Abstract

Penelitian ini bertujuan untuk menganalisis kebijakan pemberlakuan izin usaha pemondokan dan permasalahannya dengan studi di Kota Surabaya yang telah mulai diterapkan dengan dasar Peraturan Walikota Surabaya Nomor 79 Tahun 2018 tentang Tata Cara Penyelenggaraaan Usaha Pemondokan. Penelitian ini menggunakan jenis penelitian non doktrinal khususnya jenis sociolegal. Penelitian sociolegal adalah penelitian pada ilmu hukum yang tidak hanya mengkaji sistem norma dalam aturan perundangan saja, namun juga mengamati aspek sosial (ekonomi, politik, sosial dan budaya) yang mempengaruhi. Berdasarkan hasil kajian dan analisis, maka dapat disimpulkan bahwa kebijakan pemberlakuan izin usaha pemondokan relatif masih terdapat beberapa kendala diantaranya dalam hal tingkat pengetahuan masih relatif sangat sedikit, hal ini dikarenakan pemerintah baru sebatas mengundang stakeholder terkait, Lembaga Ketahanan Masyarakat Kelurahan, dan beberapa perwakilan pemilik usaha pemondokan (kos-kosan) dalam menggali aspirasi penyusunan perwali dan sosialisasi perwali setelah disahkan. Dengan keterbatasan kuantitas, tingkat pengetahuan masyarakat akan diberlakukannya izin pemondokan masih sangat terbatas. Kedua, bahwa tingkat kesadaran hukum penyelenggara rumah pemondokan terkait kewajiban memiliki Izin Usaha Pemondokan relatif masih rendah. Karena dari empat indikator kesadaran hukum yakni pengetahuan, pemahaman, sikap, dan perilaku, hanya indikator sikap saja yang memenuhi, sementara indikator yang lain masih belum memeunuhi

Abstract

In general, there are at least 3 functions of the people's representative body. First, the function of legislation. Second, the supervisory function. Third, the budget function. This type of research used in this study is normative research. By using a statutory, conceptual and historical approach. The authority of the DPR's oversight before and after the amendment to the 1945 Constitution does not only lie in the regulation, where before the change is stipulated in the explanation and after the amendment to the 1945 Constitution is regulated in the Articles of the Constitution, but there is an expansion of the intended subject. In the 1945 Constitution prior to the amendment, the supervision of the House of Representatives was only addressed to the President whereas after the amendment to the 1945 Constitution the supervision of the House of Representatives was not only addressed to the President, but to all agencies or officials who carried out Government functions. The authority of the House of Representatives in conducting oversight becomes wider after the issuance of the Constitutional Court ruling No. 36 / PUU-XV / 2017, because independent state institutions, such as the Corruption Eradication Commission and the Election Commission can be subject to oversight by the House of Representatives.

Abstract

The general election organizing body is an institution designed to have a check and balance function so that it is oriented towards realizing a democratic process in accordance with the constitution. In Indonesia, the institution responsible for the implementation of the general election is not only the General Election Commission but also other institutions, such as the General Elections Supervisory Board and the Honorary Council for General Election Organizers. This study seeks to initiate the structuring of the General Election Commission and the General Elections Supervisory Agency in supervising and handling disputes over the General Election process. This research is a legal research. This research uses a statutory approach, a conceptual approach, and a historical approach. The results of this study indicate that if it is made in stages, if the election participants do not accept the General Election Commission's attitude, then the election participants can appeal to the General Elections Supervisory Agency, and if there are parties who cannot accept the decision of the General Elections Supervisory Board, then the those who cannot accept it should file a lawsuit to the State Administrative High Court.

