Abstract

This study aims to determine and analyze the settlement of Money Politics Crimes in the Regional Head Election in Majene Regency. In this study, the author uses a juridical empirical research method, The legal materials are analyzed using a statutory approach and a conceptual approach. The results of the study indicate that: (1) The process of resolving criminal acts of money politics in the Regional Head Election of Majene Regency is considered not optimal, due to frequent conflicts of opinion related to regulations between the Sentragakkumdu parties, namely Bawaslu, the Prosecutor's Office, and the Police, which is an obstacle for the Agency. General Election Oversight (BAWASLU) in handling cases of money politics. This difference of opinion should not have occurred because the regulations governing the Violation of Money Politics Crimes have been specifically regulated in Law Number 10 of 2016 concerning the Election of Governors, Regents, and Mayors, which in these rules are very clear on which ones can be categorized as Violations. Money Politics Crime. (2) A person can be held criminally responsible if he has fulfilled the elements or formulation of the offense that has been determined in the laws and regulations. Besides that, the most important thing from criminal responsibility is the existence of errors inherent in the perpetrators.

Abstract

Penelitian ini bertujuan untuk menganalisis pemidanaan terhadap pelaku tindak pidana korupsi dalam upaya penyelesaian tindak pidana perbankan, dan menganalisis faktor yang mempengaruhi penegakan hukum pidana korupsi terhadap upaya penyelesaian tindak pidana perbankan kaitannya dengan usaha, sikap dan/atau tindakan bank sebagai Badan Usaha Milik Negara. Penelitian ini merupakan tipe peneltian empiris. Teknik pengumpulan data melalu studi lapangan dan keputakaan, dalam hal ini adalah wawancara langsung dengan pihak-pihak terkait serta mengumpulkan bahan-bahan pustaka yang relevan dengan penelitian ini. Selanjutnya data yang diperoleh tersebut dianalisis secara kualitatif, lalu disajikan secara deskriptif yaitu dengan menjelaskan, menggambarkan, dan menjawab rumusan masalah sesuai dengan penjelasan yang sarat kaitannya dengan penelitian ini, kemudian menarik suatu kesimpulan berdasarkan analisis yang dilakukan. Hasil dari penelitian ini menunjukkan bahwa pemidanaan terhadap tindak pidana perbankan yang berkaitan dengan usaha, sikap dan/atau tindakan bank sebagai badan usaha milik negara memiliki sui generis tersendiri dan juga tetap mendahulukan pendekatan kepastian hukum. Dalam hal pengaturannya, masih mengalami kekurangan yakni belum adanya dasar hukum yang jelas mengatur terkait teknis pembayaran uang pengganti bagi pelaku tindak pidana korupsi secara umum dan tindak pidana korupsi pendebetan nasabah oleh pihak bank ataupun tindak pidana perbankan lainnya yang sangat merugikan nasabah secara khusus. Penegakan hukum terhadap pelaku tindak pidana korupsi di bidang perbankan sangat bergantung pada kepastian hukum yakni faktor undang-undang itu sendiri. Sedangkan faktor penegak hukumnya yaitu Jaksa Penuntut Umum masih mendahulukan pendekatan pemidanaan secara absolut. Padahal dalam konteks keadilan, harus juga dipandang penting pertimbangan pemulihan bagi pelaku agar dapat diterima kembali oleh masyarakat.Kata-Kunci: Perbankan, Korupsi, Badan Usaha Milik Negara This study aims to analyze the punishment of perpetrators of criminal acts of corruption in an effort to resolve banking crimes, and to analyze the factors that influence the enforcement of the criminal law of corruption on efforts to resolve banking crimes in relation to the business, attitudes and/or actions of banks as State-Owned Enterprises. This research is an empirical type of research. Data collection techniques through field studies and literature, in this case are direct interviews with related parties and collect library materials relevant to this research. Furthermore, the data obtained were analyzed qualitatively, then presented descriptively, namely by explaining, describing, and answering the formulation of the problem in accordance with the explanation that was full of relevance to this research, then drawing a conclusion based on the analysis carried out. The results of this study indicate that the punishment of banking crimes related to the business, attitudes and/or actions of banks as state-owned enterprises has its own sui generis and also prioritizes the legal certainty approach. In terms of regulation, there are still shortcomings, namely the absence of a clear legal basis relating to the technical payment of replacement money for perpetrators of criminal acts of corruption in general and criminal acts of corruption in debiting customers by banks or other banking crimes that are very detrimental to customers in particular. Law enforcement against perpetrators of criminal acts of corruption in the banking sector is very dependent on legal certainty, namely the factor of the law itself. Meanwhile, the law enforcement factor, namely the Public Prosecutor, still prioritizes the absolute punishment approach. Whereas in the context of justice, it must also be seen as important consideration of recovery for perpetrators so that they can be accepted again by the community.Keywords: Banking, Corruption, Owned Enterprises Country

