imposing strict sanctions on PPATS who commit violations in carrying out their duties.