Abstract

Amendments to the 1945 Constitution have provided support to the DPR, including strengthening the DPR's oversight function. Article 22 Paragraph (2) of the 1945 Constitution of the Republic of Indonesia. The DPR's supervisory function as a compilatory composer is elaborated in Article 79 paragraphs (2) and (3) of Law No. 17 of 2014 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council and the Regional People's Representative Council (MD3). In Article 79 paragraphs (2) and (3) of MD3 Law only norms are formulated which become the object of interpellation and the questionnaire rights are legislation and policies. The formulation of Article 79 paragraphs (2) and (3) does not explain the parameters used by the DPR to request policies from the Government. The purpose of this article is to provide parameters for the use of interpellation rights and questionnaire rights to government policies. This type of research in this paper is normative research. With primary legal material for the 1945 Constitution of the Republic of Indonesia and Law No. 17 of 2014 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council and the Regional People's Representative Council (MD3). The parameters of the right of interpellation and the right of questionnaire to government policies that were born from free government authority are general principles of good governance (AAUPB).

Abstract

East Java was originally a sugarcane plantation and the main sugar producer in Indonesia. This inability is caused by the decreasing land for planting sugarcane, especially in Java. Since the 19th century, the islands of Java and Sumatra have been among the largest sugar producers. The largest land area is on the island of Java. The quality of the soil and climate are very good for sugar plants. The problem is land conversion. Land conversion occurs due to the development of large cities and their satellite cities. The development of these cities requires land for residential and factory functions. This is actually not a problem as long as there is careful planning and strict implementation of the spatial planning of the area. This study tries to examine the synergy between sugarcane plantations and spatial planning and its implementation. By examining the case of the closure of three sugar factories in Sidoarjo Regency, the study shows that inconsistency in maintaining planting land has resulted in sugar factories experiencing difficulties in sugarcane supply.

Abstract

The expansion of the authority of acting regional heads following the enactment of Circular Letter (SE) Number 821/5492/SJ actually raises legal issues. The legal issues include the legal certainty of the Circular Letter, which is a policy regulation and not externally binding, and is in conflict with statutory regulations. This research focuses on the legal implications of the authority of acting regional heads to dismiss and transfer ASN based on legal products in the form of SE, where the authority of acting regional heads is based on Law No. 10 of 2016. This research is a normative legal study that emphasizes a conceptual and legislative approach. Research findings indicate that the existence of Circular Letter (SE) Number 821/5492/SJ, which expands the authority of acting regional heads, has implications that create legal uncertainty. The recommendation from this research is that amendments to Law Number 23 of 2014 are necessary to clearly regulate the authority of acting regional heads.

Abstract

The prohibition in the Regional Head Election campaign has actually been regulated in Article 69 letter i of Law Number 1 of 2015 concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of 2014 concerning the Election of Governors, Regents, and Mayors into Law. In line with the time, there was an application for judicial review of the article a quo in which the Plaintiffs argued that they suffered constitutional losses. The constitutional judge granted the Petitioners' petition in its entirety through the Constitutional Court Decision Number 69/PUU-XXII/2024. The purpose of this study is to analyze and describe the racio dacidendi of the constitutional judge who granted the Petitioners' petition in its entirety along with the legal consequences of the Regional Head Election campaign in higher education. The type of research used in this research is normative juridical research with a research approach, namely a statute approach, case approach, and conceptual approach. The legal materials used are primary, secondary, and tertiary legal materials. The results of this study show that constitutional judges use historical (original) interpretation. However, the existence of the decision a quo actually creates a norm conflict with Article 8 paragraph (1) of Law Number 12 of 2012 concerning Higher Education. In addition, there are also violations of the principles stipulated in Article 3 of Law No. 12 of 2012, namely the principle of benefit, the principle of virtue, and the principle of responsibility. There are suggestions from researchers as a form of recommendation, namely the Constitutional Court needs to encourage the House of Representatives as the legislator to immediately revise the Regional Head Election Law to ensure legal certainty and also emphasize the importance of protecting the academic community from the potential influence of practical politics in the university environment and the House of Representatives needs to immediately revise the Pilkada Law to be in line with the Constitutional Court Decision No. 69/PUU-XXII/2024.