Abstract

This article aims to examine the responsibilities that can be applied by the Board of Trustees and Supervisors of Land Deed Making Officials in terms of fostering and supervising Temporary Land Deed Making Officials (PPATS). The method used is normative or doctrinal legal research, is descriptive-prescriptive, focuses on examining primary legal materials and secondary legal materials, using statutory and conceptual approaches. Based on the results of the analysis that the form of accountability applied by the supervisory board and supervisor of Land Deed Making Officials in terms of fostering and supervising PPATS, namely, only imposing administrative sanctions in the form of; written warning; Temporary suspension; Dismissal with honor; Dismissal with disrespect, against PPATS who commit violations as a form of part of the guidance and supervision. Thus, the PPAT supervisory board and supervisors in being responsible for the task of coaching to PPATS, need to seek formal and informal guidance, as well as imposing strict sanctions on PPATS who commit violations in carrying out their duties.

Abstract

This study was written to find out and analyze the application of criminal conditions on children who are perpetrators of crimes based on Decision Number 2/Pid.Sus-anak/2020/PN.SKG and the implementation of criminal coaching outside the institution against children in accordance with the form of criminal conditions with conditions. The results of the study show that there are efforts from law enforcement to protect the rights of children in conflict with the law. Coaching outside the institution also really requires coordination between the Community Counselor and the child's parents. There is a legal vacuum in terms of technical regulations for fostering children outside the institution. So that the Supervision of Children should be made technical implementing regulations so that they can be used as a reference by the Community Counselor in carrying out their main duties and functions.  Keywords : Criminal Conditions; Child; Coaching.

Abstract

Analisis Tindak Pidana Kolusi dan Nepotisme dalam Undang-Undang Nomor 28 Tahun 1999. Pemberantasan Tindak Pidana Kolusi dan Tindak Pidana Nepotisme dilakukan dalam rangka mewujudkan good governance yang bersih dan responsif (clean and responsive state) yang ditandai dengan semaraknya masyarakat sipil (vibrant civil society) dan kehidupan bisnis yang bertanggungjawab (good coorporate governance). Namun, Undang-Undang Nomor 28 Tahun 1999 masih dianggap kurang aplikatif. Tujuan artikel ini adalah untuk mengetahui penafsiran frasa “kerugian orang lain, masyarakat dan/atau negara” dalam Undang-Undang Nomor 28 Tahun 1999 dan untuk mengetahui penegakan hukum dalam Tindak Pidana Kolusi dan Nepotisme. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan undang-undang, pendekatan kasus, dan pendekatan konseptual yang disajikan secara deskriptif kualitatif. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Bahan hukum bersumber dari peraturan perundang-undangan dan literatur lain. Teknik pengumpulan data dilakukan melalui penelitian kepustakaan (library research) atau dokumentasi hukum. Hasil penelitian menunjukkan frasa kerugian dapat berupa kerugian materil maupun non materil yang tersusun secara alternatif. Tidak harus terpenuhi keseluruhan unsur dari Pasal 1 Ayat 4. Artinya apabila salah satu diantara ketiga pihak tersebut dirugikan, maka rumusan delik ini sudah dimaknai telah memenuhi unsur. Frasa kerugian dapat terpenuhi apabila terpenuhinya kerugian nyata atau actual loss yang terlebih dahulu diperiksa atau diaudit. Masih terdapat berbagai persoalan baik dalam substansi hukum, struktur hukum maupun kultur atau budaya hukum yang dibuktikan bahwa belum ada satu pun kasus yang memiliki kekuatan hukum yang tetap yang dipidana menggunakan delik Kolusi dan Nepotisme.

Abstract

This study aims to analyze the legal arrangements for immigration detention efforts in law enforcement of immigration crimes. This research was conducted using empirical research methods conducted in Makassar Immigration Office Class I TPI. Data collection techniques through interviews and literature studies. The data collected is processed and analyzed using qualitative analysis techniques and presented descriptively. The results of this study indicate that: Implementation of immigration detention efforts in law enforcement of immigration crimes is basically set on Law Number 6 of 2011 concerning Immigration, Government Regulation Number 31 of 2013 concerning Implementing Regulation of Law Number 6 of 2011 concerning Immigration and Regulation of the Minister of Law and Human Rights Number 39 of 2021 concerning Immigration Crime Investigation Procedures.

Abstract

Juvenile cases in conflict with the law are ideally resolved through diversion, a restorative mechanism that prioritizes recovery, avoids stigmatization, and encourages participatory dialogue among stakeholders. However, in practice, diversion implementation in Indonesia often encounters systemic and cultural barriers, especially when relying solely on formal legal institutions. This study explores the role of Reconciliatory Customary Judges (RCJs) in Tana Toraja as culturally embedded mediators and reconstructs their potential function within the national diversion framework. Using a mixed-methods approach, the research combined qualitative interviews with customary leaders (to parenge), religious figures, and law enforcement actors, alongside quantitative surveys conducted among community members. The empirical findings reveal that RCJs hold significant social legitimacy, drawn from their alignment with tongkonan kinship systems and aluk todolo norms of deliberation (musyawarah). Their mediation practices reflect Islamic principles of reconciliation (sulh) and complement the restorative justice goals of the Juvenile Criminal Justice System (UU-SPPA). The study identifies a legal pluralism in practice, wherein Islamic, customary, and national legal traditions converge. RCJs have proven effective in resolving community conflicts and are trusted across generational lines, making them ideal mediators in diversion cases. The results call for the institutionalization of RCJ roles across diversion stages, including police, prosecution, and judiciary levels, to enhance cultural responsiveness, legal legitimacy, and social restoration. This research offers a transformative framework for integrating localized wisdom into national legal reform. By recognizing RCJs as formal diversion mediators, Indonesia can bridge gaps between normative aspirations and socio-cultural realities, promoting a restorative justice system that is legally sound, culturally resonant, and constitutionally grounded

Abstract

The phenomenon of motorcycle gangs involving children in Makassar City shows an increase in violent crimes, such as bowing, assault, abuse, and the use of sharp weapons, thus raising issues regarding the limits of criminal liability for children from the perspective of Indonesian criminal law. This condition creates a dilemma because on the one hand, children receive protection through Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA), while on the other hand, law enforcement must be able to provide protection to the community. This study aims to analyze the criminal liability of children for motorcycle gang crimes and the application of the Juvenile Criminal Justice System in realizing a balance between the protection of children's rights and the interests of law enforcement. The study uses a normative-empirical legal method with a statutory, conceptual, and case approach. Data were obtained through observations at the Makassar City Police Headquarters, analysis of laws and regulations, court decisions, and various relevant literature, then analyzed qualitatively using a descriptive-analytical method. The results of the study indicate that the criminal responsibility of children cannot be based solely on age, but must consider the elements of fault (schuld), the ability to be responsible, the form of participation, the level of intent (dolus), and the level of danger (social harm) caused. The phenomenon of motorcycle gangs in Makassar shows a shift from juvenile delinquency to organized collective crime, so that children who consciously play a role as the main perpetrator or active participant must still be held criminally responsible proportionally. This study also found that the implementation of the SPPA Law needs to be carried out proportionally by considering the level of child involvement, the potential for rehabilitation, and the impact of the crime on society in order to achieve a balance between the protection of children's rights, legal certainty, a sense of justice, and the interests of law enforcement.

Abstract

Digital sexual violence is escalating in Southeast Asia as social media, chat services, and cloud storage enable non-consensual recording, dissemination of intimate images, sexual threats, and technology-facilitated harassment. This article assesses Indonesia’s legal protection framework and draws regional lessons for reform. Using normative legal research with international human rights law and comparative legal study as its primary approaches, this article examines Indonesia’s criminal law policies and selected judicial decisions concerning electronic-based sexual violence under the Sexual Violence Criminal Acts Law (SVCA Law, Law No. 12/2022) and the Electronic Information and Transactions Law (EIT Law, Law No. 19/2016). The analysis finds that Indonesia has advanced by criminalizing electronic-based sexual violence under the SVCA Law, yet sanctions remain focused on imprisonment and fines, leaving gaps for effective deterrence when offenders repeatedly exploit online communication tools. A recent revenge-porn case illustrates judicial experimentation with internet-access restrictions and the countervailing legality principle. Comparative insights from Canada and Germany show that court-supervised digital restrictions can be structured as additional penalties, while regional experiences in Malaysia, Thailand, and Japan underscore the value of conduct-specific offences and safeguards. The article proposes amending the SVCA Law, as lex specialis, to authorize proportionate revocation or limitation of online-communication access, supported by clear criteria, review mechanisms, and consistent inter-agency monitoring to balance constitutional freedoms and human rights.
